Cities across America are going soft on crime because of the increasing homeless numbers skyrocketing.

Calling them survival crimes for the homeless, authorities across the U.S. are just not enforcing the laws. Saying there now appears to be two sets of laws: those for regular hard working people and those for the homeless, giving them a pass. The question being what does that say for the small businesses around the areas these homeless people live?

Editor's Note: The problem has reached such a level that Fox News actually did this news clip. Sounds like they're saying 'hey retailers accept the losses and consider your part of helping these homeless people'. With no regard to the other crimes that this activity causes. Failing to Provide Robust Security Knowing of Dangerous Employee
Judge Rules No Insurance Coverage For Kwik C-Store in Dallas

The Fifth Circuit on Friday affirmed that United Fire and Casualty Co. has no duty to defend or indemnify a Texas convenience store chain in a lawsuit brought by an employee who alleged she was sexually assaulted by a co-worker,

The incident giving rise to the still-pending underlying suit occurred in August 2014. As recounted in the complaint, an employee of a Midland Kent Kwik convenience store was locking up at the end of a shift when she was attacked and sexually assaulted by a co-worker who had come over from another store. The suit didn't provide any further details, nor did it name the co-worker, who was not included as a defendant.

The employee accused Kent of failing to provide more robust security measures at the convenience store and of having "knowledge of the dangerous nature of the attacker well before the incident occurred" but still allowing him to work for the company.

the claims asserted by the Kent employee clearly fall under "employer's liability" and "abuse or molestation" exclusions in the Midland-based company's primary and umbrella liability policies. law360.com

Woman sues Subway after 'hero' son died protecting her during robbery inside store
A woman is suing a Subway franchisee almost two years after her son was gunned down in the restaurant in southeast Houston while protecting her from two armed robbers — a crime that gripped the community and prompted an outpouring of support from friends and neighbors. Hilda Vasquez filed the lawsuit through her attorney, Paul Skrabanek, on Tuesday in Harris County Civil Court. Both Vasquez and her son, Javier Flores, were working at the Subway at the time of the robbery. Government shutdown poses cybersecurity threat
Oversight agency has furloughed more than 40% of its staff

"The government shutdown is a major setback with potentially severe effects," cybersecurity experts said, the shutdown is hurting morale at a critical government agency that monitors threats to the financial industry, telecommunications networks and power grids.

The Cybersecurity and Infrastructure Security Agency, part of the Department of Homeland Security, has furloughed 43% of its staff—more than 1,500 of its 3,541 employees. In addition, the lack of funding is slowing the build-out of the National Risk Management Center, which Homeland Security launched in July with the aim of beefing up collaboration with the private sector and pooling information on threats across different industries.

Most of the staff members who are still working, albeit without pay, are assigned to a division known as the National Cybersecurity and Communications Integration Center, according to Dave Weinstein, vice president of threat research at Claroty, a cybersecurity software company in Manhattan.

The US government shutdown is having a chilling effect on national cybersecurity, with 80 government web certificates having already expired without being renewed and FBI agents issuing a stark warning.

Americans Think the US is Prepared for a Cyberattack
Of 26 countries surveyed by Pew Research, Americans are among the most likely to say cyberattacks will happen.

Nearly half (47%) say their country is well prepared to handle a major cyberattack, but an equal share disagrees. Attitudes vary widely by country. Two-thirds or more in Israel (73%) and Russia (67%), for example, say their nations are ready for a major cyber incident, while fewer than one-in-five Brazilians (16%) and Argentines (9%) say the same. In the United States, just over half of Americans (53%) think their country is prepared to handle a major cyberattack.

Parcel Guard joins the fight against porch pirates
Appliance manufacturer Danby unveiled a smart mailbox at the Consumer Electronics Show in Las Vegas this week that can operate as a securely locked safe to protect delivered packages from theft, according to a TechCrunch report.

The mailbox, called Parcel Guard, has an anti-theft drop-in slot similar to many standard mailboxes, but also has a large door and enough space to store a package. The door can be opened when a delivery person scans the package. It locks automatically after the package is placed inside, the story stated.

The Parcel Guard box also has an alarm, a camera that allows a customer to remotely watch their delivery, and a wireless connection through which the customer is alerted when the delivery has been completed, according to the company website. retaildive.com

Online holiday sales surge 17.4% and reach $122 billion

Schaumburg, IL: Thieves Stole $23K Worth of Apple Products From Suburban Target; 25 iPads and 25 Apple Watches
Three men reportedly stole dozens of Apple products from a popular suburban Target store during a smash-and-grab late Thursday. Just as the Schaumburg store was preparing to close, one man distracted an electronics employee while two others broke into cases housing Apple products and stole $23,750 worth of items. nbcchicago.com

Keene, NH: Booster Box / thefts linked to $20,000 of stolen merchandise at Online Marketplace in NJ
James Falk, 37, was arrested on a charge of driving while under the influence of drugs. After Falk's arrest, Sgt. William DiLegge and Trooper Zachary Bernier of Troop C conducted an initial inventory of the contents of Falk's vehicle "to document and protect the integrity of Falk's belongings ..." During the inventory, the troopers found a partially open Keurig coffee pot box, which was later identified as a makeshift Booster Box. The troopers also discovered drugs and a file folder container in the front seat which was full of receipts from various stores. Before securing the vehicle, troopers saw three, brand-new Nest Home Thermostats with the retailer's security device still around each of the boxes.

Once a search warrant was received, troopers inventoried the contents of the vehicle, which included the drugs, the thermostats, smart home lighting systems, Ring Alarm home security systems, Moen and Delta sink faucets, MyQ garage door openers, Phillips Sonic Care toothbrushes, power adapters, a GeoForce gaming console, a JBL bluetooth speaker, and Dewalt and Rigid power tools with battery packs; total value nearly $6,000. The messages (on Falk’s cellphone) included a discussion about stores in Keene, including Home Depot, Bed Bath and Beyond, Kohl's, Dick's and Target.

Further investigation revealed, from Aug. 6 through Sept. 18, 2018, more than $20,000 in stolen merchandise was sent by Falk to RK (Russian person living in Elizabeth, NJ and Brooklyn, NY) , for which RK sent 60 to 70 percent of the retail value back to Falk. reformer.com

Update: Pittsburgh, PA: Mt. Pleasant Twp. store owner to fight Corruption charges
Charged with selling Millions in stolen merchandise

A Mt. Pleasant Township grocery store owner, accused of racking up millions of dollars in illegal profits by selling stolen items, waived his preliminary hearing Thursday and opted to proceed to trial. But don’t read too much into the decision, his lawyer warned.

“There is no plea agreement,” said Francis R. Murrman, the attorney for well-known Bridgeport store owner Melvin “Beanie” McCloy, 60. McCloy appeared before Norvelt District Judge Roger Eckels on charges filed by state police and Fayette County detectives of running a corrupt organization, dealing in proceeds of unlawful activities, receiving stolen property and fraudulently trafficking in food orders for allegedly selling stolen groceries over the past three years. Arlington, TX: Shootout during traffic stop leaves officer wounded, suspect dead outside Shopping Mall
The shooting occurred just after 10 p.m. after an unspecified traffic violation on West Randol Mill Road. The officer who stopped the car called for backup after seeing that there were four people in the car, three men and the woman driving. After the arrival of two backup officers, a man and a woman, the driver and her front-seat passenger were asked to step out of the vehicle. While the female officer spoke to the driver, the passenger took off running through a parking lot outside a Tom Thumb grocery store, and the two policemen chased him. Lake Charles, LA: Victim of Shooting found outside C-Store
Lake Charles Police Department says a man entered a convenience store about 1 a.m. Friday and threatened another man with a gun. The statement says officers responding to a call about the incident found a man about a block away from the Raceway store minutes later. Police aren't saying exactly what happened after that. But the statement says an officer opened fire, killing a man with a gun. thestate.com
 
Murray, UT: Police searching for 3 suspects in Fashion Place Mall shooting; 2 injured
Two people were wounded in a shooting just outside a popular Utah mall Sunday where hundreds of scared shoppers hunkered down until police arrived to evacuate the building. Police are actively searching for three suspects, all Hispanic males in their early 20's, seen wearing dark pants and light-colored hoodies. Police are investigating the shooting, which happened on the east side of the mall near the south entrance, as gang related. Police stormed surrounding neighborhoods searching for the suspects, that includes a heavy police presence near 6200 South and 400 East in Murray. Gloucester County, NJ: Man shot by police after taking 2 women hostage at UPS facility
A man was in custody Monday after authorities said he took two women hostage at a UPS Mail Innovations facility in New Jersey, police confirmed. The incident, which started just after 9 a.m. Monday, ended around 12 p.m. after officers opened fire on the hostage taker, officials said. Although authorities confirmed shots had been fired, no serious injuries were reported to either of the hostages. The condition of the suspect was not immediately known, although police confirmed in a news briefing that, “He did not surrender.” ajc.com

Wichita, KS: Suspect still critical after officer-involved shooting
The 29-year-old man shot by Wichita police Thursday is still in critical condition as of Friday morning. Deputy Police Chief, Troy Livingston, provided new details at the Friday police briefing. Two Wichita officers had been looking for the 29-year-old suspect for a couple weeks. He had warrants for several violent crimes, including an armed burglary, and for pointing a gun at a loss-prevention officer at a store.

Officers learned this man would be at the Department of Correction building around 1 p.m.. He showed up around 1:04, and officers moved in after the suspect’s girlfriend got out the car to go into the building. A Department of Corrections employee pulled his car behind the suspect, to block him into a parking space, as two Wichita officers approached from the side, with guns drawn.

The suspect was told to get out of his car, but instead backed into the KDOC vehicle. While pulling forward, the two Wichita officers fired, fearing he was going to run over one of them. One officer climbed onto a parked car to get out of the way, but neither officer was hurt. The suspect was shot several times and got his car out of the parking lot, before crossing Main and hitting a wall. One officer was cut by glass while pulling the suspect from his car. A gun was found on the suspect, and the tag on his car had been reported stolen. Giving a time frame Friday morning, Livingston said all of this happened within a couple minutes. kfdi.com

Jersey City, NJ: Chaos at Newport Centre Mall as shots fired in gang feud; two men wounded
A gang shooting led to the evacuation and lockdown of the Newport Centre mall in Jersey City on Friday, authorities said. A fistfight followed by gunfire erupted at the mall’s food court shortly after 6 p.m., said police. Some stores remained locked down nearly two hours later. No one was reported injured in the lockdown or the evacuation. nydailynews.com

Authorities are searching for five men who allegedly staged a fake fight at a Long Island Walmart and caused a panic among shoppers. It happened at the location on Crooked Hill Road in Commack just after 12:30 p.m. on December 2. Police say the men were creating a video inside the store without permission and created a disturbance and prompted a store-wide panic. abc7ny.com

Update: St Louis County, MO: Prosecutor will not seek death penalty in Catholic Supply store murder
St. Louis County prosecutor Wesley Bell says he won't seek the death penalty for a man accused of killing a woman and sexually assaulting two others inside a religious supplies store. Bell said Friday in a statement to The Associated Press that he will seek life in prison without the possibility of parole for Thomas Bruce. Bruce is charged with first-degree murder and other crimes in the Nov. 19 attack at the Catholic Supply store near the St. Louis suburb of Ballwin. Authorities say he fatally shot 53-year-old Jamie Schmidt when she refused his sexual demands. abcstlouis.com

Listening and hearing what your internal customers are saying is critical if you expect to be successful with any program or project. Oftentimes, the speed of delivery negatively impacts the process of success and keeps us from hearing exactly what we need to hear when we so passionately roll out our programs and projects. After testing and reviewing our plans and being so committed to our beliefs, we oftentimes don't hear our retail partners once we've committed ourselves to a specific path. And sometimes it's not what they say that's important as much as what they don't say or as much as what they quietly say beneath their breath or maybe even how they react. Whenever you're rolling out a new program or project, use those interrogative skills, in a positive way, and read the reactions of your internal customers because they will determine the success regardless of how good it is.
