NRF says ‘state of the economy is sound’ and forecasts retail sales will grow between 3.8 and 4.4 percent in 2019

The National Retail Federation today forecast that retail sales during 2019 will increase between 3.8 percent and 4.4 percent to more than $3.8 trillion despite threats from an ongoing trade war, the volatile stock market and the effects of the government shutdown.

“We believe the underlying state of the economy is sound,” NRF President and CEO Matthew Shay said. “More people are working, they’re making more money, their taxes are lower and their confidence remains high. The biggest priority is to ensure that our economy continues to grow and to avoid self-inflicted wounds. It’s time for artificial problems like trade wars and shutdowns to end, and to focus on prosperity not politics.”

Preliminary estimates show that retail sales during 2018 grew 4.6 percent over 2017 to $3.68 trillion, exceeding NRF’s forecast of at least 4.5 percent growth. The number includes online and other non-store sales, which were up 10.4 percent at $682.8 billion. That met NRF’s forecast of 10-12 percent online growth, and online is expected to grow in the same 10-12 percent range again this year. The numbers exclude automobile dealers, gasoline stations and restaurants.

Growth of between 3.8 percent and 4.4 percent would result in total 2019 retail sales of between $3.82 trillion and $3.84 trillion. Based on growth of 10-12 percent, online sales would total between $751.1 billion and $764.8 billion, which are included in the total. nrf.com



Florida Retail Federation Fights Proposed Felony Theft Threshold Increase
Two proposed bills would raise Florida's threshold from $300 - 2nd lowest in the country behind New Jersey - to either $1,000 or $1,500

If you steal anything worth $300 or more in Florida, you can be convicted of a felony, lose your voting rights, and go to jail for quite a while. It's the second-lowest felony theft threshold in America, behind New Jersey. Florida hasn't updated the number since 1987.

Justice-reform advocates on the left and right have been trying to raise that threshold for years, but one massively powerful lobbying group has stood in the way: the Florida Retail Federation, the largest big-retail-business lobbying group in the state. The Federation, which represents Target, Walmart, Publix, Walgreens, Lowe's, Walt Disney World, Best Buy, and virtually every other major retail chain in Florida, has long lobbied to keep the theft-threshold as low as it is — despite the fact shoplifting rates haven't increased in the 48 other states where the felony minimum is higher.

And now, with two different bills filed for the 2019 legislative session to raise the threshold, the Federation has told New Times it will lobby against them. One of the bills would raise the level to $1,000, the other to $1,500. While many other states have similar felony minimums — some have set thresholds as high as $2,500 — a lobbyist with the group, James Miller, said via email last week that the Federation believes these numbers are too high. browardpalmbeach.com

New Jersey moves closer to banning cashless stores
All that is needed for New Jersey to become the second state in the nation to ban cashless store is the signature of Gov. Phil Murphy. New Jersey legislators have passed a bill to prevent businesses from banning consumers from using cash for purchases. The bill, which passed with overwhelming support, applies only to point-of-sale purchases and excludes mail, telephone and Internet sales. Under the proposed law, violators would be subject to a civil fine of up to $2,500 for the first offense and $5,000 for the second. Further violations would be considered unlawful practices under the state’s Consumer Fraud Act. chainstoreage.com

FBI reportedly carried out a sting operation on Huawei at a burger joint
The makers of a super-hard smartphone glass made partially of synthetic diamonds took part in an FBI sting on Huawei, according to a new Bloomberg report. The operation apparently took place at a Prime Burger joint in Vegas during CES last month, while a Businessweek reporter watched from a nearby gelato stand.

The embattled Chinese company had ordered samples of the "Miraj Diamond Glass" from US startup Akhan Semiconductor in 2017, only to return them badly damaged. Suspecting Huawei of intellectual property theft, Akhan's founder Adam Khan reportedly contacted the FBI, which drafted him and COO Carl Shurboff to take part in its Huawei investigations. engadget.com

The Loss Prevention Benevolent Fund was recently selected to receive a donation from the ISCPO at this year’s conference. The conference, which will be held March 6 – 7, 2019 in Irving, TX, focuses on supply chain security, industry theft, global trends and investigation.

Facial-Rec 'Smart Coolers'
Walgreens tests tech that sort of recognizes you in-store

Walgreens is piloting a line of “smart coolers” with the ability to display targeted ads to in-store shoppers. Instead of seeing through the glass to drinks, ice cream and other items, shoppers view digitized representations of available products inside, or basically a planogram on the front of refrigerator and freezer doors.

The system involves using sensors that detect shoppers and cameras that scan their faces to estimate their gender and approximate age for delivering targeted messages. Weather, time of day and other events may also influence messaging.

Beyond messaging, iris-tracking technology can show which items are picked up or are looked at, providing insights into the effectiveness on-screen promotions and the overall display.

The digital screens on the coolers further give retailers the ability to make real-time changes to pricing and promotions. Alerts to out of stocks is touted as another benefit.

According to The Wall Street Journal, about 15 brands, including Nestle and MillerCoors, are also testing the technology from the start-up, Cooler Screens. Microsoft was involved in Cooler Screens’ latest funding round and provides software that powers the technology.

Facial recognition software in retail is becoming more common in Asia to support mobile payments. But some see facial scanning as an invasion of privacy that doesn’t ask for consent from the consumer.

Walgreens is posting privacy statements near the coolers and a concierge will be available in test stores to explain the technology. retailwire.com

Home Depot Applicant Says Credit Check Forms Are Improper
Home Depot USA Inc. asked new job applicants for permission to check their credit histories using forms that violated the Fair Credit Reporting Act, according to a proposed class action in California federal court.

Ross Mitchell, who applied to work at a Home Depot location in Santa Rosa, California, alleged Friday that the company gave him a "standard application form" that didn't properly disclose the retailer's intention to conduct a credit check.

Mitchell is suing on behalf of himself and anyone for whom Home Depot obtained a consumer report "for employment purposes" in the last five years, his complaint states. He estimates this amounts to more than 1,000 individuals. law360.com

Ghosting in the Workplace
Thanks to a solid labor market and historically low unemployment rates, candidates and employees are starting to ghost companies more frequently than ever before. When it’s easy to get another job, it makes it that much easier to just get up and leave ... or never show up in the first place.

NPR recently reported on this trend, featuring a story of a disgruntled manager who caused thousands of dollars of missed revenue by ghosting on a shift. This is the first type of workplace ghosting: when current employees just decide to quit without giving any notice. They simply don’t show up.

Other types of workplace ghosting happen more frequently with job candidates. Recruiters and hiring managers can attest to the growing problem of candidates not showing up for interviews, an issue that can happen as frequently when hiring for managerial positions as it does for entry-level jobs. New York Governor Andrew Cuomo is facing some obvious opposition to his campaign to offer Amazon a home in Long Island City for its new headquarters. Americans are lining up to work for Amazon for $15 an hour
Amazon disclosed in its latest earnings report that it received a record 850,000 work applications for hourly jobs in the US in October 2018 after announcing it would raise its minimum wage to $15 an hour starting Nov. 1. The company said that was more than double its previous record for job applications received in a single month.

Amazon said the new $15 minimum affects more than 250,000 employees in the US and 17,000 employees in the UK, plus more than 200,000 workers who were hired for the holiday season. As of Dec. 31, Amazon had 647,500 full- and part-time employees, up 14% from the same period a year earlier. qz.com

Crypto CEO dies with the password to unlock $200+ million of customers' Bitcoin
Digital-asset exchange Quadriga CX has a $200 million problem with no obvious solution -- just the latest
cautionary tale in the unregulated world of cryptocurrencies.

The online startup can’t retrieve about C$190 million ($145 million) in Bitcoin, Litecoin, Ether and other digital tokens held for its customers, according to court documents filed Jan. 31 in Halifax, Nova Scotia. Nor can Vancouver-based Quadriga CX pay the C$70 million in cash they’re owed.

Access to Quadriga CX’s digital “wallets” -- an application that stores the keys to send and receive cryptocurrencies -- appears to have been lost with the passing of Quadriga CX Chief Executive Officer Gerald Cotten, who died Dec. 9 in India from complications of Crohn’s disease. He was 30.

Cotten was always conscious about security --
the laptop, email addresses and messaging system he used to run the 5-year-old business were encrypted, according to an affidavit from his widow, Jennifer Robertson. Huddle House fast food chain announces breach of POS system
Huddle House says POS vendor got hacked and hackers used a vendor tool to deploy malware on restaurants' POS systems.

US-based casual dining and fast food restaurant chain Huddle House announced late Friday last week a security breach that impacted its point of sale (POS) system.

"Criminals compromised a third-party point of sale (POS) vendor's data system and utilized the vendor's assistance tools to gain remote access-and the ability to deploy malware-to some Huddle House corporate and franchisee POS systems," Huddle House said in a security alert listed on its front page.

The restaurant chain says it found out about the infection after receiving notifications from a law enforcement agency and a credit card processor. Huddle House notified users right away. An investigation is still ongoing, with the help of third-party forensic experts and federal law enforcement. zdnet.com

Exposed Consumer Data Skyrocketed 126% in 2018
Business Sector Hit With Most Breaches, But Least Data Compromised

According to a new report from the Identity Theft Resource Center, there were 1,244 breaches reported in 2018, marking a 23% drop from the year prior. But the reported number of consumer records containing personally id
entifiable information (PII) significantly increased from 197.6 million to 446.5 million – a 126% jump. ITRC notes the actual total number of records exposed is likely higher, given that only half of reported breaches disclose the number.

Sensitive PII wasn't the only type of data tracked for this year's report. The number of non-sensitive records (email addresses, passwords, usernames) exposed in data breaches amounted to an additional 1.68 billion compromised records exposed in only 37 of 1,244 incidents.

The lowest rate of exposure was in the business sector, which was hit with the most data breaches (571) but had the smallest amount of data compromised in each. Healthcare had the second-highest number of breaches (363) but had the highest rate of exposure at 9.92 million records total. darkreading.com

Facebook, Friendly Fraud And Friction
What enabled Amazon to outstrip its competition in its early years? While there were many reasons, the ecommerce firm's ultra-easy ordering process was a key contributor. From the start, founder Jeff Bezos was obsessed with "frictionless shopping." This led to the firm's patented one-click ordering process.

From an ecommerce standpoint, reducing friction is one of the easiest ways to boost sales. But, there may be times when a little friction could offer a benefit to users and customers. Facebook's early process for in-game purchases is one such example.

An investigative report by Nathan Halverson in Reveal, a publication of The Center for Investigative Reporting, shows the social media giant allowed something akin to one-click ordering in games like Angry Birds and Petville despite being aware that some of these purchases were made by minors without their parents' knowledge. The report examined documents dated from 2010 to 2014, neatly bracketing Facebook's 2012 initial public offering.

Friendly Fraud. Facebook called this "friendly fraud." The report shows that not only did the firm know that minors were spending thousands of dollars, often unknowingly, but the firm then fought parental attempts to get refunds.

The route to spending real money in these games made Amazon's one-click process look sluggish. The ecommerce firm, at least, showed you a confirmation screen clarifying what you bought, what it cost, and when it would be delivered. Minors racked up hundreds and even thousands of dollars in charges before parents discovered the charges.

Friction Fix. Facebook engineers quickly devised a solution that would reduce the extraordinarily high chargeback rates on in-app purchases. They would turn the effortless purchasing process into something a bit more difficult by asking for the first few numbers of the credit card to be entered. Not only would this make it crystal clear that money was being spent, it would require access to the credit card number. forbes.com

Amazon added first-ever warning about counterfeit products to its earnings report
Amazon is warning investors of one of the biggest problems facing its online marketplace: counterfeit products.

Under the “risk factors” section of its annual report, Amazon added a new line addressing counterfeit problems on its marketplace.

“We also may be unable to prevent sellers in our stores or through other stores from selling unlawful, counterfeit, pirated, or stolen goods, selling goods in an unlawful or unethical manner, violating the proprietary rights of others, or otherwise violating our policies,” the filing said.

The disclosure reflects Amazon’s increased concern over the counterfeit problem on its marketplace, as the words “counterfeit” and “pirated” were never mentioned in its annual filing before. While Amazon publicly says it has a “zero tolerance” policy for counterfeit products and has built new technology to deal with the problem, its marketplace that allows third-party merchants sell goods continues to be plagued by knockoffs. cnbc.com

Jenay Marie Evans, 25, is facing charges of grand theft and scheme to defraud. The store manager told police he went through records and noticed Evans used her manager's 'no sale' thumb print to get into the register and take cash. The manager noted a more than average number of 'no sale' register entries and less "cash pulls" when Evans worked. Deputies arrested a suspect armed with a knife after they say he barricaded himself at a Subway in White Center on Monday evening. Investigators said the incident started with a 911 call from a nearby car where a family member reported the suspect had assaulted them and damaged their car. Minnesota: 4 convicted in Twin Cities Auto Part store Armed Robberies
Four men have been convicted in connection to a string of auto part store robberies that occurred in the Twin Cities, according to a release from the U.S. Attorney's Office. The release said Tony Lendell Reed was guilty of six counts of interference with commerce by robbery. Reed was convicted Friday. According to the U.S. Attorney's Office, Reed and his co-conspirators robbed auto part stores in the Twin Cities on six different occasions. During the robberies, the four men displayed what victims said appeared to be a firearm. The men also restrained the employees by using zip ties to bind the victims' wrists and ankles, according to the release. kstp.com

San Bernardino, CA: ‘White glove bandit’ sentenced to more than 16 years in prison for robbery
Parsons, 38, whom prosecutors dubbed the ‘White Glove Bandit’, pleaded guilty last August to multiple robberies between April 14 and July 21 in 2015. He targeted businesses in Redlands, Upland and Ontario. He also robbed banks in Palm Desert, Banning and Irvine. Locations robbed included a Toys “R” Us, Boot Barn, David’s Bridal, Wells Fargo, Chase and Community Valley Bank, according to the Attorney’s Office. sbsun.com
