Jury hits Walmart with $16.9M verdict in 2015 shoplifter apprehension incident
Walmart found 30% responsible for customer's injuries

A Wood County, Virginia jury returned a verdict of $16,922,000 against Walmart on Monday as a result of its failure to maintain its premises in a reasonably safe condition when attempting to apprehend a shoplifter in February 2015 which led to injuries to one of its customers Diane Ankrom.

In 2015, a shoplifter was arrested at the Parkersburg Walmart. However, while Walmart employees were trying to detain him, the man ran into a woman inside the store and injured her. A lawsuit was filed against the shoplifter, as well as Walmart, for not properly handling the shoplifter, which led to the shopper’s injuries.

The jury in Circuit Judge J.D. Beane’s court listened to five days of testimony and deliberated for less than two hours before reaching its verdict, which included $6.5 million in past and future medical expenses and over $10 million in general damages. The jury found Walmart to be 30 percent responsible for the incident and the shoplifter to be 70 percent responsible.

Jamie Bordas of the Wheeling-based law firm of Bordas & Bordas who served as lead counsel for the plaintiff at trial commented, “We are hopeful that this jury’s verdict sends a message to large corporations that they are not supposed to put profits over safety. The shoplifter in this incident had merely stolen gloves and had already given them back before Walmart persisted in attempting to detain him in an inappropriate manner that ultimately led to one of its customers being injured.” wtov9.com bordaslaw.com

These Cameras Can Spot Shoplifters Even Before They Steal
Japanese startup’s 'Minority Report'-like software detects suspicious behavior

It’s watching, and knows a crime is about to take place before it happens.

Vaak, a Japanese startup, has developed artificial intelligence software that hunts for potential shoplifters, using footage from security cameras for fidgeting, restlessness and other potentially suspicious body language.

While AI is usually envisioned as a smart personal assistant or self-driving car, it turns out the technology is pretty good at spotting nefarious behavior. Like a scene out of the movie “Minority Report,” algorithms analyze security-camera footage and alert staff about potential thieves via a smartphone app. The goal is prevention; if the target is approached and asked if they need help, there’s a good chance the theft never happens.

Vaak made headlines last year when it helped to nab a shoplifter at a convenience store in Yokohama. Vaak had set up its software in the shop as a test case, which picked up on previously undetected shoplifting activity. The perpetrator was arrested a few days later.

“I thought then, ‘Ah, at last!’” said Vaak founder Ryo Tanaka, 30. “We took an important step closer to a society where crime can be prevented with AI.”

“If we go into many retailers whether in the U.S. or U.K., there are very often going to be CCTV cameras or some form of cameras within the store operation,” said Thomas O’Connor, a retail analyst at Gartner. “That’s being leveraged by linking it to an analytics tool, which can then do the actual analysis in a more efficient and effective way.”

Because it involves security, retailers have asked AI-software suppliers such as Vaak and London-based Third Eye not to disclose their use of the anti-shoplifting systems. It’s safe to assume, however, that several big-name store chains in Japan have deployed the technology in some form or another. Vaak has met with or been approached by the biggest publicly traded convenience-store and drugstore chains in Japan, according to Tanaka. bloomberg.com

Inventory mishaps behind staggering revenue loss in physical retail
Could inventory management robots help?

There's a big inventory problem in retail. Can robots help?

The root of the issue is inventory mismanagement. Physical retailers are painfully aware of revenue they lose due to theft, and all major retailers have loss management protocols to minimize the bleeding. But general inventory mismanagement could be a far more pressing issue. According to a new survey, inventory management issues account for far more lost revenue than theft.

The survey, conducted by Wakefield Research and commissioned by robotics company Bossa Nova, includes perspectives from dozens of corporate retail professionals with a title of Director or greater at companies with $500m+ in annual revenue. The results suggest an ongoing catastrophe in how inventory is tracked and forecast in the $1.3 trillion retail sector.

Over 70 percent of those surveyed, for example, stated that inaccurate inventory forecasting is a major issue, resulting in costly supply-demand mismatches. Nearly two-thirds of those surveyed reported some difficulty tracking inventory through the supply chain.

It's not for lack of trying. Over 90 percent of retailers surveyed reported their stores spend more time identifying inventory issues than they do implementing solutions. On ground level, retail employees typically spend more time filling out-of-stock holes on shelves than interacting with customers.

Bossa Nova, the company that commissioned the survey, believes shelf-scanning robots are a crucial part of the answer. Bossa Nova's robots roam stores autonomously and scan merchandise on shelves to help retailers keep track of inventory more efficiently than employees with scanning guns. zdnet.com

Sam’s Club tests Scan & Go system that uses computer vision instead of barcodes
In October, Walmart-owned Sam’s Club opened a test store in Dallas where it planned to trial new technology, including mobile checkout, an Amazon Go-like camera system, in-store navigation, electronic shelf labels and more. This morning, the retailer announced it will now begin testing a revamped Scan & Go service as well, which leverages computer vision and machine learning to make mobile scanning easier and faster.

The current Scan & Go system, launched two years ago, requires Sam’s Club shoppers to locate the barcode on the item they’re buying and scan it using the Sam’s Club mobile app. The app allows shoppers to account for items they’re buying as they place them in their shopping cart, then pay in the app instead of standing in line at checkout.

The new scanning technology will instead use computer vision and ML (machine learning) to recognize products without scanning the barcode, cutting the time it takes for the app to identify the product in question, the retailer explains. techcrunch.com

Indiana’s jail population increasing more than any other state, research finds
A non-profit research group looking into jail incarceration rates found that Indiana is among the worst states in the country when it comes to jail overcrowding. The Vera Institute works with justice systems, stakeholders, communities and policy makers to “reimagine and improve justice systems.” Jack Norton and Jasmine Heiss took it upon themselves within the last couple of years to visit small and rural counties across the country. They were investigating incarceration trends and who was behind bars.

“The jail incarceration rate rose 32 percent in the last two years,” Norton said. “That 32-percent increase in Indiana is the first time that has happened in the state since 2003.” The Vera Institute found that no other state had seen their jail population grow as rapidly as Indiana’s in the last 15 years. “Indiana, we found, sort of engaged in some prison reforms. They wanted to get the prison incarceration rates down,” Heiss explained.

Heiss referenced House Bill 1006, which former Governor Mike Pence signed in 2015. It forced low-level felons to be housed in county jails rather than at state prisons. “Now in Indiana, you have a situation that counties across the state are facing. Their jails are overcrowded and they’re needing to build bigger jails,” Heiss said.

Researchers pointed to nearby cities and states that have successfully shifted their approach. Chicago, for example, has reportedly seen a 40-percent decline in their jail population in recent years.

Editor’s Note: In 2014, Indiana raised the Felony Threshold for Theft to $750. Currently in the neighboring state of Illinois the threshold is set at $500, but Cook County (Chicago) is set at $1,000. cbs4indy.com

Georgia, Nevada, California, Florida and Texas are the top 5 in most frequent incidents of fraud, according to the FTC
Reports to the FTC suggest that Americans lost $1.48 billion in 2018 to fraud, an increase of 38 percent over 2017. The top reported incidents in 2018 were imposter scams, debt collection and identity theft. Younger people lost money more often than older people, but elderly people tended to lose a greater amount of money when they did get scammed. The median loss for people in their 70s was $751, compared to $400 for people in their 20s. Credit card fraud was up 24 percent from 2017 to 2018. The most frequent payment method reported in scams was wire transfers. houstonchronicle.com

Survey: 71% of Shoppers Are Spending More In-Store Than Online
Both men and women are spending significantly more in-store than online during a typical shopping visit according to a new report, by First Insight, Inc. The survey found that 71 percent of respondents (72 percent of men; 70 percent of women) typically spend more than $50 when shopping in-store. In contrast, only 54 percent of respondents (59 percent of men; 49 percent of women) are spending more than $50 when shopping online.

Of note, 34 percent of respondents (36 percent of men; 33 percent of women) reported spending more than $100 during a typical in-store shopping visit, compared to only 21 percent (26 percent of men; 17 percent of women) who reported spending more than $100 when shopping online. chainstoreage.com

Amazon, Long Seen as a Threat to Malls, Is Now a Hot Tenant
Shopping center owners have long blasted Amazon.com Inc. as a destroyer of their business. Now some are starting to view Amazon as a potential savior. At a time when Sears Holdings Corp. and Macy’s Inc. are shutting down stores, and many malls are struggling to attract high-profile tenants to fill empty spaces, the giant online retailer has been ramping up its presence in physical retail.

“When Amazon comes knocking, it feels like Apple has showed up,” said Jay Luchs, vice chairman at Newmark Knight Frank, a real estate consulting firm. Apple Inc. has a huge pull on mall traffic and the clout to negotiate for lower rents with landlords.

Amazon has become a much sought-after retail tenant. In November 2015, the company opened its first physical bookstore in Seattle and rolled out pop-up stores in malls and shopping centers. It opened about 20 pop-up stores in malls the following year, each one occupying a few hundred square feet of space that showcased devices such as voice assistant speakers, tablets and Kindles.

Amazon’s website says it now has three 4-star stores in New York, Colorado and California; and more than 80 pop-up stores and 18 bookstores across 22 states as well as Washington, D.C. wsj.com

'Momazonians' press Amazon for backup daycare benefits
A group of more than 1,800 working mothers at Amazon calling themselves the “Momazonians” are pushing the ecommerce giant to provide a backup daycare benefit. The women are set to meet with senior managers at Amazon to argue the company should provide daycare options for its employees who require childcare assistances during school closures or illnesses, Bloomberg reported. The “Momazonians” argue that a lack of backup daycare options can stunt the career growth of female employees and make it more difficult – and expensive – for Amazon to fill positions through recruitment. foxbusiness.com

Marriott CEO to testify before U.S. Senate panel on data breach
Thursday hearing to examine 'causes and scope' behind private sector hacks

Marriott International Inc Chief executive Arne Sorenson will testify before a U.S. Senate panel Thursday about a hacking incident it reported in December that exposed the records of up to 383 million customers in its Starwood hotels reservation system and 5.25 million passport numbers.

The Senate’s Permanent Subcommittee on Investigations is holding a hearing “to examine the causes and scope of private sector data breaches that expose the most sensitive information of millions of Americans.”

The hearing will also include Equifax Inc Chief Executive Mark Begor, who will discuss the company’s 2017 disclosure of the hacking of sensitive data of about 148 million people. That massive breach sparked calls for changes by Congress to the credit reporting agencies’ handling of data. reuters.com

Florida considers biometric data privacy law with private action rights
similar to Illinois and New York state laws

A pair of Florida lawmakers are proposing legislation to require private companies using consumers’ biometric data to obtain informed consent and apply protections to it in storage, WJCT News reports.

The
Florida Biometric Information Privacy Act, brought by Senator Gary Farmer and Representative Bobby DuBose, proposes requiring written notice of biometric data collection, use, and storage practices, considering the data as confidential and sensitive information for the application of industry standards, and making businesses liable for the unauthorized distribution of biometric data.

An assessment of the proposed law by Freeborn & Peters LLP Partner Robert A. Stines (PDF) notes that the legislation includes a right of private action from $1,000 to $5,000, which is the same as Illinois’ controversial BIPA, as well as a proposed New York City law.

The law is proposed to take effect on October 1, 2019. biometricupdate.com

Study: Only 11% Of Consumers Trust Retailers To Handle Data Breaches Properly
Retailers face a significant mistrust issue when it comes to data breaches: only 11% of consumers trust retailers to properly handle data breaches, according to a survey by First Data. High-profile events, such as the HBC data breach that affected as many a 5 million shoppers in 2018, can erode trust across the entire industry. But retailers have many tools to help them build up shoppers’ trust.

The most important step retailers can take to build trust with shoppers is also the most straightforward: protect themselves from data breaches before they can happen. While this is a complex process with no single solution, adhering to best practices can help retailers rise to the challenge:

Ensure anti-fraud efforts are properly funded. The first step in building trust is making sure infrastructure is up-to-date, data is properly encrypted, the right third-party solutions are implemented and other basic security measures are in place;

Let shoppers know security is in place. People care about their data, and telling customers that their concerns are being taken seriously (while also explaining how it is being protected) can help build goodwill and trust;

Protect shoppers from themselves. Retailers need to recognize that customers often practice poor security management and act accordingly. Tools like two-factor authentication and one-time passwords, while potentially inconvenient, can keep shoppers from accidentally exposing themselves to fraudsters; and

Use machine learning to ease friction. Harnessing AI can help retailers not only detect fraudulent activity but also determine when regular shoppers access a site, which allows inconvenient security protocols to be waived at checkout. retailtouchpoints.com

Companies are Sacrificing Mobile Security & Face Greater Mobile Threats
Verizon study finds half of respondents sacrificed security to “get the job done”

Verizon’s second Mobile Security Index finds that more organizations are compromising mobile security in order to “get the job done”, and in turn are facing a greater risk of data loss, downtime and damage to their reputation and customer relationships.

The study shows that despite companies saying they see risks growing, companies’ defenses aren’t keeping up. Almost half (48%) of respondents said that their organization had sacrificed mobile security in the past year. Up from 32% from last year. What’s more, the index found those that had sacrificed security were nearly twice as likely to suffer a compromise - 46% versus 24%. And the majority (62%) of those affected described the event as “major”. securitymagazine.com

Why You Need VPN

At a recent trip to Europe I stayed at a hotel where, a week prior, had two hackers arrested in its parking lot.

Public wi-fi hotspots like the ones we use at hotels, airports or Starbucks offer no encryption security. Someone with very little computer skills can easily eavesdrop on your communications (or your team members’) and even steal your log in credentials.

One possible solution? VPN – Virtual Private Network. If your company currently does not use one, you can purchase it for as little as $5 a month per user. A VPN will encrypt your activities and keep you safe on the go.

Big Data: The Treasure Trove for eCommerce Industry
In today’s cognitive world, data is the new oil. Every digital business in every corner of the world wants to leverage data to offer differentiated customer service and fuel business growth. This is especially true for the ecommerce sector that has emerged as the game-changer in the technology-driven economic landscape.

Personalizing User Experience
The biggest positives that ecommerce businesses offer are the ability and convenience for customers to view, compare, and buy items using a payment option convenient for them. Since the users—both buyers and sellers—are tech-savvy, ecommerce businesses must harness data in a way which enhances user experience. As a result, players in the business are using big data to analyse user behaviour on their platforms and offer personalized services.

Fighting Fraud
Since ecommerce platforms entail large-scale spending and acceptance of money, there are greater chances of fraudsters trying to abuse the platform for stealing money and conning unsuspecting genuine users. Harnessing the data they possess, ecommerce businesses can gain insights into the behavioural patterns of the users and differentiate between genuine users and bad actors.

Key Constituent of Business Strategy
Increasingly, ecommerce businesses are realizing that the data they possess can not only enhance customer experience, but also increase revenues, reduce operational costs, efficiently manage risks, and comply with the changing regulations. Therefore, they would do well to include big data analytics as an essential component of their overall business strategy given the fact they are operating in a digital world. dqindia.com

Consumers are spending a lot more time in retailers' apps
Shoppers spent more time and money in retail apps in 2018, according to recent findings from mobile analytics firm App Annie and app technology vendor Button. 70% of app shoppers during Cyber Week who made a purchase had not previously made a purchase with that retailer before, and 33% of those customers shopped again with that retailer during the holiday season.

U.S. consumers spend 60% more time in shopping apps in 2018 compared with 2016, according to data released in app analytics firm App Annie’s report “The State of Mobile 2019.”

The firm attributes the growth to more consumers shopping on mobile devices and opening apps more frequently. For example, sessions, or when when a shopper opens an app, increased 70% to more than 60 billion sessions in U.S. retail apps in 2018 compared with 2016, according to App Annie. As shoppers spend more time in shopping apps, overall ecommerce sales increase at a nearly proportional rate, according to the firm, meaning that time spent in mobile shopping apps correlates highly with overall e-commerce sales, a spokeswoman says.

Ranked by time spent in app in 2018, here is how Android’s digital-first retail apps stacked up:
1. Amazon
2. Amazon (outdated version)
3. Wish
4. ASOS
5. AliExpress

Greenville, SC: Two Business owners who sold $1.5M in stolen merchandise on eBay found guilt of fraud
The owners of a used electronics store, Reboot LLC, in Greenville were convicted on fraud charges last week after they allegedly sold hundreds of thousands of dollars in stolen items.

Reboot owners Jonathan E. Field, 41, and Shena J. Field, 40, both of Mauldin, were found guilty of conspiracy to commit mail and wire fraud by a federal jury.

Through Reboot, the Fields were part of an organized operation where shoplifters, many of whom suffered from drug addiction, unloaded stolen items for less than the items' retail value, according to the U.S. Attorney's Office. The Fields posted the stolen items for sale on e-commerce website EBay where purchasers would buy the items not knowing they were stolen.

"The evidence showed that the Fields welcomed the shoplifters' business by not requiring production of sales receipts and implementing a no-questions-asked policy at Reboot," a press release from the U.S. Attorney's Office stated. "The Fields and store employees would also meet the shoplifters after hours at gas stations and other spots to receive stolen goods."

The owners would also instruct shoplifters on what to obtain if they oversold an item on EBay, in order to avoid negative online feedback, the press release stated. The Fields face up to 20 years in federal prison, a fine of $250,000 and three years of court-ordered supervision. greenvilleonline.com

Nassau County, NY: Former NFL prospect busted in $1 M Identity Theft Ring
A former tryout for the New York Giants was among five people busted in Nassau County for an alleged million-dollar identity theft ring that prosecutors say was highly sophisticated and massive in scope. Nyantakyi Boateng, 32, of Perth Amboy, New Jersey — an undrafted wide-receiver who attended the Giants rookie mini-camp in 2010 — and his co-defendants face anywhere from five to 15 years prison. The five allegedly used stolen bank account data to pay for their car loans, rent and plane tickets. “Over the course of a year, these defendants allegedly operated a highly sophisticated and organized loan and identity theft ring,” said Nassau County District Attorney Madeline Singas. Some 20 victims in at least six states were robbed of $250,000, Singas said, but prosecutors believe other people were targeted. In all, the ring members were trying to steal more than $1 million, the DA said. nypost.com

Santa Ana, CA: Verizon store Robbery ringleader pleads guilty
10 robberies of Verizon stores in CA and AZ

The ringleader of a crew that staged 10 robberies of Verizon stores in Southern California and Arizona has pleaded guilty to federal charges and is facing a possible sentence of life in prison. Authorities say Zachary Wade of Long Beach pleaded guilty on Friday to conspiracy and other crimes for his role in armed holdups in 2017 and 2018 that netted some $340,000 in smartphones and other merchandise. Authorities say Wade acknowledged choosing the stores, planning the robberies and providing guns. The robberies took place in Tarzana, Torrance, Fullerton, Long Beach, Corona, San Pedro, Corona del Mar and Tucson, Arizona. Eight other Southern California men have pleaded guilty to federal crimes for their roles in the robberies. Most await sentencing. startribune.com

Tip of the Day
Sponsor
ed by Vector Security Networks

With everything that goes on in one's personal and professional life, it's oftentimes difficult to be able to really focus on the day's objectives. It's easy to get lost in everything going on around you and, while no one can bat 1,000 everyday, you've got to be able to separate -- to use your work as a form of escape from everything and to get lost in your work. Your work can give your mind the chance to separate from virtually anything going on in your life which allows your subconscious time to rethink-refresh- and hopefully see things more clearly. It's like using work as therapy. The trick is forcing yourself to do it. Much easier said then done.

Just a Thought,
Gus
