2019 CAL-ORCA Conference Recap

800 in attendance for a day of learning & networking

On February 20th, 2019 the California Organized Retail Crime Association (CAL-ORCA) delivered a conference highlighting current ORC initiatives being developed statewide and insightful content shaped to develop new and experienced Asset Protection and Law Enforcement leaders. Close to 800 attendees were exposed to a day of learning and networking which followed the conference’s theme of Past, Present, and Future.

Opening remarks were delivered by Los Angeles County District Attorney Jackie Lacey, Los Angeles Chief of Police Michel Moore, and Pasadena Chief of Police John Perez. The opening remarks by the respective dignitaries set the tone for the not-to-be-missed third annual CAL-ORCA Conference. The opening remarks were followed by Keynote presentations by Joe LaRocca, Founder & Senior Advisor, RetaiLPartners and also a brief address by the Assistant Chief of the California Highway Patrol.

To conclude the morning session, a power-panel consisting of Assistant District Attorney (San Francisco) Tom Osley, Deputy District Attorney (San Diego) Anna Winn, Detective (Escondido PD) Mike Martinez, retired Commander (CHP) Scott Sanbrook and National ORC Manager (CVS) Tony Sheppard discussed the new AB 1065 Legislation in California and its potential to positively reshape the ORC landscape throughout the state.

Two Lawmakers Float First Facial Recognition Privacy Bill
With facial recognition growing in popularity and uses showing up everywhere from the airport to retailers, two U.S. senators introduced legislation that would prevent businesses from collecting and using facial recognition data without the consent of consumers.

According to a report in CNET, the bill is called the Commercial Facial Recognition Privacy Act and is designed to protect consumers’ privacy as facial recognition is used more often. The bill would block businesses from using facial recognition technology to identify and follow customers in their stores unless they sign off on it. If the bill introduced by Missouri Republican Roy Blunt and Hawaiian Democrat Brian Schatz passed, it would be the first piece of legislation on the federal level aimed at protecting consumers’ privacy when using facial recognition. “Our faces are our identities. They’re personal. So the responsibility is on companies to ask people for their permission before they track and analyze their faces,” Schatz said in a statement to CNET.

With the bill, businesses that deploy facial recognition technology will have to engage in mandatory tests to ensure the system is accurate and there is no bias. Companies would also be barred from selling facial recognition technology data without the consent of the consumer. “Consumers are increasingly concerned about how their data is being collected and used, including data collected through facial recognition technology,” Blunt said in the report.

Until a federal law passes on facial recognition, businesses can continue using the technology and selling that data.

Though this is the first proposed federal legislation looking to take on commercial facial recognition, there are state laws similar to Schatz and Blunt's bill. pymnts.com cnet.com

QuikTrip's First Armed Security Employees Get to Work
QuikTrip Corp.'s first employees who fill a role combining security and store associate responsibilities have taken their posts in select Tulsa-area convenience stores.

According to Tulsa World, the convenience store chain hired 11 full-time hybrid employees to work the store and provide armed security.

QuikTrip spokesman Mike Thornbrugh declined to reveal which locations are staffed with the new employees; however, he told the news outlet the company was placing them at select stores as needed and continuing to hire more.

Hybrid employees' presence has "significantly" lowered thefts and other incidents at those stores, Thornbrugh added.

He did not provide any specific numbers, but he noted the program's community policing approach has often deterred habitual offenders at the door.

"The response has been phenomenal," Thornbrugh said. "We can tell from inventory control that theft is down. ... When (habitual offenders) walk in, they see our people and walk right back out."

The employees carry weapons openly and are clearly identified apart from regular clerks, he told Tulsa World. Security officers won't work behind the counter and, though they may assist in stocking and cleaning in some cases, they will primarily function in the same way the store previously used off-duty law enforcement and security guards.

The role requires relevant certifications as an armed security officer or peace officer, whose conditions vary by state. QuikTrip also asks that applicants be certified in electronic stun devices, pepper spray, first aid, baton use and hand irons, Convenience Store News previously reported.

The job description calls for applicants to have at least three years of experience as a peace officer or five years as a reserve officer, armed security officer or honorable military service.

Tallahassee, FL: Florida Senate Committee Increases Felony Threshold to $750
Felony theft threshold legislation watered down by Senate

A comprehensive criminal justice reform bill got unanimous approval from a Senate committee Thursday morning but was slightly watered down. A provision in the bill would have raised Florida’s felony theft threshold from $300 to $1500. It was reduced to $750. Florida currently has the second lowest felony theft threshold in the country. Raising it to $750 would bring the state closer in line with the rest of the nation.  wjhg.com

OSHA Whistle-Blower Claims Are on the Rise. Are Employers Prepared?
Data provided by OSHA (a federal agency under the purview of the U.S. Department of Labor) shows that the number of whistle-blower complaints filed has increased by 29 percent over the last five years, from 7,408 complaints in 2014 to 9,566 complaints in 2018.

In 2018, OSHA opened full investigations into 3,007 of those complaints. While the number of complaints has gone up, the number of OSHA investigators has declined. OSHA had 76 investigators at the end of 2018, down from 100 in 2014.

OSHA's increase workload combined with the loss of investigators has led to it being unable to timely complete its investigation process. Pursuant to its governing regulations, OSHA has 90 days to complete its whistle-blower investigations. But last year, it took OSHA on average 272 days to make a determination on a complaint. The backlog has gotten so bad that in some cases OSHA may be aware of a complaint for months before an employer is contacted. 

The delays have led to employees pursuing their claims in federal court, after the expiration of the 90-day period, rather than at the administrative level, devaluing the administrative-exhaustion requirements of many of the statutes containing whistle-blower provisions.

The delayed process has also created problems for employers that have had difficulty locating witnesses, months after the fact, to disprove a complainant's stale allegations. shrm.org

Former SAP Global Vice President Pleads Guilty to Insider Trading With Two Conspirators - Being Sentenced March 22nd
Christopher Salis, former Global vice president for SAP SE devised a scheme where he and two co-conspirators traded in options ahead of SAP SE’s (SAP) acquisition of Concur Technologies (Concur), which netted them and their co-conspirators hundreds of thousands of dollars in profits.

Douglas Miller, 44, of Dyer, Indiana, who pleaded guilty in September 2018 sentenced to 24 months and two years supervised release and his brother Edward Miller sentenced to six months and two years supervised release. Both forfeit over $200k each.

Douglas Miller had also destroyed electronic data, misled investigators, and took steps to hinder and impede the investigation by setting up a burner phone network to communicate and destroying that electronic data as well. justice.gov

Congress to the rescue?
When retailers go bust, workers often get nothing

U.S. Rep. Tim Ryan, D-Ohio, and U.S. Sen. Joe Manchin, D-West Virginia, within weeks plan to push parallel bills in the House and Senate that would prioritize workers' claims in corporate bankruptcies.

More specifically, the measure would classify worker claims in bankruptcy as administrative costs, putting them on par with the investment bankers, lawyers and consultants who get paid in full through a bankruptcy proceeding. cbsnews.com

Macy’s Backstage sells name-brand clothing, shoes, accessories, housewares and makeup at 20 percent to 80 percent below traditional department store prices, Cincinnati-based Macy’s Inc. said.

Macy’s has too much space in some of its stores, which is one reason for its Backstage concept. Also, “Macy’s has a lot of excess apparel inventory that it needs to offload. It could do this by discounting in the mainstream part of the store, but that devalues the proposition, so it has opted to create an off-price concept instead,” he said.  newsday.com

The big idea
Imagine how powerful it will be if we can upload and analyze images of offenders committing crimes to automatically fill out a report for us?

Would it be faster and more accurate in the long run?

Where we’ve started
When our customers report crime, they fill in the usual stuff like height, build, and gender. There’s a text field asking for more information on appearance. Text fields allow people to write as little or as much as they have time. It is entirely dependant on how confident the reporter is at remembering incidents and translating them into well-written descriptions.

Is it accurate? Is it fast? And more importantly, is it consistent?


Ask people to describe an object. Is it big or small? What color is it? Do you describe the same object using the same words all the time? Through the data, we can see that people describe the same things in many different ways. This is perfectly normal, but there is huge potential for improvements.

Don’t take my word for it, let’s take a look at the data.

Two immediate benefits of structured data: simplicity and speed.

  • Looking at the graph above, a collective 76.25% of people have one of the four selectable attributes. Compare this to the unstructured fields (person description and methodology) where they have a collective 25.5% usage.

  • This definitively proves people are more likely to use a readily available checkbox rather than type out a narrative.

  • The speed of getting useful information from the data is also better when it has structure. Making the most of unstructured data requires expertise and specialized tools e.g. natural language processing, machine learning etc. These subjects are intrinsically complicated, time consuming and therefore expensive (cost and effort).

  • Conversely, having a little structure can speed up search results immensely. E.g. with our fuzzy search implementation we can retrieve all people with red beanies quickly.

Microsoft's Ann Johnson wants to close cybersecurity's talent gap—here's how
2 Million Students & 20,000 Internships

Women make up less than 10 percent of the cybersecurity industry and people of color far less, Ann Johnson, Microsoft's VP of cybersecurity solutions, said. She thinks it's critical to take steps to fix it now. Over 3 million job openings are projected to open in the industry within the next two years, and she sees a real need to bring different people into the industry to fill those jobs.

"Our teams need to be as diverse as the problems we are trying to solve," Johnson said. "We need to be much more inclusive as an industry and go out and recruit through non-traditional channels."

She said it has become an industry-wide effort to recruit, train and retain a diverse workforce,d that Microsoft is leading that effort and focusing on creating a pipeline of talent.

One program she highlighted is Microsoft's partnership with the Security Advisor Alliance, a non-profit that aims to support and diversify the cybersecurity industry. The program hosts cyber hackathons for students in grades 7 to 12 at underserved schools. The program's goal is to
impact 2 million students and encourage then to pursue a career in cybersecurity, Johnson said. They also want to create 20,000 internship opportunities to help build that talent pipeline. cnbc.com

House Dem introduces bill requiring public firms to disclose cybersecurity expertise in leadership
A Democrat on the House Intelligence Committee introduced a bill on Wednesday that would require publicly traded companies to disclose to investors whether any members of their board of directors have cybersecurity expertise amid growing cyberattacks targeting U.S. companies.

Rep. Jim Himes (D-Conn.) introduced the
Cybersecurity Disclosure Act of 2019, a companion bill introduced in the upper chamber, that would make the Securities and Exchange Commission issue a new set of rules requiring U.S. companies to tell their investors whether they have someone who has cyber expertise on their board. If they don't, they must explain to their investors why this is the case. msn.com

U.S. legislators introduce bipartisan IoT security standards bill
Lawmakers have introduced legislation in a bipartisan effort to establish national standards in the U.S. for the cybersecurity of internet-of-things (IoT) devices used by the government, The Hill reports.

The bill directs NIST to make recommendations to the government, and establish minimum requirements to address vulnerabilities. NIST would also issue a report on increasing IoT device use and overlap, and the Office of Management and Budget (OMB) would create guidelines for device purchase and use. U.S. Retail To Lead Global Investment in AI Systems in 2019 With Two Thirds of All Spending
Retail is leading global spend on AI systems this year, with the category projected to invest $5.9 billion on solutions like automated customer service agents, shopping advisers and product recommendation platforms.

Automated customer service will see the biggest investment this year at $4.5 billion, followed by sales process recommendation and automation at $2.7 billion and automated threat intelligence and prevention at $2.7 billion. Ransomware's New Normal
Targeting the Big Game With Cryptocurrency

Don't be fooled by the drop in overall ransomware attacks this past year: Fewer but more targeted and lucrative campaigns against larger organizations are the new MO for holding data hostage.

While the number of
ransomware attacks dropped 91% in the past year, according to data from Trend Micro, at the same time some 75% of organizations stockpiled cryptocurrency. The majority that did also paid their attackers the ransom, according to a Code42 study. Overall, more than 80% of ransomware infections over the past year were at enterprises, as cybercrime gangs began setting their sights on larger organizations capable of paying bigger ransom amounts than the random victim or consumer.

The evolution of the prolific GandCrab ransomware over the past few months demonstrates how this new generation of more selective attacks is more profitable to the cybercriminals using it - and underscores how the ransomware threat is far from over. darkreading.com

Criminals Use One Line of Code to Steal Card Data from E-Commerce Sites
Criminals using just one line of malicious code have successfully compromised at least seven e-commerce sites and potentially stolen payment card data belonging to thousands of customers of the online stores.

Six of the e-commerce sites are US-based and one, belonging to footwear maker Fila, is based in the United Kingdom. Security vendor Group-IB, which uncovered the attacks, identified the malicious code as a new
JavaScript sniffer (JS sniffer) that it has named GMO.

In an alert Thursday, the Moscow-based Group-IB said its researchers first discovered the GMO JS sniffer on Fila UK's website in early March. The company's subsequent investigations showed that the malware has been active since at least May 2018 and that six relatively small US e-commerce sites have been affected as well. darkreading.com

'Sensor Fusion Technology' & How to Defeat It
Autonomous devices, including drones, robots & self-driving cars can be hacked

Relying on sensors to gauge their position and actions. However, hackers can use
ultrasound waves to disable these sensors or feed them inaccurate information, causing the devices to crash or change course.

Researchers from Mitsubishi Electric Corp. have developed an algorithm to detect the signs of such an attack and prevent hackers from taking control of the devices. The technology is experimental, though Mitsubishi Electric expects to add it to products in the future and license it to makers of robots, drones and cars in the next year.

To move and maneuver, autonomous machines and other Internet of Things devices rely on
sensor fusion technology to interpret data from sensors such as gyroscopes, accelerometers and magnetometers. Sensor fusion systems make the devices reliable and resilient: If one sensor fails or gets infected with malware, other sensors keep the device from crashing.

Sensor fusion technology, however, can be
vulnerable to sophisticated cyberattacks that could cause a drone, for example, to fly in the wrong direction, Dr. Yoneda said. His team is working on countermeasures that in part use artificial intelligence to ward off such interference in drones and self-driving cars. cybersecurity.cmail20.com

Mobile Threats a Growing Concern for E-Retailers
Despite sizable investments in fraud protection tools and strategies, fraudsters and attackers are growing more sophisticated in their ability to compromise online businesses by leveraging mobile devices.

According to Verizon’s new Mobile Security Index, many e-commerce businesses have suffered significant fraud losses and data breaches because they weren’t prepared to defend against mobile threats.

While they say they are focused on PCI DSS compliance, many e-commerce businesses struggle to secure credit card information and payment details. Though PCI DSS does provide a solid framework for building strong security policies and procedures, Verizon’s 2018 Payment Security Report found that many companies don't maintain compliance between annual assessments. All the while, online retailers remain vulnerable to other types of attacks.

More than half (55 percent) of retailers said they were most likely to be concerned about cybercriminals stealing payment card details, but a greater number (61 percent) of respondents said they were actually more likely to be concerned about customer data being taken, the report said. cardnotpresent.com

Cartersville pawn owner accused of fencing items stolen from Home Depot and Target
Cartersville Police said they recovered tens of thousands of dollars in merchandise and charged a pawn shop owner with fencing stolen property after he allegedly bought and sold items stolen from some retailers. William Mark Anderson of Acworth was arrested on charges of Retail Property Fencing and Theft by Receiving Stolen Property March 13. Cartersville Police worked with investigators from Home Depot and Target on a probe of the business they believed to be involved in fencing stolen property. Elkhorn, WI: Piggly Wiggly employee steals $71,000 worth of Lottery tickets
According to a criminal complaint, Ludke committed the theft in December while working as a service desk clerk at Frank’s Piggly Wiggly, 58 W. Market St. The complaint indicates that Ludke is charged with stealing lottery tickets valued at between $2,500 and $5,000. Alameda County, CA: Routine shoplifting call end with Fleeing Felon attempting to run-down a Police Officer; suspect shot and killed
A man who was fatally shot by Alameda County sheriff's deputies after he allegedly escalated a routine shoplifting call at a thrift store near San Leandro into a life-threatening situation had 11 prior felony convictions, a sheriff's spokesman said on Thursday. Charles Ballard, 41, of San Leandro, also was on felony probation and had a warrant out for his arrest, sheriff's spokesman Sgt. Ray Kelly said. Two deputies responded to the Thrift Town store at 16160 E. 14th St. in unincorporated Ashland near San Leandro at about 4:40 p.m. on Wednesday after store employees reported a minor theft, Kelly said. The deputies made "a very low-key contact" with Ballard because it was a relatively low-priority call, according to Kelly.

Ballard was outside his SUV when the deputies contacted him but then he got inside, put his car into reverse and accelerated at a high rate of speed, pinning the two deputies in an open door and dragging them at least 20 feet. The two deputies, a male and a female, then fired at Ballard because he was using his SUV as a weapon and their lives were in danger. Ballard then put his SUV in forward and aimed his car toward a third deputy, Kelly said. That deputy, a male, also fired at Ballard and the three deputies fired about a total of 24 shots. Ballard suffered gunshot wounds and was pronounced dead at the scene despite attempts to save his life, Kelly said.

Philadelphia, PA: Would-be Robber dies after being shot by C-Store owner in West Philadelphia
It happened at a store near 54th Street and Wyalusing Avenue. Police say a man in his 20s entered the store wearing a ski mask with intentions on committing a robbery. That's when he was shot one time in the abdomen by the store owner. Police found a man fitting the suspect's description behind the wheel of a car. He was rushed to the hospital where he later died. 6abc.com

Jacksonville, FL: Gas Station Robber with knife shot and killed by Police
A Jacksonville officer shot and killed a man brandishing a knife at a gas station in the Englewood area on Thursday. The officer wasn't injured. According to JSO, Jerry Marrero, 38, entered the Gate Gas Station shortly before 6:51 a.m. while the store was full of customers. Police say Marrero walked around the store and was muttering unintelligible profane sentences. He also poured out a bottle of motor oil onto the floor.

Police say the suspect then walked into the employee area where the cash register and employees were working and barricaded the employees from leaving the area. The subject demanded that the police were called and continued to make profane statements, according to JSO. Officer Santoro with JSO entered the store and store employees began to evacuate the business. When the officer approached the suspect still armed with a knife. Officer Santoro told him repeatedly to drop the knife and to get on the ground. Police say that instead of following the officer's orders, the suspect made a move towards the police officer and the officer fired his weapon six times. firstcoastnews.com

Federal Way, WA: Macy’s Robbery Suspect opens fire on Police
Suspect now in critical condition, no Officers were injured

On Thursday, Federal Way Police shot one man during a traffic stop after a reported robbery at the Macy’s at Commons Mall in Federal Way. Just after 4:30 p.m., police pulled over a purple mini-van on the 1800 block of South 333rd Street in Federal Way. A 27-year-old man stepped out of the van with a gun and opened fire at Federal Way police. Police said it was then that three officers returned fire, hitting the man. The officers performed aid until medics arrived. Witnesses say a second man was arrested. Police say they recovered a firearm on scene. The shooting is under investigation by the Valley Investigation Team, a regional task force. komonews.com

Bergen County, NJ: Nine people charged in connection to at least 20 store Burglaries
Nine people were charged following a six-month investigation into burglaries of cellphone and cosmetic stores throughout New Jersey. The burglars would break into the stores through the front doors, take items from the shelves, escape in stolen cars and then sell the items, the Prosecutor's Office stated. The investigation started in September and on Monday search warrants were executed in West New York, Bogota, Newark, East Orange, Union City, Fort Lee and North Bergen. Some of the burglary locations included a Verizon store in East Rutherford and Ridgewood and AT&T in Paramus and Lodi, and other locations in South Orange and Union City. northjersey.com

Reading, PA: Pawnshop Manager gets Accelerated Rehabilitative Disposition for scheme to sell stolen items online
The former manager of a Muhlenberg pawnshop will have a chance to clear his record of charges that he was involved in a scheme to sell stolen items on the internet. Brendan T. Hill, 30, appeared before Judge Patrick T. Barrett Wednesday to be placed into the Accelerated Rehabilitative Disposition program for two years. Hill had faced charges of being involved in a corrupt organization, organized retail theft, receiving stolen property and conspiracy for working with co-defendant Nicholas J. Blanck, the owner of the pawnshop. Blanck, 36, pleaded guilty in July 2018 to receiving stolen property and conspiracy. Blanck was sentenced in January to five years of probation and to pay back $100,000 in restitution. readingeagle.com

While most people try to avoid risk and corporate America actually labels it to be avoided at all cost ultimately life is filled with it. Risk taking is something everyone is faced with and without it life would become somewhat stagnate. Taking a risk once in a while is a healthy thing. It pushes people to do sometimes their most creative work and reach new levels. The problem becomes the fear of risk and hesitation. It seems like our society has become so risk avoidance driven that people are applauded for not taking it. When in actuality it is those who take risk that pave the road for all others to travel. As Joseph Campbell, a famous American mythologist once said, it is the darkest path in the woods that holds the most treasure. Next time you're faced with taking a risk give it some thought who knows your career may take off!
