'Hiring People with Criminal Backgrounds Is Easier Than You Think'
Second-Chance Hiring Gaining Momentum & Support
HR Trade Show Hot Topic Session

Second-chance hiring—recruiting and hiring people with criminal backgrounds and eliminating obstacles to those efforts—is building momentum among policymakers, the business community and worker advocates.

Genevieve Martin, executive director of Dave's Killer Bread Foundation, a prominent voice in the second-chance movement, told attendees at the 2019 Society for Human Resource Management Employment Law & Legislative Conference March 18 in Washington, D.C., that hiring people with felony convictions shouldn't be a "big, scary thing."

She led a panel of experts to address what many in the room may have been thinking: Second-chance hiring is well-intentioned, sure, but how do we actually do it?

"In most cases, having an across-the-board ban on hiring someone with a criminal record may run afoul of Title VII of the 1964 Civil Rights Act and the 2012 EEOC [Equal Employment Opportunity Commission] guidelines."

Thirty-three states and more than 150 cities and counties have passed "ban-the-box" measures. However "It doesn't mean you can't ask about it later or not at all."

When it comes time to evaluate someone's criminal history, you should be looking first for context and accountability, Martin said. "Does the person take ownership for their background? And who are they now? Have they invested in themselves? Have they improved their skills?"

Survey: Half of HR Pros' Workplaces Experienced Violence
New SHRM data demonstrates need for more education, training to prevent workplace violence

SHRM surveyed 1,416 members in February 2019. The total of those who say violence has occurred at their workplace (48%) is up from 36 percent in 2012. A 33% increase. The category includes incidences of harassment and intimidation, as well as physical assaults and homicides.

According to the Bureau of Labor Statistics, 458 of the over 5,000 fatal injuries that happened in a workplace in 2017 were homicides. About 15 percent of those were perpetrated by co-workers or other work associates.

A majority (82 percent) of 545 employees surveyed by NORC at the University of Chicago, an independent research institute, reported feeling safer in organizations that provide programs to prevent workplace violence and train employees to respond to violent incidents. But less than half say their organization has a program to prevent workplace violence (45 percent) or provides training to workers on how to respond to an act of workplace violence (49 percent). Less than one-third of workers (29 percent) said that they are unsure or don't know what to do if they witness or are involved in workplace violence.

Highlighted Provisions: This bill authorizes the Office of the Attorney General to create and coordinate a multi-agency strike force to combat crimes that may have a negative impact on the state's economy; authorizes the Office of the Attorney General to establish the Organized Retail Crime Unit; and establishes reporting requirements. In conjunction with the Strike Force, the Office of the Attorney General shall establish the Organized Retail Crime Unit for the purpose of: investigating, apprehending, and prosecuting individuals or entities that participate in the purchase, sale, or distribution of stolen property; and targeting individuals or entities that commit theft and other property crimes for financial gain. Federal 'Ban-the-Box' Bill Would Apply to Agencies, Contractors
Legislation prohibiting federal agencies and federal contractors from asking about job applicants' criminal history until after making a conditional offer of employment appears on its way to a House vote.

Employers say they worry about not knowing the criminal histories of job candidates. Hodge stressed that ban-the-box laws do not "force anyone to hire anybody. Employers can continue running background checks and gathering all the information they need to make a hiring decision."

Both Harris and Hodge discounted recent studies suggesting that ban-the-box policies lead to broader race-based discrimination in hiring. shrm.org

Up to now the first quarter has been traditionally the quarter of budget cuts, staff reductions, store closing announcements and Chapter 11 filings. With Q1 2009 and 2010 really being the milestone first quarters where cuts were the deepest and industry exec's started labeling the period 'The Retail Apocalypse.'

Over the last eight years we've seen thousands of store closures and household name brands disappear as if they were never here. Retail behemoths falling in Amazons wake all the while violence in the workplace and in general in retail started rising, along with armed robberies and mass-shootings. Adding a new pressure on the consumer. The element of fear. Where parents plan pictures with Santa's who are closest to exit doors.

All the reports, studies and anecdotal information we've seen points to an element of fear that consumers are struggling with when out in public which has to be influencing the decrease in traffic being reported across the world at certain level malls and shopping centers. You just can't have all of these reports on increasing violence in retail and not have that impact.

So this year, in the states, we're seeing an unprecedented number of liquidations. Certainly the private equity debt burdens opened the door for most of these but the Amazon effect and fear played into all of them as well.

It has long been an open secret that some farms survive by relying on an undocumented labor force. Now, tough immigration enforcement has caused a crisis.

It has long been an open secret in upstate New York that the dairy industry has been able to survive only by relying on undocumented immigrants for its work force. Now, this region has become a national focal point in the debate over President Trump's crackdown on undocumented immigrants and their role in agriculture.

"There are people out there who just say, 'Send them all back and build a wall.' But they would be facing empty shelves in the grocery store if that were to happen."

The pressures here reflect broader challenges facing farmers across the country who rely on undocumented workers. The farmers are struggling with a shrinking labor pool as fewer migrants cross illegally into the country and migrants who are long-term residents become too old for field work.

This year the labor shortage has been compounded by Mr. Trump's trade war and extreme weather, forcing some small farmers to switch to higher-value crops, to reduce their acreage and to consider selling their farms. nytimes.com

How to Address Negligent Hiring Concerns
Exercise due diligence to avoid negligent hiring nightmares.

An episode of workplace violence occurs on his or her watch and is closely followed by a negligent hiring claim. While such claims are rare, every employer should understand basic risks and due diligence to avoid liability.

Negligent hiring tends to be associated with candidates with criminal records, but the link between the two is often exaggerated. Fear of negligent hiring litigation shouldn't negate the emerging trend of employers giving people with criminal histories a second chance. Current research indicates that these individuals are no more likely to engage in workplace misconduct than anyone else, Emsellem says. That's why it's wiser for employers to focus on exercising due diligence with regard to all job candidates, not just those with criminal records.

Negligent Hiring Doctrine

Under the doctrine of negligent hiring, an employer is liable for harm its employees inflict on third parties when the employer knew or should have known of the employee's potential risk to cause harm, or if the risk would have been discovered by a reasonable investigation.

While federal courts and the courts of nearly every state recognize a cause of action for negligent hiring, they apply different standards for liability-notably, to the degree of foreseeability required-and offer little clarity on how to avoid it.

A dozen states have passed laws recently limiting employer liability for negligent hiring, but even these provisions are not uniform. They generally fall into three categories. shrm.org

Washington, DC: National Law Enforcement Museum opened in October of 2018, now facing default on $103M loan
Just two months after its grand opening in October, the National Law Enforcement Officers Memorial Fund said that its museum a few blocks from the Mall in Washington was headed for default on some of the $103 million it borrowed in 2016. That kind of failure is rare in the $3.8 trillion municipal-bond market, and after two decades of planning and construction, it was a notably quick descent. The museum counted on its high-profile backers’ fundraising prowess and the willingness of tourists to pay more than $20 a head. To survive now, it must get more visitors in the door. A lot more. In its first three months, the museum attracted only about 15,000 people. It’ll need 20 times that to meet its first-year goal.

The National Law Enforcement Officers Memorial Fund, which oversaw the monument, was put in charge of the museum as part of a 2000 law signed by President Clinton. NYPD partners with a high-tech detective:
Algorithm helps spot crime patterns

When a syringe-wielding drill thief tried sticking up a Home Depot near Yankee Stadium, police figured out quickly that it wasn't a one-off. A man had also used a syringe a few weeks earlier while stealing a drill at another Home Depot 7 miles (11 kilometers) south in Manhattan.

The match, though, wasn't made by an officer looking through files. It was done by pattern-recognition computer software developed by the New York Police Department.

The software, dubbed
Patternizr, allows crime analysts stationed in each of the department's 77 precincts to compare robberies, larcenies and thefts to hundreds of thousands of crimes logged in the NYPD's database, transforming their hunt for crime patterns with the click of a button.

It's much faster than the old method, which involved analysts sifting through reports, racking their brains for key details about various crimes and deciding whether they fit into a pattern. It's more comprehensive, too, with analysts able to spot patterns across the city instead of just in their precinct.

UK-based AI tech startup aims to detect store thefts in real-time
As per The BRC Retail Crime Survey, during 2016-17, there have been over half a billion pounds of loss in the UK due to customer theft. This is where the intelligent computer vision software built of ThirdEye comes to play. The startup claims to help retailers and staffs prevent up to £56 billion (nearly €65 billion) theft along with other benefits such as better understanding of customer behaviour, eliminating queues and limited stock-outs. The UK-based startup aims to make that possible with the help of artificial intelligence (AI).

The 12 most common phishing email subject lines cyber criminals use to fool you


Analysis of over 360,000 phishing emails reveals some common themes in phoney emails sent to businesses. Don't get caught out by these ones.

After analyzing 360,000 phishing emails over a three-month period, researchers at cybersecurity company Barracuda Networks have detailed the most common lines used in phishing attacks – these subject lines are the most common because it's highly likely they're often the most successful bait for reeling in victims.

According to Barracuda's spear phishing report, by far the most common subject line used in attacks is simply 'Request' – accounting for over a third of all the phishing messages analysed. That's followed in popularity with messages containing 'Follow up' or 'Urgent/Important' in the subject line.

The simple trick attackers are using here is to make potential victims think they need to open and respond to the email as a matter of urgency – especially if the message is designed to look as if it comes from one of their colleagues, or their boss. That could nudge the victim into responding quickly, without thinking, especially if it claims to come from a board-level executive.

The top subject lines according to Barracuda analysis are based around the following key phrases:

5. Payment Status
6. Hello
7. Purchase
8. Invoice Due

'Are you at your desk' uses the trick of familiarly to try and coax victims into falling for the attack, while subjects suggesting the email is part of a previous conversation are also used for a similar goal – to trick the user into trusting the sender.

Many of the most-used subject lines also refer to finance and payments; if the recipient thinks they might lose money if they don't respond, they'll likely jump to it. The same also goes for messages about payments – an employee might think it will look bad if they leave somebody without being paid, especially if the request comes from someone who is their senior.

"Increasingly the social element is becoming the key "attack vector" in cybersecurity attacks. In the past, attackers sent ransomware emails, which actually took over the computer and encrypted the files, asking for a ransom," Asaf Cidon, VP for content security at Barracuda Networks told ZDNet.

"But today, they don't even need to send ransomware. They can simply use social manipulation to get the recipient to send a ransom – which is far cheaper, more effective and harder to detect." zdnet.com

How data plays a vital role against online fraud

Johnston County, NC: Scammers impersonate Walmart employees, target your receipt in order to shoplift
Officials in North Carolina, and around the country, are warning consumers about a scam that is targeting Walmart shoppers. Law enforcement said scammers are impersonating Walmart employees and approaching customers in the parking lot, asking to see a receipt for proof of purchase, according to the Johnston County Report. The suspects typically target shoppers with expensive items such as electronics and televisions. Raiders used a van to smash their way into a Chanel store in Knightsbridge and escape with thousands of dollars worth of designer goods. The robbery came after the store removed guard dogs from the pop-up branch in Sloane Street following criticism on social media. One witness told the Standard how the van driver, wearing a high-vis jacket, parked up opposite the store waiting for his accomplices to arrive at just before 2.50am yesterday. Tulsa, OK: Police Search for Woodland Hills Mall Shooting Suspects
Tulsa police are searching for the two men they say shot at each other at Woodland Hills Mall. Officers say multiple people called 9-1-1 after hearing gunfire at the mall Monday evening. Police say a caller described a man standing next to a car in the parking lot and shooting. Another caller reported seeing a second man in the area. Detectives say the crime scene is consistent with two people shooting at each other. They say bullets hit one car, the mall's wall, and a mall door. There are no reports of injuries. newson6.com

Bellevue, WA: Car riddled with bullets during shooting outside Bellevue Strip Mall
Gunfire erupted inside a Bellevue parking lot Monday evening, but luckily no one was injured. Officers received a report of shots fired at the lot outside a row of businesses at 148th Ave. SE. They arrived to find a woman who was the apparent target of the gunfire. She told officers she had been shopping there and when he returned to her car, another car pulled up and at least one gunman started several shots at her car. The car was struck several times, but the woman was not injured. The gunman drove off. komonews.com

Mississippi: After six trials for same crime, Curtis Flowers' 'extraordinary' case gets U.S. Supreme Court hearing
Curtis Flowers has been tried six times for the same crime — the brutal execution-style killings of four people at Winona's Tardy Furniture store in 1996. His trials have been tainted by alleged racial discrimination and prosecutorial misconduct. He has been spotlighted by an investigative true crime podcast. Now the U.S. Supreme Court will hear his case Wednesday. Flowers, by the accounts of his family and friends, was an ordinary guy with no prior criminal history who loved singing in his gospel group before an indictment upended his life. His odyssey through the criminal justice system, however, has been anything but normal. The heart of the issue: Whether Montgomery District Attorney Doug Evans and his office purposefully excluded black citizens from serving in the jury in Flowers' most recent trial because of their race. A Pioneer Square business owner tackled a man who pulled out a gun inside Emerald City Guitars. Repeat offenders have been targeting their store. The significance of Friday’s incident isn’t just about the play by play of what happened, it’s a prime example of the mounted frustrations of business owners in Seattle who say the city is out of control. Jay Boone has called Seattle Police so many times over the years, it's like a part-time job. “We talked about how many times we've called 911 in the last year, a hundred; we feel like fools calling them up so many times,” Boone said. Montgomery Police need information to help identify a suspect in two burglaries at the same Coliseum Boulevard beauty supply store. The suspect forced entry into the store and stole three mannequin heads and multiple wigs. UK: Oxfordshire, England: Police hunt gang following $2,250,000 perfume theft
Police say the gang used a HGV tractor unit to smash their way through the entrance gates at the compound where the trailer was being kept on Sunday March 10 between 10.12pm and 10.22pm. They then hitched the HGV trailer onto their tractor unit before driving away with the valuable load. The exact location of the perfume raid is not yet known, however the empty trailer was recovered in the Midlands. The company which owns the perfume has since offered a $40,000 reward in relation to the theft. oxfordmail.co.uk

Umatilla, FL: Suspected Arsonist caught on surveillance video; Restaurant, C-Store and Pawn Shop
The Lake County Sheriff's Office has released footage from various security cameras that show a suspected arsonist in action. Authorities are investigating whether these recent fires in the Umatilla area are connected to the same suspect. Investigations into six different arson cases are active and ongoing, the Sheriff's Office says. In some of the cases, cars have been set ablaze. In others, the arsonist has targeted private businesses or residential structures. fox35orlando.com

Houston: "Wing Stop Robbery Crew" Sentenced for Multiple Violent Armed Robberies Committed Within Two Weeks
Five area men have been ordered to prison for their roles in a string of Houston-area armed robberies, including one in which someone was almost killed. Reshaun Lee Jenkins, 25, James Daniel Henderson, 24, Ashton Armstrong, 24, Cedric L. Andrews, 44, and Bradley Alexander, 28, had all previously pleaded guilty for their crimes as did Tadarius Robinson, 23, and Joseph Adams, 34, both also of Houston, and Mik Yia Shua Faye Durden, 22, of Livingston, and Travescy Cauley, 27, of Beaumont. All of them were sentenced to lengthy prison terms. Robbing 2 Wing Stops, T-Mobile, El Mexsal Taqueria, and Movie Magi.
