Target Fires Security Guard After Black Customer Says She Was Racially Profiled,
Forced to Remove Clothing to Prove Innocence
Target fired an employee at a Michigan store on Monday, two weeks after a
black customer was falsely accused of stealing a bikini and then forced to
remove her clothing to prove her innocence, according to her attorney. The
development was the latest in a string of discriminatory practices that have
dogged the retailer.
Ashanae Davis, 20, was exiting the Southfield, Michigan, store on May 22 when a
Target security guard confronted her and claimed that she was wearing a stolen
bikini bottom underneath her clothes, Davis' attorney, Jasmine Rand, said
Monday. A second guard then handcuffed her and dragged her through the store,
yelling that she had stolen the bikini, Rand said.
The officers took her to a room. Once inside, a female manager was called in,
and Davis was instructed to lift up her shirt and pull down her pants in front
of the manager and the two male officers.
Davis said she felt "humiliated and forced" by the Target employees.
"Initially, I was in shock. I couldn't believe what was going on," Davis, who
lives nearby in the Detroit area, told NBC News. "I was scared — afraid of what
was going to happen next."
Davis and Rand held a press conference on Monday morning in Detroit in which
they detailed the incident, adding that Target had not responded to their calls.
Hours later, Target announced that it had fired one worker.
"We want everyone who shops at Target to feel welcomed and respected and take
any allegations of mistreatment seriously," Target said in a statement. "We’re
sorry for the actions of our former team member, who created an experience we
don’t want any guest to have at Target. Upon reviewing our team’s actions, we
terminated the team member who was directly involved."
The statement added that the retailer would be addressing the matter with the
security team for the store.
The manager is white, as is one of the security guards, Davis' attorney said.
The other guard, who is black, hinted after Davis was allowed to leave that
what had happened to her was not unusual.
"The African-American employee apologized to her and
said, 'This happens all the time,' and he was afraid he would lose his job" if
he didn't participate, Rand said. "The other two did not apologize at
all."

Security Guard's Licenses Revoked for Felony
Expunged Nearly 30 Years Ago
A long-time security guard for the Little Rock School District is out of a job
and without his security license. He says it's all because of a crime he
committed nearly 30 years ago that was taken off his record. The security guard
pled guilty to a felony in 1992. After being on probation for about five years,
the judge cleared his record. Since then, he says, he's never been in trouble
with the law again. Bert Gatlin says he's worked as a security guard at the
Little Rock School District for 22 years.

5 Ways HR in Canada Is Different
HR professionals on both sides of the border deal with similar issues, but a
closer look reveals five key differences between the U.S. and Canada. Work
cultures aren't quite the same. In general, Canadian workers have more workplace
rights and job protections under the law.
1. Termination of Employment Employers in Canada, unlike in the U.S., do
not practice at-will employment. That's one of the biggest differences between
the laws of the two countries.
In Canada, every employment relationship is governed by an agreement that
grants employees rights regarding termination. For example, "Canadian
employers must always provide notice or pay ... if they wish to cancel that
contract―or, in other words, fire someone."
The main exception is just cause for termination, which generally refers to
firing someone for serious misconduct, incompetence or willful disobedience.
"But that is a very high and difficult threshold to meet in Canada," and when
employees are let go, severance packages are often much more generous than they
are in the United States.
2. Parental Benefits Canadian parents receive more-generous leave by law
than their U.S. neighbors.
3. Marijuana Legalization In the U.S., states have taken the lead on
regulating the substance. In Canada, federal legislation will make cannabis
legal across the country sometime between August and September 2018. But how
that translates into specific workplace rules will vary from province to
province.
4. Sexual Harassment and #MeToo Across Canada, federal human rights
legislation has protected against sexual orientation and gender discrimination
for years, Pau says. Harassment tends to be covered in provincial occupational
health and safety laws, adding a layer of protection for workers and obligations
on employers.
5. Minimum Wage British Columbia, Alberta and Ontario have mandated
increases in the minimum wage in recent years-providing a case study in how such
legislation can affect businesses. One unfortunate consequence of the resulting
higher labor costs is an increase in the number of terminations and staff
reductions at small and midsize businesses.

Toys "R" Us workers take pay demands to Wall Street
Should deep-pocketed investors and corporate executives profit as a company goes
bankrupt? That's what workers laid off by Toys "R" Us are asking as they demand
compensation following the retailer's demise earlier this year.
Toys "R" Us gave out millions in executive bonuses a week before filing
bankruptcy, but isn't paying severance to the roughly 30,000 employers who are
losing their jobs as the company shuts down.
In a campaign supported by the advocacy groups Center for Popular Democracy and
the Organization United for Respect, dozens of Toys "R" Us workers on Monday
took their demands for severance payments to the New York offices of the
private-equity firms they claim are responsible for the chain's undoing.
Current and former Toys "R" Us employees are also readying a claim to file in
bankruptcy court this week asking that they receive fair compensation, according
to labor advocates in involved in the campaign.

Walmart, Target, Kohl's see the light at the end of Toys R Us' tunnel
Retailers are already preparing for the disappearance of Toys R Us from the
market. Since the toy retailer filed for bankruptcy last fall, media and
analysts have speculated on who might grab Toys R Us' market share should it
close stores or fail altogether. Now many are making plans to push deeper into
the category as the 70-year-old toy retailer winds down.
Walmart, which is often credited with being among Toys R Us' killers, said last
week it plans to expand toy offerings. Target, which added 1,400 toys to its
offering in 2017, is also beefing up the category in stores. Kohl's has company
in the department store space. J.C. Penney - whose catalogs used to be filled
with toys - has also expanded assortment.

Walmart order-by-text service could be
next stage of omnichannel retail and e-commerce
Walmart unveiled plans for their new delivery service, Jetblack, which will
allow some of their customers to order goods from their website by way of text
messages. The initiative, spearheaded by Rent the Runway co-founder Jenny
Fleiss, has started serving people in New York City and will soon expand
nationwide.
Walmart created Jetblack within their Store No. 8 technology incubator,
believing it to be a step forward in their battle to retake control of the
market against Amazon. Users will be able to shop on Walmart.com and other
websites, text Jetblack with specific orders, and receive other recommendations
before ordering it with same-day delivery.

Security Fail?
One in three companies think paying hackers is worth the risk
For some organisations it seems splashing out on cyber security products or
training is viewed as investing in something which might actually never be
needed, so some are choosing to invest elsewhere.
Decision makers at organisations around the world were asked if they would
consider paying a ransom by a hacker rather than invest in security because it's
cheaper.
Just over a third (35 percent) of US firms said they'd consider taking this
action, while the country with the fewest number of organisations which would
consider paying a ransom to hackers is the UK -- although one in five still
represents a significant proportion.

What does a ransomware attack cost? Beware the hidden expenses
Not surprisingly, industry estimates relating to ransomware damages have soared
recently. Cybersecurity Ventures, which pegged ransomware costs at $325 million
in 2015, last year estimated damages at $5 billion in 2017 and predicted it
would exceed $11.5 billion in 2019.
For security executives trying to prepare a total ransomware cost estimate, the
key is not to get fixated on the ransom amount itself. Even if you end up paying
it to recover your data - something that most security analysts advocate against
- the actual costs of the attack in most cases will end up being greater.
"Data loss and loss of productivity are two of the biggest ransomware-related
issues that executives need to proactively plan for," says Gary Mello,
security evangelist, SentinelOne. "Projecting the overall cost of an attack
needs to include loss and destruction of data, downtime and loss of
productivity, and the potential for post-attack disruption to the normal course
of business."

Cloud functions present new security challenges
Serverless apps are deployed over a cloud platform and are designed to use only
the amount of computing resources needed to carry out a task. They come into
play when needed, and then go away when the task completes. This is great if
you’re looking to maximize performance and minimize overhead in a cloud
environment. Because they are small, fast and have short lifespans, however,
serverless apps pose challenges to security teams.
The cybersecurity industry is still trying to come to grips with containers,
those small, easy-to-deploy, pre-built little bundles of applications. Since
many containers can run in a single virtual machine, each isolated from the
rest, they are cheaper and more flexible than previous application deployment
options.

U.S. Sen. Warner: Mandatory Standards Critical
for IoT Security
Following
the release of a report to President Trump on the increasing threat of
botnets, Sen. Mark Warner, D-Va., said Thursday that the government is not doing
enough to force the private sector to build better security into Internet of
Things (IoT) devices.
The botnet report called for the establishment of security baselines for IoT
devices in both commercial and government environments, similar to the type of
standards Warner has been advocating for in
legislation he introduced in the Senate last August with Sen. Cory Gardner,
R-Colo.
Their bill calls for "minimal cybersecurity operational standards for
Internet-connected devices purchased by Federal agencies."
A draft of new legislation in the House also calls for an in-depth study
into the IoT marketplace in order to coordinate the appropriate regulatory
framework for the burgeoning industry.
Warner, co-founder of the Senate Cybersecurity Caucus, said the report is
further evidence that Congress needs to move quickly to make that bill law.

US Authorities to Open Criminal Investigation into Bitcoin Price Manipulations
The Justice Department has opened a criminal test into whether dealers are
controlling the cost of Bitcoin and other digital monetary standards,
significantly tightening up U.S. investigation of scorching markets that
commentators say are overflowing with unfortunate behavior, as per four
individuals acquainted with the issue.
The examination is centered around unlawful practices that can impact costs –
for example, ridiculing, or flooding the market with counterfeit requests to
trap different products into purchasing or offering, said the general
population, who requested that they should not be recognized in light of the
fact that the survey is private.

Retail chains post impressive e‑commerce
growth in this week's earnings news
A number of retail chains reported strong e-commerce growth this week,
helping them post revenue increases as store sales slump.
DSW didn’t break out exact e-commerce revenues, but chief financial
officer Jared Poff said on the company earnings call that orders placed
online and via a mobile device increased by more than a third year over year
for its first fiscal quarter ended May 5. Total comparable sales were up
2.2% overall.
Express Inc. (No. 97) reported a 35% increase in e-commerce sales for
the first quarter. Online sales accounted for 28% of total revenue, or about
$134.2 million, during the quarter, up from 21% of total revenue, or about
$99.6, million during the same period last year.
E-commerce sales at Ulta Beauty were up 48% year over year to $154.4
million during the first quarter. Online sales now represent 10% of the
retailer’s total $1.54 billion in overall sales. Comparable retail store
sales increased 4.7% during the same period last year and overall comparable
sales (including stores open at least 14 months and e-commerce sales) were
up 8.1%.
Lululemon Athletica Inc. (No. 90) posted a 60% year-over-year
increase in first quarter comparable sales through its direct-to-consumer
channel, which is mostly online sales, while comparable store sales rose 8%.
Total comparable sales were up 20% with a net revenue of $649.7 million.
Abercrombie & Fitch Co. (No. 69) announced a 14% increase year over
year in direct-to-consumer sales, which include e-commerce transactions,
during the first quarter. The direct channel generated $200.7 million in
sales, or about 27% of the apparel retailer’s total sales of $730.9 million.
Dick’s Sporting Goods (No. 54) online sales increased 24% year over
year during the first quarter to $210.1 million. That’s now 11% of total
sales, compared with 9% during the same period last year. Comparable
same-store sales dipped 0.9%, but overall the retailer reported a 4.6% total
revenue increase to $1.91 billion.
Costco Wholesale Corp. (No. 12) boosted e-commerce sales by 36.8%
year over year for its 2018 fiscal third quarter ending May 13. Profits are
down with a gross margin of 11.1% compared with 11.5% during the same period
last year. Total comparable sales were up 12.1% to $32.4 billion.
Hibbet Sports Inc. reported that online sales now make up 7% of
overall sales or $19.2 million. Overall expenses hit 22.5% of net sales,
compared with 21.2% last year. Comparable store sales were down 0.3%, with
net sales across stores and e-commerce totaling $274.7 million.

Amazon needs to get a handle on its
counterfeit problem
'Fulfilled by Amazon' should be a badge of trust, not a legal loophole
Legally, Amazon isn't responsible for third-party counterfeits, as its
Fulfilled by Amazon service acts as a shield against liability. With FBA,
Amazon takes care of the entire transaction between sellers and customers.
It stores, ships and processes payments, but the only thing it doesn't do is
claim to be the owner -- and that's what keeps it from being held
accountable.
The
Counterfeit Report (TCR), an advocacy group that works with brands to
detect fake goods, has found around 58,000 counterfeit products on Amazon
since May 2016. That's a small slice of the 560 million items on the site,
but even a single counterfeit is probably too many for most customers. Craig
Crosby, TCR's publisher and CEO, said that as Amazon's sales keeps
increasing, so does the fake-goods problem. All told, the group managed to
have 35,000 items taken down, but TCR says that the total number of fakes on
Amazon could be much higher than 58,000, since that accounts for only brands
it represents.
Although Amazon is not be liable for the sale of counterfeits on its
marketplace, thanks to its FBA program, that may not be the case for long.
Mark Schonfeld, a partner at law firm Burns & Levinson LLP, in Boston, who
focuses on intellectual property cases, said that Amazon has been able to
shield itself because when it started its business, it acted only as an
intermediary between buyer and seller. But that's clearly changed in the
past few years as Amazon has taken on the approach of being more of a direct
seller, be it through its own sales or those that are Fulfilled by Amazon.

Muncie, IN: Three sentenced in $1.2M Amazon
return scheme; stole over 2,700 items
Three people have been sentenced in a fraud investigation involving more than $1
million worth of Amazon merchandise. Erin and Leah Finan, plead guilty to
federal mail fraud and money laundering charges and were sentenced to 71 and 68
months respectively. Danijel Glumac, pleaded guilty to money laundering and
fencing items, and was sentenced to two years. U.S. Attorney Josh Minkler said
the Finans and Glumac stole and sold more than 2,700 electronics items such as
GoPro digital cameras, Xbox’s, Samsung smartwatches, and Microsoft Surface
tablets. "For the Finans, fraud had become a way of life. Their Amazon scheme
was their “job.” It involved placing thousands of Amazon orders, creating
hundreds of false identities, retrieving their stolen goods from retail shipping
stores all over Indiana, and selling them to their fence, Glumac, on a
near-daily basis." Their theft included more than $1.2 million in stolen
products and they made more than $750,000 by selling those products over a
two-year period.

Gillette, WY: Woman gets probation in $10,000
theft, Kleptomania term paper defense fails
A 24-year-old Wyoming college student who claimed she stole more than $10,000 in
store merchandise as research for a term paper on kleptomania has been sentenced
to five years of supervised probation. Lydia Marie Cormaney was sentenced last
week after she pleaded guilty earlier to two counts of felony shoplifting and
two counts of misdemeanor shoplifting. Cormaney was arrested at Walmart in June
2017 with a cart full of nearly $2,000 in unpaid items. At the time, the
Gillette College student told officers she was working on a paper on the
emotions people with kleptomania experience. When officers discovered she was
only enrolled in a biology class, she was arrested.

ID: Stokes Market employee charged with theft of nearly $9k in merchandise
A Burley store employee, who police said stole thousands of dollars in tools and
other items from the store, is charged with grand theft and burglary. Michael L.
Thompson, 37, was arrested on May 31 after a warrant was issued for his arrest
in connection with merchandise that had been stolen from Stokes Market in 2016.
Detectives said Thompson was a lead employee on the store’s freight crew and was
stealing tools and other items from the store. The store recovered $8,835.95 in
merchandise with the help of another employee but said other items remain
missing. A female employee, who was dating Thompson, said he told her never to
look in a locked room at his home. When they were having a barbecue and he was
downstairs, she took a peek inside the room and discovered it was full of
merchandise that belonged to her employer.

Chubbuck, ID: Couple accused of stealing FedEx
packages from their own delivery vehicles
A boyfriend and girlfriend have been accused of stealing numerous packages while
working for FedEx to support their heroin addiction. Authorities said various
items of merchandise that were reported stolen were found in the possession of
Nelson and Wheeler, and it was later discovered that Nelson and Wheeler sold
some stolen merchandise to several local pawn shops.

New Iberia, LA: Jeanerette man identified as
victim in fatal parking lot shooting at McDonald's
One person is in custody following a fatal shooting Monday evening at the
McDonalds's on Admiral Doyle Drive in New Iberia. Major Wendell Raborn said that
another suspect is being sought at this time. Raborn said detectives were in the
area at the time that shots rang out and were on scene in less than a minute and
captured one of the suspects as he was running away. Police have identified the
victim as a 20 year old Levonne Johnson of Jeanerette.

Tucson, AZ: Armed Robber in SWAT standoff
arrested inside a Mattress store
A Midtown Tucson street was shut down for hours Monday after a possible armed
robbery and standoff. At about 8:20 a.m., Tucson Police say they got a call from
Just Right Mattress Outlet, saying there was a burglar inside. They said they
had video surveillance telling them where he was and what he was doing. Police
said they saw what appeared to be a rifle and called in the SWAT team and bomb
squad. For hours, the hostage team used a bullhorn to try to get him to come
out. They told him they were monitoring his movements even the fact that he had
fallen through the ceiling. SWAT officers entered the mattress store and a
nearby locksmith business and after hours of negotiating the suspect came out.

Santa Barbara, CA: Multiple Armed Robbers storm
into Trader Joe’s
Police are investigating a reported armed robbery involving multiple suspects
that occurred at the Trader Joe's grocery store on N. Milpas Street late Sunday
night. Police said the suspects used rifles and held the store employees at
gunpoint, after which, the robbers drove away from the scene with an unknown
amount of money. The crime happened after the store's closure at about 10:30
p.m. No customers were inside the store at the time. The employees did not
suffer any injuries in the crime.

Former state Rep. Sandra Pihos of Glen Ellyn entered the plea Monday. Her
sentence includes 50 hours of community service and a year of court supervision.
Authorities say she stole nearly $600 in women's clothes from Von Maur in
Lombard's Yorktown Shopping Center before trying to return the stolen items for
cash or store credit on the same day.

Skimming Thefts
Clarksburg, WV: Five Florida residents face charges in multi-state gas
station skimming operation
Five Florida residents pleaded guilty Monday to using gas station
skimmers to steal money across four states, including West Virginia.
Each of the suspects admitted to using skimming devices at gas pumps,
uploading account information, and creating fake cards with those
accounts to make purchases at different businesses. Gomez, Sosa, and
Diaz each face up to up to 7 1/2 years in prison and fine of up to
$125,000 for the conspiracy count, and up to 10 years in prison and up
to a $250,000 fine for the access device count.

Your self-evaluation is probably the most important document you'll write all
year and it requires a degree of self-reflection and openness that, if done
correctly, thoroughly, realistically and written well, will in actuality garner
more respect than virtually anything else you can do. However, it's also a
double-edged sword that mandates your adherence and constant effort to reach
your written objectives and goals. The problem is that while most are rather
open about their areas of improvement, very few actually quantify what they are
going to do to improve and set specific goals that are realistically obtainable.
The first step may be in just approaching and completing the reviews of your
direct reports first and doing them with the same intensity and focus as you do
