Sonya Hostetler named President of Nashville Division for Kroger Co.

Hostetler spent the previous 30 years with Walmart Inc., where she began as an hourly associate and went on to hold key leadership positions in retail, asset protection, human resources and operations. Most recently, Hostetler was VP and regional general manager based in Dallas, one of Walmart’s largest markets. In this role, she led 13 markets, 122 stores and 45,000 associates, Kroger said. Retailers Urge Tennessee Supreme Court to
Uphold Felony Conviction for Serial Shoplifters

Washington, DC – This term the Tennessee Supreme Court will decide whether the state of Tennessee can use its burglary statute to prosecute serial shoplifters who have been issued no-trespass warnings banning them from re-entering retail stores. Leading retailers are encouraging the court to uphold this practice, arguing that habitual shoplifters should face more stringent consequences to deter them from re-victimizing the same retail establishment.

“Retailers are doing all they can to combat the growing problem of shoplifting. But their efforts cannot succeed unless they are backed up by serious legal consequences, including the use of a felony burglary charge for shoplifters who return to stores after they’ve been issued a trespass warning by the retail establishment,” said Deborah White, President of the Retail Litigation Center (RLC) & General Counsel of the Retail Industry Leaders Association.

The RLC along with the National Association for Shoplifting Prevention (NASP) and the Tennessee Retail Association (TRA) filed a friend-of-the-court brief asking the Tennessee Supreme Court to permit the enforcement of felony burglary statutes to cover habitual shoplifters who ignore no-trespass notices and then re-enter retail establishments to try to steal more products. rila.org

OSHA: 2 Million Reports of Workplace Violence Each Year - 450 Deaths
Verify: Is workplace violence becoming more common?
The Occupational Safety and Health Administration says about two million people report some type of workplace violence each year.

According to the Occupational Safety and Health Administration, about 25 percent of workplace violence goes unreported.

The National Safety Council says assaults are the fourth leading cause of work-related deaths. The council reports between 2014 and 2017, workplace assault that led to nonfatal injuries increased by about 2,400 cases.

The National Safety Council says in 2017, workplace assaults resulted in more than 18,000 injuries and 450 deaths. The council reports certain industries, like healthcare and education, are more prone to violence. 13wmaz.com

Man accused of killing 2 managers, injuring Officer at Walmart
Martez Abram, 39, is accused of shooting the two employees to death and injuring an officer Tuesday morning. One employee was shot inside the store, another employee was shot outside the store. Both were killed. Families of the victims confirmed their identities as Brandon Gales and Anthony Brown – both were fathers. A Southaven officer was also shot during the incident - but he is expected to be ok. The bulletproof vest he was wearing stopped the bullet.

According to investigators, authorities recovered several weapons at the scene. Martez will be facing two charges of murder after his release from the hospital, but officials said more charges could be coming.

The DA told FOX13 he was possibly suspended after bringing a knife to work a few days earlier. “To our knowledge he did not threaten anyone with it, he just showed the knife,” Champion said. Officials said Abram didn't have a criminal history before the shooting in Southaven. fox13memphis.com

Legislatures could consider changing laws regarding theft as it pertains to flash mobs. If these flash mobs make customers or staff feel threatened or fear for their own safety, this intimidation could raise the bar to becoming robbery, a felony with more serious consequences. Retailers bear the primary responsibility. Security cameras, how and where more expensive items are displayed or controlled, and training staff on what to do are important first steps. Staff should learn to get descriptions of thieves, vehicle descriptions, call police and secure video. Forming retail alliances, sharing information as Premium Outlet Mall does, also will help, as well as a push to prosecute. Facial biometrics’ law enforcement potential debated around the world
As facial recognition becomes more commonly used, controversies and calls for limitations continue around the world. Both sides of recent mass protests in Hong Kong have been using facial recognition to identify individuals on the other side. Protesters also began taking pictures of police officers, after they deployed without wearing visible badgers, to identify them using facial recognition. Protesters have spray painted the lenses of CCTV cameras black in at least one instance.

New York police plan to continue using facial recognition, but only for investigations, a representative said during a recent panel discussion. NYPD Detective Bureau Assistant Chief Jason Wilcox said that people expect the force to use cutting-edge technology, and that it is “not scanning the people walking down the street, trying to identify wanted people.”

Civil liberties advocates in Britain are also calling for public facial recognition to be banned, while police say it is a potentially highly valuable tool. Woman - Pharmacist impersonator filled over 745,000 phony prescriptions for over a decade

California’s attorney general has charged a Milpitas woman with impersonating a pharmacist and dispensing hundreds of thousands of prescriptions over several years. Kim Thien Le is facing three felony charges of false impersonation, identity theft and obtaining money, labor or property by false pretenses, Attorney General Xavier Becerra’s office announced Tuesday.

For more than a decade, beginning in November 2006, Le used license numbers of legitimate pharmacists to illegally impersonate pharmacists and dispense more than 745,000 prescriptions.

More than 100,000 of those prescriptions “contained highly regulated controlled substances, including prescription opioids such as fentanyl, oxycodone, hydrocodone, morphine, and codeine,” a statement from Becerra’s office said.

The attorney general also alleges Le never obtained a pharmacist license “and was therefore never actually legally permitted to dispense medication.”

Capital One Breach Shows Danger of a New Insider Threat - A Cloud Provider
The alleged Capital One hacker had worked at the bank's cloud provider recently, highlighting the challenges in stopping attackers with inside knowledge.

The breach disclosed by Capital One Financial Corp. this week highlights an uncomfortable truth: It’s almost impossible to stop a determined hacker with inside knowledge of a firm’s systems.

As more information is stored in the cloud, staff trained in how to use these systems could become a threat to other companies.

The data exposed in the Capital One hack was stored on Amazon.com Inc.’s cloud, according to a federal criminal complaint and people familiar with the matter.

An Amazon spokesman attributed the hack to a firewall issue, not a cloud-computing problem.

While AWS itself wasn’t breached, cloud providers should do more to assist their users.

Equifax throws Big Money at Cybersecurity

Equifax Spent $1.44 Billion Recovering From 2017 Breach
$1.26 Billion allocated for technology and security investments between 2018 and 2020 and hired 1,000 in IT and cybersecurity over the past year alone.

Equifax so far has spent around $1.44 billion recovering from the cyberattack, including data security and technology investments and legal costs, according to its most recent financial statement.

The company plans to make its board-assessment method public and it is promoting it to other businesses through the World Economic Forum and the National Association of Corporate Directors, he said. Representatives for these organizations declined to comment.

“We want to be a force for good,” Jamil Farshchi, who joined as chief information security officer in February 2018. Mr. Farshchi comes from Home Depot Inc., where he cleaned up after a 2014 breach exposed data about 56 million customers—one of the biggest cyber incidents until that point.

Equifax said it now ties part of executive bonuses to cybersecurity goals. Executives this year became accountable for improving firewalls to defend against attacks targeting web applications and implementing more advanced technology to classify cyber threats, among other objectives. The company is also experimenting with a system to rate managers in part by how well their teams adhere to security practices.

Mr. Farshchi reports to Mr. Begor, Equifax CEO, while the former head of security reported to Equifax’s chief legal officer. A direct relationship with the CEO, some analysts say, can help elevate cybersecurity to a business priority.

Mr. Begor receives security alerts on his smartphone through a mobile app, as well as emails and text messages from Mr. Farshchi. Some alerts are automated, sent by security tools. Others Mr. Farshchi decides to send on an ad hoc basis, considering risks such as attacks on customers or business partners that use the same technology as Equifax. The security team may send alerts if it discovers hacked credentials from the company’s vendors for sale in dark web criminal forums, he said.

New study exposes low confidence among security professionals in their security operations centers.

More than half of IT and security professionals consider their security operations center (SOC) ineffectual, and the long hours, alert overload, and incomplete visibility into their IT infrastructure has 65% considering quitting their jobs.

The saga of the stressed-out SOC has been well documented over the past few years as organizations have amassed a cache of security tools amid an ever-expanding threat landscape where they don't have the time, resources, or expertise to fully tap into the tools nor keep up with all of the data they generate. Meantime, nearly 70% of organizations studied in a new report by the Ponemon Institute consider their SOC essential or very important to their security posture.

Store Owner with Alleged Ties to the Mafia 'Flees for His Life'
The three-level Giorgio Gruppo Roma store at 1440 Peel Street in Montreal has shuttered as its owner, Tony Elian, flees for his life. That's according to a French language report over the weekend in TVA Nouvelles, which says that it has sources who say that Montreal police have informed Mr. Elian to go into hiding because his life is in danger, with threats said to be linked to his many debts to creditors.

The threats to Mr. Elian's life follow other serious incidents. In the spring of 2017, his car was firebombed and in March of 2018, he was shot with a shotgun in his Peel Street store. The TVA Nouvelles report notes that last week, a moving truck was parked in front of the shuttered Giorgio Gruppo Roma store.

Debts have plagued Mr. Elian's business dealings since at least 2015. TVA Nouvelles reports that there's a long list of subcontractors claiming to be unpaid for work done on a condominium building in nearby Westmount that was developed by Mr. Elian's company Cesare Immobilier. Between 2009 and 2014, Mr. Elian was involved in a $1.1 million lawsuit with Frank Bertucci, who was accused of trying to bribe a Revenue Canada representative with $150,000 for a tax reduction.

Some are saying Mr. Elian had ties to criminal entities in the Montreal area. He was seen in photos with gangster Ducarme Joseph who was murdered in 2014, and he attended the funeral of Italian-Canadian crime boss Vito Rizzuto in late 2013 - Rizzuto is alleged to have been the leader of the Sicilian Mafia in Canada. retail-insider.com

How Canadian Employers Address Bullying and Harassment
More than half of Canadians say they have experienced bullying at work, according to the results of a November 2018 survey by polling firm Forum Research. The survey showed that 55 percent of them reported bullying to management, senior staff, human resources, or another person or department responsible for employee conduct. Only 1 in 3 Canadian employers took action to address the bullying.

Workplace bullying and harassment can have far-reaching impacts on worker health and safety, leading to absenteeism, lower productivity, anxiety and depression.

What British Columbia Employers Can Do
To date, British Columbia is the only Canadian province that has developed policies specifically addressing workplace bullying. These steps include the following:

Draft a policy statement that workplace bullying and harassment are not acceptable. Then distribute the statement to workers.
Create ways workers can report incidents or complaints of bullying and harassment.
Figure out how HR or supervisors will handle incidents or complaints of workplace bullying and harassment, including how and when to conduct investigations.
Train workers and supervisors about what bullying and harassment are.

Policies Across Canada
Each Canadian province has different laws about workplace bullying and harassment. McFarlane explained that Ontario's approach is different from British Columbia's because Ontario has legislation that requires an investigation. Under Ontario's health and safety laws, employers must have a workplace harassment policy that includes procedures for workers to report incidents of harassment. Employers also have a general duty to protect workers from risks on the job, including physical and mental harm. shrm.org

'It can happen to anyone': Fraud on the rise in Saskatoon and nearly double the incidents reported in Regina
According to Statistics Canada, 5,957 incidents of fraud were reported to police in 2018, up from 5,503 in 2017. Many of those incidents happen in Saskatoon. Statistics Canada, in its most recent Crime Severity Index report released this month, found that Saskatoon recorded 1,739 occurrences of fraud in 2018, up from 1,459 in 2017. E-Retailers Need to Prepare For Holiday Spikes
Spike in web traffic means additional threat of cyber-attacks
Web traffic during Amazon Prime Day, in which 250 e-commerce merchants participated, reflected a significant uptick in the US, according to Akamai. The fifth annual event spanned 48 hours this year, resulting in a 14% spike in web traffic.

Interestingly, the surge in US traffic resulted in a decline in global traffic, “with the exception of LATAM, where baseline traffic increased nearly three times as much as the US,” according to the research.

The report warned that retailers need to be aware of these spikes in traffic in order to prepare for future online sales and the holiday season, according to Akamai’s Chris Wraight. “Also, the growing number of shoppers who use their mobile device to research means that it is vital to present images and videos quickly, regardless of device, browser or connection speed,” wrote Wraight.

With a spike in traffic comes the additional threat of cyber-attacks. The report also found that “nearly 10 billion total bot attacks during the 48 hours of Prime Day is equal to the number of retail-specific bot attacks we detected from May to December 2018. Prime Day was very attractive to threat actors due to the high visibility of Prime Day and the larger number of retailers offering their own promotions. Detecting, correctly interpreting and remediating credential stuffing attacks needs to be a top priority of retailers, especially going into the Q4 holiday peak traffic season.” infosecurity-magazine.com

Phoenix, AZ: Man wanted for $45,000 wine theft, found in federal prison in California
A man wanted for a $45,000 wine theft in Scottsdale was found in a federal prison in California. Court records show that Joseph Eric Hill, 52, was charged last week for theft, forgery, and identity theft after wine was stolen from Phoenix Wine in Scottsdale. Police say Hill ordered 51 bottles of wine and liquor and paid for the order with a stolen credit card. When he came to store, he allegedly provided credit card information and identification from an identity theft victim from California. After helping to load the wine bottles into his car, a store assistant took a photo of Hill. Later "Phoenix Wine received a charge back for $45,339 for this transaction." abc15.com

West Springfield, MA: Two wanted in $10,000 credit card/ID theft
Police in West Springfield are asking for the public's assistance in identifying a pair of suspects accused of using fraudulent credit cards at various location. West Springfield Police state that the pictured individuals allegedly purchased over $10,000 in merchandise using fraudulent credit cards, all on July 15. Both individuals that are pictured may have ties in Vermont. westernmassnews.com

American Canyon, CA: Walmart cashier got kickback for allowing thefts totaling $1,100
A Vallejo woman was arrested Monday after American Canyon police say she was paid for her help in allowing someone to come into the store and steal more than $1,100 of merchandise. Eboni Symone Green, 24, was on the job for only five days. Green was arrested on suspicion of four felonies related to theft, embezzlement and conspiracy. napavalleyregister.com

Tulsa, OK: One man dead after shooting outside Whataburger
Police are investigating after one man died outside a midtown Tulsa Whataburger early Wednesday morning. Tulsa police responded to the shooting call near 15th and Peoria around 2 a.m. Officers say an altercation inside the Whataburger continued into the parking lot where the man was then shot multiple times. No arrests were made after questioning the shooter. fox23.com

Phoenix, AZ: 2018 shooting surveillance video now released
Customers tackle murder suspect after being held hostage inside Circle K
The video, just now released, after the Maricopa County Attorney's Office ruled the officer-involved shooting of the suspect was justified. Police say 53-year-old Joel McClain Carson entered the Circle K near 19th Avenue and Grant Street on May 9, 2018. In surveillance video, he can be seen deliberately walking up to a customer waiting in line and shooting him in the back of the head. The victim was 24-year-old Efran Hernandez, who was a father of two. He died at the scene before paramedics could get him to a hospital. Carson reportedly tried to shoot several other customers and employees in the store, but his .22-caliber handgun malfunctioned. Investigators say Carson had recently stolen the gun. abc15.com

San Antonio, TX: C-Store Clerk shot and wounded in Armed Robbery
The shooting was reported around 10:30 p.m. at a DMJ Grocery store. Two men wearing masks were attempting to rob the store when an argument broke out between one of the men and the store clerk. That's when, police said, one of the suspects shot the store clerk, hitting him once in the arm and once in the chest. ksat.com

Sherman, TX: 7 people, 4 cars involved in Goodwill Burglary
The Goodwill loading dock is where four different cars of people pulled up, got out, and took items from the donation pile. "You ought to be ashamed of yourself," Goodwill marketing specialist Sarah Pierce said about the people who stole from them. Surveillance video caught seven people in four different cars taking donations from the loading dock on Sunday night from about 8:30 p.m. to midnight. "86 cents to every dollar that is sold from the donations we receive goes right back into our mission, which is to improve the quality of life for individuals with disabilities or disadvantages," Pierce said. kxii.com

Kent, WA: Teen with gang affiliation threatened Safeway employee with gun
An 18-year-old suspected gang member from Tukwila was charged with first-degree robbery in King County Superior Court. The robbery is alleged to have happened around 7:15 p.m. July 5 at Safeway. In a probable cause document, police said Ismael Cibrian threatened a store employee with a gun while he stole two cases of Modelo from the store. kiro7.com

Port Huron, MI: Four teens accused of Kay’s Jewelers robbery waive preliminary hearing
The four were arrested following the attempted robbery of Kay Jewelers in Fort Gratiot on July 9. A little before 7:30 p.m., three males broke glass in the store with large hammers while a fourth suspect stayed in a vehicle, police said. Three suspects entered the store and grabbed an unknown amount of jewelry before quickly leaving, witnesses told detectives. The incident lead to a car chase through Port Huron, ending in a crash. Three are charged with armed robbery, conspiracy to commit armed robbery, receiving and concealing stolen property $20,000 or more and conspiracy receiving and concealing stolen property motor vehicle. thetimesherald.com

Chinese National Sentenced for Smuggling 40,000 Apple Knockoffs from China
A 45-year-old Chinese national has been sentenced to more than three years in prison for his role in trafficking and distributing counterfeit Apple products from China in the United States, the Department of Justice announced in a statement on July 30. Li Jianhua, who also goes by Jeff, had smuggled more than 40,000 electronic devices and accessories, such as fake iPhones and iPads, for the five years between 2009 to 2014 while living on a student visa. theepochtimes.com

Granby, CO: Former City Market employee sentenced to 90 days in jail, 3 years probation for $12,000 theft
Penny Sanchez Rivera who pleaded guilty to stealing over $12,000 from self-checkout resisters at Granby’s City Market store was sentenced to 90 days in jail and three years of supervised probation. Sanchez Rivera will additionally be required to make a $500 donation to DARE Winter Park. Sanchez Rivera’s case made local news in September when over $12,000 was stolen from self-checkout registers at City Market after a late night power outage. Authorities reviewed security camera footage from the incident and identified Sanchez Rivera as a suspect in the case. skyhinews.com

The Old School 'Us Them' Mentality
Partnerships and collaboration go well beyond the typical definition and one of the most important lessons in your career is realizing that your team includes the solution providers that deliver the tools, technology and resources that help make you successful.

One of the common mistakes I've seen over the years is not totally appreciating the role these executives and companies play in the overall success of a retailer's program. So much so that without them the program would fail.

For decades the "Us Them" mentality prevailed as one of the biggest obstacles to growth and development, when in fact these executives hold the keys to tomorrow's success.

And yes, many LP execs have transitioned to the 'Dark Side' and all of them quickly find out the true definition of rejection and friendship, but the good ones can be one of your most critical assets.

So make sure your entire team recognizes it, appreciates them, and is exhaustive in finding the best ones regardless of yesterday, because they have the answer to tomorrow's challenges.
