On August 3, Governor Cuomo announced the launch of a new DMV pilot program using state-of-the-art technology to crack down on underage drinking and the use of fake IDs. The new technology, developed by New York-based company Intellicheck Inc., allows law enforcement to scan a license or ID using the Intellicheck "Law ID" app on the investigator's smartphone and match it against driving records from all 50 states. Within seconds, investigators know if an ID is authentic or not. New York's is the first DMV in the nation to pilot the Law ID app. Later this month, additional DMV investigators will begin using this technology in the field.

DMV Executive Deputy Commissioner and GTSC Acting Chair Terri Egan said, "With the help of new technology, our investigators can detect even the most sophisticated fake IDs."

On May 9, Governor Cuomo announced that during underage drinking sweeps conducted in April 2018, the State Liquor Authority charged 200 businesses with selling to a minor, and DMV made 48 arrests of persons under 21 attempting to use false identification to purchase alcohol.

NY will be conducting statewide sweeps of locations holding liquor licenses, including bars, restaurants, liquor stores and grocery stores, looking for fake IDs and illegal sales to minors.

"Underage drinking can lead to bad decisions that could have lifelong consequences, or worse, and this administration is committed to taking proactive measures to prevent young New Yorkers from purchasing and abusing alcohol," Governor Cuomo said. ny.gov

The Big Secret's Out
Barnes & Noble Says Former C.E.O. Demos Parneros Was Fired for Sexual Harassment

When Barnes & Noble fired its chief executive, Demos Parneros last month, the bookseller was mysteriously quiet about why.

On Tuesday, the explanation came spilling out in a public exchange of accusations between Mr. Parneros and the company — including that Mr. Parneros had been fired in part because of claims of sexual harassment by an employee.

The fight began when Mr. Parneros filed a lawsuit claiming defamation and breach of contract. He said that he had been fired without warning after a deal to sell the company fell through. Casting himself as a “well-respected retail executive,” he claimed that the bookseller had enabled rumors that he was let go because of “serious sexual misconduct.”

He described Barnes & Noble as a “financially troubled business” that is in turmoil and disarray, with a “volatile” chairman who “refuses to relinquish control.” He said he was owed severance of $4 million in cash, plus equity and damages.

In response, Barnes & Noble’s board said in a statement that Mr. Parneros had been “terminated for sexual harassment, bullying behavior and other violations of company policies.” Until Tuesday, the company had said only that he was terminated for violating policies, without further explanation except to say they were not related to financial matters.

In his lawsuit, Mr. Parneros referenced the alleged misconduct, revealing details that Barnes & Noble had not disclosed.

The allegations lobbed in the suit are likely to make it even more difficult for Barnes & Noble to recruit its next chief executive, at a moment when the company desperately needs stable leadership.  nytimes.com

Payless Shoe Architect Sentenced For $425,000 Fraud
3rd Party's Billing Fake Co. at His Mom's House

The Board of Directors Issued the following statement:

The lawsuit filed by Demos Parneros is nothing but an attempt to extort money from the Company by a CEO who was terminated for sexual harassment, bullying behavior and other violations of company policies after being in the role for approximately one year. The allegations contained in the complaint about Len Riggio are replete with lies and mischaracterizations. They are an example of someone who, instead of accepting responsibility for blatantly inappropriate behavior, is lashing out against a former employer. The Board, advised by legal counsel at Paul, Weiss, Rifkind, Wharton & Garrison LLP, unanimously terminated Mr. Parneros’ employment following a thorough investigation that revealed multiple examples of significant misconduct. Mr. Parneros not only violated his employment agreement, but also compromised the trust and respect that we strive to foster throughout our organization. businesswire.com

Payless Shoe Architect Sentenced For $425,000 Fraud
Manuel Francisco Ruiz-Lacayo, 38, Lawrence, Kan, was sentenced today to 21 months in federal prison and ordered to pay more than $425,000 in restitution.

He worked for Payless as a project manager for store planning which included designing exteriors and interior floor plans for new stores in Central and South America.

Without the knowledge of his employer, Ruiz-Lacayo told the contractors that 3D renderings of storefronts were required for all projects. He told them to use a firm he said was located in Costa Rica. In fact, the address he gave them was his mother’s and no renderings were produced. Ruiz-Lacayo submitted invoices from the fictitious firm to Payless for payment. justice.gov

Virginia: The Threshold for Felony Larceny Just Increased in Virginia - But Is It Enough?
Both Virginia’s Democratic Governor Ralph Northam and Republican Speaker of the House of Delegates, Kirk Cox, have recently changed that though. Beginning on July 1, 2018, through a bipartisan agreement, the threshold for felony larceny charges increased to $500, ( Previously, that was over $200). While the new law is a good step towards justice, many are wondering if it is enough. “Even with the new law, the threshold in Virginia is still just half that of most states,” says Patrick Woolley of Price Benowitz LLP. “Most states have a threshold of $1,000 for felony larceny charges. Other states, such as Wisconsin, set their threshold as high as $2,500. The new law will not actually help many people, as theft of something as small as a cellphone could still be considered a felony larceny charge.” bluevirginia.us

Chicago, IL: Judge Tosses Suit Against Southwest Airlines on Fingerprints, Rights to Privacy
A Chicago federal judge has tossed a proposed class-action lawsuit alleging Southwest Airlines violated the law by requiring that certain employees use fingerprints to sign into and out of work. Judge Marvin Aspen concluded a courtroom wasn't the proper venue to resolve what he deemed a relatively minor dispute between unionized workers and a company with a collective bargaining agreement. He said in a decision posted last week that the right place was arbitration. Several Southwest agents filed the lawsuit in federal court this year. They argued that the use of fingerprints violated the Illinois Biometric Information Privacy Act. It sought both an injunction halting the practice and an order forcing the airline to destroy any biometric data it gathered. ktvn.com

NIST Calls For Comment of Ecommerce Security
In an effort to reduce online fraud, the National Cybersecurity Center of Excellence (NCCoE), a subdivision of the National Institute of Standards and Technology (NIST), announced it is now accepting feedback on its draft exploring the ways in which multi-factor authentication can help to mitigate fraudulent online purchases.
As was the case in Europe after retailers adopted chip-and-pin technologies, retailers in the US have seen a spike in ecommerce fraud. In fact, the US saw a 30% increase in online fraud and credit card theft during 2017.

The technology partners that collaborated on the project signed a cooperative research-and-development agreement and worked in a consortium with NIST to build the draft, NIST Special Publication 1800-17, Multifactor Authentication for E-Commerce. With the draft, retailers will able to successfully implement the example solutions by following the step-by-step guide.

Collaborating with stakeholders in the retail sector, NCCoE has developed a draft that explores the use of multifactor authentication in a variety of risk-based scenarios. “In the project’s example implementations, if certain risk elements (contextual data related to the transaction) are exceeded that could indicate an increased likelihood of fraudulent activity during the online shopping session, the purchaser will be prompted to present another distinct authentication factor – something the purchaser has – in addition to the username and password,” NIST wrote.

The guide has been divided into three volumes for greater ease of use. Comments are currently open and can be submitted to NIST by 22 October 2018 by using this online form. infosecurity-magazine.com

R-CISC: Targeting the Supply Chain
Threat actors are increasingly targeting supply chain organizations to get around ever more hardened corporate perimeters, modifying their products to achieve a range of potential effects, such as cyber espionage, organizational disruption or demonstrable financial impact.

According to a recent report by the National Counterintelligence and Security Center (NCSC), software supply chain infiltration has already threatened critical infrastructure and is poised to imperil other sectors. China, Russia and Iran were cited as the most capable and active states involved in such economic subterfuge.
As attackers look for new ways to exploit computer networks via the privileged access given to technology providers, software supply chain vendors are increasingly becoming attractive targets. As such, software supply chain infiltration is one of the key threats that corporations must consider, and in particular, how software vulnerabilities are exploited.

In July 2018, hackers compromised a font package installed by a PDF editor app and used it to deploy a cryptocurrency miner on users’ computers. Hackers breached the cloud server infrastructure of a software company providing font packages as MSI files, which were offered to other software companies and ultimately downloaded by the PDF editor app. Because the PDF editor app was installed under system privileges, the malicious coinminer code hidden inside received full access to a user’s system.

In September 2017, a booby-trapped version of CCleaner, a computer-cleaning program, was used to infect millions of machines, to specifically target 18 companies to conduct espionage including Samsung, Asus, Intel, VMware, O2 and Fujitsu.

According to a recent report from CrowdStrike which surveyed 1,300 senior IT decision makers and security professionals in the U.S., Canada, Mexico, the U.K., Australia, Japan, Germany and Singapore in April and May, two-thirds (66%) of respondents’ organizations have experienced some form of a software supply chain attack.

Conclusion
Supply Chain attacks are becoming increasingly common, and as such, organizations must pay close attention to the supply chain. Along with rigorously assessing the software supply chain suppliers they use, organizations must close the security gaps that are making them vulnerable to attack. This requires employing effective prevention, detection and response technologies. r-cisc.org

MSSP Benchmark Survey: 90% of Retailers Use Event Monitoring Services
Retail organizations are increasingly outsourcing their security functions to MSSPs, a trend that appears likely to continue in the foreseeable future, according to the “2018 MSSP Benchmark Survey” from the Retail Cyber Intelligence Sharing Center (R-CISC).

Key findings from the R-CISC survey of chief information security officers (CISOs) across 45 retail organizations included:

● Quality of service/service-level agreements (SLAs) was the top MSSP decision-making factor, followed by price/value.
● 92 percent of respondents said the cost of developing and maintaining in-house talent and/or talent engagement and retention challenges were the top reasons for leveraging MSSP services.
● 90 percent choose MSSPs to provide event monitoring for IT infrastructure logs, firewalls and intrusion detection systems (IDS)/intrusion prevention systems (IPS).
● 36 percent expect their MSSP spending to increase, and 15 percent anticipate their MSSP spending will decrease.
● 23 percent expect to use an MSSP for threat intelligence and dark web monitoring services next year.

Cyber risks are evolving, and retail organizations cannot remain static, R-CISC indicated. However, annual managed security services investments can help these organizations keep pace with cyber risks. msspalert.com

Don't Be So Sure AI Is Cybersecurity's Silver Bullet
"To be fair, AI definitely has a few clear advantages for cybersecurity," wrote Tomas Honzak, director of security and compliance at Good Data, in a recent Dark Reading post. "In reality, like any technology, AI has its limitations."

One of these limitations is our reliance on information the AI has learned. It is clear that an AI has the same learning curve as a human intelligence: Both have to see something or make a mistake before it can learn. "Even when the malware is detected, security already has been compromised and damage might already have been done," Honzak pointed out.

Another important limitation of AI is that we view it only from the defenders' side, when in fact the same tools are available to the attackers.

"If you're using AI to better detect threats, there's an attacker out there who had the exact same thought," Honzak cautioned. "Where a company is using AI to detect attacks with greater accuracy, an attacker is using AI to develop malware that's smarter and evolves to avoid detection."

"Once attackers make it past the company's AI, it's easy for them to remain unnoticed while mapping the environment, behavior that a company's AI would rule out as a statistical error," Honzak said.

While the limitations detailed above may suggest a death knell for cybersecurity AI, that is not the final conclusion to draw. Just as AI needed IBM's Watson to make AI accessible, the development of AI for cybersecurity purposes continues.

We currently use humans for detection. If AI can realize its goal of mimicking human intelligence, then it will equal or surpass the human ability to detect threats. technewsworld.com

Canadian Security's Director of the Year winners share lessons learned
Canadian Tire's Tom Rousseau on the evolving nature of LP

Tom Rousseau, VP, Enterprise Corporate Security & Loss Prevention, Canadian Tire

I am hard pressed to come up with the “most important” lesson, as I feel that within our own ecosystem we constantly deal with new risks and are constantly learning new important lessons from those new risks. As most of you know, we are now living in a world where things are becoming more intricate and are moving at a much faster speed. Although technology is helping us to keep up, it is also helping the criminal minds and allowing them to move faster and hide in better places. It seems that not only are we dealing with better scams, we are also seeing more of them.

Complacency is one of our worst enemies and I think if I was asked to pick my most important lesson it would be to never become complacent. Always be open to new ideas and new ways of doing things and always update yourself on trending or new technology. I guess it sounds like I am stating the obvious here but you would be surprised how many folks fall into this trap and learn the hard way. I would also add that sharing information amongst colleagues/police agencies, etc. is one of the most valuable tools we have as security professionals and is one of the best ways to help all of us stay ahead of the game. The old days of not wanting to share data or information because of fears of divulging “company secrets” are long gone. I strongly believe that there are multiple ways to achieve this without hurting the integrity of your company’s brands.

Businesses in Surrey believe area is still not safe, according to survey; 89% of businesses have been victimized, but only 33% report it
The Downtown Surrey BIA's annual safety audit shows 61 per cent of business owners feel no safer than they did last year in the area, while 23 per cent feel less safe, a noticeable increase from the previous year. The survey was based on 192 responses.

In spite of the bars on Taste of Africa’s storefront and their alarm system, they have had four break-ins over the years, and the trash, drug activity, fighting and people loitering in the lot next to their business have driven customers away.

Almost 89 per cent of businesses reported they had been victimized in some way. However, less than 33 per cent reported those crimes to police, believing that police were too busy or the crime was not serious enough.

Salesforce Partners with Deloitte on Report Re: How Leading Brands
Utilize Data
The report - Consumer Experience in the Retail Renaissance: How Leading Brands Build a Bedrock with Data - says that the formula for success includes embedding data into organizational principles, turning data into intelligence, and adopting a unified consumer engagement platform. [Download the full report here]

The report was based on a survey of more than 500 traditional retail, pure play, consumer goods, and branded manufacturing leaders from around the world.

It says rumours of the retail apocalypse are everywhere these days but the reality is that winners and losers in this landscape have emerged.

“Today, we find ourselves not in the midst of a retail apocalypse, but a retail renaissance. This renaissance means that brands must rethink consumer experience — and how to invest in it — to thrive.”

Home Depot Canada attacked on social media for using hijabs in advertising; Some threaten to boycott store
An August 9 promotional video from the Canadian branch of retail chain The Home Depot featuring an orange-aproned employee wearing a hijab, ostensibly an example of the promotion of a diverse and well-trained work force. “Our specialized training programs and unlimited opportunities for advancement helped Sehrish go from cashier to talent acquisition specialist,” declares the retailer.

In the days that followed, social media users took to their keyboards to express their discontent. “Why do they always show someone with a tablecloth on their head?” one woman wrote. “They’re [expletive] hypocrites and slaves, obedient to their masters, to make an ad for Muslims,” another raged. Other Facebook users said they would boycott the store.

For its part, The Home Depot didn't take the video down, and decided not to comment on the backlash it provoked, releasing the following *statement: "Home Depot is proud of the diversity of its workforce, and the objective of this advertisement is the demonstrate the unlimited possibilities for advancement that the company offers."

'We Are Open': Social media, millennials driving success of Toys 'R' Us Canada
Toys “R” Us Canada had long been the company’s “jewel in the crown” and was far stronger than its American counterpart – even though the separately run entity always had less money – because it was much smaller and more nimble, she said. But the U.S. ordeal still placed the Canadian operations in jeopardy.

They eventually hooked up with Prem Watsa, a billionaire often called the Canadian Warren Buffett, who snatched up the Canadian business, and its 82 locations, for $300-million.

Toys “R” Us started emblazoning flyers with “we are open” messaging, using social media influencers and bringing mascot Geoffrey the Giraffe, celebrities and play fairs to stores in a campaign to fend off customer loss amid the news coming out of the United States and United Kingdom.

The brand is adding benches to play areas where children can test new products or take part in crafts and games. It’s toying with allowing families to throw birthday parties at stores and opening smaller format locations. They are also looking to millennials, now embarking on parenthood, and who Ms. Teed-Much is seeing “revolt” against kids constantly playing with gaming devices, phones and computers.

New Cyberfraud: Online Retailers Warned as Digital Skimmers Infest 800+ eCommerce Sites
A Ticketmaster data breach announced in late June was subsequently discovered to be part of a widespread digital card-skimming campaign by cybercriminals known as Magecart, whose malignant code has infiltrated more than 800 eCommerce sites worldwide. The new cyberfraud threat is particularly concerning in light of a new study that found the average cost per data breach has risen to $3.86 million. Chargebacks911, a leading dispute mitigation and loss prevention firm, advises eCommerce merchants to stay abreast of Magecart-related activity and other emerging cyberfraud risks, and to take proactive measures to combat these threats.

"Merchants have become almost numb to cyberfraud, but they cannot afford to ignore it. Cybercriminals are always finding new vulnerabilities to exploit," asserted Monica Eaton-Cardone, co-founder and Chief Operating Officer (COO) of Chargebacks911. "eCommerce businesses need to stay abreast of new threats and continue to fight fraud on multiple fronts."

Eaton-Cardone emphasizes that it's not enough to focus solely on the security of internal servers—merchants need to keep an eye on all potential access points and guard against many types of losses. Below, she outlines five essential steps to mitigate the risks and potential losses from the latest Magecart data-skimming threat:

1. ENCRYPTION: Encryption renders data useless to thieves, protecting customers and reducing the overall cost per breach.

2. 3P NETWORK CONNECTION TRACKING: it's critical to control website access and permissions for outside entities.

3. VULNERABILITY ASSESSMENTS: To pinpoint potential access points for digital skimmers, Eaton-Cardone advises merchants to run scans on external-facing hosts and cloud environments to identify services "listening" for inbound connections.

4. INDICATORS OF COMPROMISE (IOCs): As soon as a breach is made public, Eaton-Cardone urges merchants to scan all code for cybercriminals' domains/IP addresses.

5. COMPREHENSIVE LOSS PREVENTION: To minimize losses, Eaton-Cardone says it's vital to implement solutions that address both intentional and accidental data breaches as well as chargebacks and other financial hits. businessinsider.com

Defendants in $1.3M ticket-switching scam hitting Home Depot & Lowe's sentenced
ATLANTA: Charles Blackman, a/k/a Ralph Jones, and Quinton Williams were sentenced to federal prison by U.S. District Judge Amy Totenberg for altering the prices of merchandise, through an elaborate “ticket-switching scheme” at The Home Depot and Lowe’s on August 27, 2018.

"These defendants defrauded Home Depot and Lowe’s of merchandise valued in excess of $300,000 and $1 million, respectively,” said U.S. Attorney Byung J. “BJay” Pak. “Security measures at The Home Depot helped uncover and stop this scheme before they could steal more. It is unfortunate that the consumer pays the cost of these elaborate schemes in a higher cost of goods.”

“The U.S. Secret Service and our law enforcement partners work tirelessly to protect our nation’s electronic financial payment systems,” said Malcolm D. Wiley, Acting Special Agent in Charge of the U.S. Secret Service, Atlanta Field Office.  “Today’s sentences should serve as a reminder that criminals will not get away with using point of sale terminals to fund their criminal activities.”

According to U.S. Attorney Pak, the charges, and other information presented in court: Blackman and his associates allegedly switched or altered the prices of merchandise by changing the Universal Product Code (UPC), so the items could be purchased at a lower price and then returned for the actual, higher retail price. They used false information and fake identifications to further their fraud. Their alleged scheme was to cheat The Home Depot and Lowe’s out of the hundreds of thousands of dollars to be made on the price difference after returning the merchandise.

Charles Blackman, a/k/a Ralph Jones, 58, of Atlanta, Georgia was sentenced to three years, one month in prison, to be followed by two years of supervised release. He was also ordered to pay restitution in the amount of $1,269,621.00 to The Home Depot and Lowe’s.

"Something just told me it was the wrong thing to do -- it didn't feel right -- I didn't have a good feeling about it." The subconscious is a very strong silent partner we all have and oftentimes it speaks to us in these phrases. The problem becomes when we over-think things and muffle the most powerful partner we have -- our own minds. Or we allow our closest confidant, our closest friend, or even at times our mentor to change or alter our true feelings. Coming to the right decision with any big issue is difficult and certainly we need the input of our trusted inner circle, and our spouse, but at the end of the day you're the one living with the consequence of your decision and you alone are responsible for it. When the bird on your shoulder is talking, make sure you listen because most mistakes are made when that voice has been muffled.

Just a Thought,
