With three VP of LP jobs and seven Director jobs on the market it's a busy time for senior LP jobs heading into the fourth quarter.

Take this Q4 senior push and couple it with the 10% and 15% increase in job postings in June and July respectively, and we're seeing the strongest job market since before the great recession.

Obviously retailers are loosening payroll compared to last year's 21% and 15% drops in June and July. That's a huge swing of 30% and 31% respectively.

If we just took March's 39% drop in job postings out of the equation, which coincidently enough almost timed perfectly with the Macy's and Toys R Us impact, we'd have an extremely strong job market for 2018 and probably one of the best in over a decade.

Even with a 10% error ratio, the numbers we're seeing are still up 20% and 21% respectfully. Which is still extremely strong and quite frankly our numbers are fairly accurate given our search model and the fact that we don't include 30 day re-posted jobs.

This job growth reflects a number of things. From increased comp's, payrolls sliced to bare bones for years, fear of the retail apocalypse subsiding a little, or at least the media has calmed down about it with a few creditable journalist even labeling this a "retail renaissance". Read more here

Criminal and administrative charges have been filed against 33 people after a blaze at a Davao City mall claimed 38 lives. 37 working for US research firm that conducted polls for some retailers. The 38th victim was the security guard trying to save their lives.

Fire investigators have identified safety failings that might have contributed to the deaths of 38 people in the recent Davao mall blaze. A task force set up to investigate concluded that the building did not meet the requirements for the enclosure of fire exits. “If the fire exit was inside the building, the law requires that that must be enclosed to prevent the smoke from coming in.”

Investigators also suspect that the fire alarm system of the top-floor 4th floor call centre SSI — where 37 of the victims perished — was “defective” and was not connected to the mall’s main system.

The mall’s owners have previously denied allegations of locked or nonexistent fire exits and insisted that fire alarms worked during the blaze.

Now, the owners of the mall, officials of Survey Sampling International, city building and fire officials and officials of the Philippine Economic Zone Authority (Peza) are all facing cases at the city’s prosecutor’s office.

Fire Superintendent Anthony Figurasin, leader of the interagency task force investigating the tragedy, said charges of ‘reckless imprudence resulting in multiple homicide’ were filed against officials of LTS Malls, officials of the mall's contractor, and numerous Davo City building officials and fire protection officials.

Also charged with the same offence were Jose Antonio San Gabriel, SSI Philippines board chair; Riza Lyn Ocampo - SSI Dir. of Administration, Rey Roble - SSI Accountant, Christopher Fanning and David Ian Weatherseed. philippineslifestyle.com

Over the last three years, the Federal Trade Commission (FTC) has cracked down on Instagram influencers, forcing users to disclose sponcon and brand partnerships with a simple hashtag (#ad or #paid are preferred) or built-in branded partner ID tools. Business is booming regardless, with even teens getting a piece of that that sweet sweet sponcon cash. However as the industry matures and companies grow more dependent on the insidious form of advertising, it seems like the real money, and shenanigans, might not be in glowing reviews, but brutal takedowns.

An Instagram post by Kevin James Bennett, an Emmy Award-winning makeup artist and cosmetics developer set the beauty influencer community aflame on Tuesday. In it, Bennett describes the “mob-like behavior” of high-profile beauty influencers and the management teams he was in touch with to reviews for beauty products he was releasing under his own name. Bennett claims the influencers offered to trash a competing product in comparison to Bennett’s products in exchange for $75,000 to $85,000. Bennett also called out the all-too-common practice of skirting disclosure requirements and urged the FTC to start issuing fines. theoutline.com

The United States’ top spy catcher said Chinese espionage agencies are using fake LinkedIn accounts to try to recruit Americans with access to government and commercial secrets, and the company should shut them down.

About 70 percent of China’s overall espionage is aimed at the U.S. private sector, rather than the government, said Joshua Skule, the head of the FBI’s intelligence branch. “They are conducting economic espionage at a rate that is unparalleled in our history,” he said. reuters.com

Aurora, CO, Walmart APM Gets 22 months Fed Prison & $830,000 Restitution Order
A 40-year-old Aurora man who worked for Walmart has been sentenced to 22 months in federal prison for wire fraud and money laundering. He also has been ordered to pay $830,000 restitution.

Manning was employed as an asset protection manager and assistant store manager at a local Walmart between 2012 and 2015, according to an indictment in the case. Manning had access to blank checks in his job positions. He fraudulently filled out checks and had others fill out checks in the names of third parties to deceive Walmart employees that the checks were legitimate.

Manning used his management position to access the store’s safe and take cash from deposit bundles, the news release stated. Manning created fake loans to one of the store’s cash registers to conceal that cash was missing from the safe. Manning then placed in those cash registers fraudulent Money Network Checks totaling the same amount as the cash taken so the balance would look correct and other employees would not realize cash had been taken from the safe. denverpost.com

One of the Most Expansive Rare Book Thefts in History
300 Rare Books Worth $8M - A Librarian Archivist & a Book Dealer
John Schulamm, a book dealer and Gregory Priore, a library archivist at Carnegie Library of Pittsburgh. The two carried out the theft over nearly two decades, the authorities said, stealing about 300 books and other artifacts that, in total, would cost more than $8 million to replace.

Their arrests last month sent a shudder across the rare books industry, a multimillion-dollar business in the United States, according to the Antiquarian Booksellers’ Association of America.

In this niche world based on trust, where confidants are currency and handshake deals are commonplace, the arrest of a prominent dealer is a shocking suggestion of deceit.

Mr. Schulman had served on the association’s board of governors and had even led its ethics committee, the organization said. His clients included some of the biggest names in the business. Prominent bookshops from New York to London bought stolen books, an affidavit shows.

“It was an amazing setup that was close to foolproof,” Mr. McDade said, noting that most rare book thieves get caught trying to sell their goods.

In a scheme that dated back to the late 1990s, Mr. Priore told the authorities, he would remove items from the library and drop them off at Mr. Schulman’s bookshop, just a block away, on his way home from work. nytimes.com

New Orleans, LA: Security Guard replaced after complaint of Racial Profiling
A security guard at the Breaux Mart on Magazine Street has been replaced after a confrontation with a black shopper that the shopper says was racially motivated. The unnamed security guard approached Branson Morgan and his two friends on September 1 as the trio were shopping at the popular locally owned grocery store. Morgan outlined what happened next in a Facebook post with an accompanying video showing the security guard closely following him through the store. wgno.com

Employers are slowly turning to ex-offenders to fill open jobs in a worker-hungry economy
As the job market gets tighter, employers are slowly turning to nonprofits such as Rise, Emerge, Building Better Futures, Summit Academy, Genesys Works, Goodwill Easter Seals and others that help former felons build skills and land decent jobs.

“We are safer when these guys have jobs and housing,” said CEO Dan Pfarr of 180 Degrees. “We are their step from prison to the civilian world.” The good news is that the low unemployment rate is prompting employers to warm to hiring former inmates.

It’s been embraced by large employers including Google, Total Wine, the Ford Foundation, the Open Society Foundation, Koch Industries, Walmart and other companies. Locally, Quality Ingredients, Target, Bremer Bank and numerous small businesses are on board.

A groundbreaking report last year by the American Civil Liberties Union (ACLU) provides a road map into the “successes of corporate policies giving formerly incarcerated Americans a fair chance at re-entry.”

And Rise and its national partner, Root & Rebound, which advocates for former inmates, have received great response from local employers for their “Minnesota Employers’ Fair Chance Hiring Guide.”

The guide takes employers through legal compliance and risk minimization, background checks, the rewards of hiring a second-chance worker, best practices for “onboarding” former inmates and strategies for helping them integrate into the workforce. startribune.com

Investigators’ Notes Play Pivotal Role in Cases
A recent case from the British Columbia Human Rights Tribunal provides an example of a complaint that took a turn no one saw coming, and one where the notes could have played a critical role.

In the early stages of an investigation, it's often impossible to say what information is going to be critical to the decision-making process. What seemed at first like an innocuous, offhand comment from a complainant could end up cementing, or tarnishing, his or her credibility once the respondent and witnesses are interviewed.

So what's an investigator to do, in the absence of a crystal ball? Document, document, document. Detailed notes of everything a party says are the best way to ensure you are prepared for any unexpected twist or turn that an investigation may take. Below descriptions are abbreviated.

Best Practices for Note-Taking

Memory is fallible. It's impossible for any of us to remember all the details from our interviews.

Consider your medium. Are you going to take notes on your laptop? By hand? Some people can capture more information by typing. There is no right or wrong answer here. What's important is that you give some thought to how you are best able to capture complete and accurate information.

Remember the basics. Before getting into the substance of the interview, your notes should cover the basics.

The more detail, the better. As the McIntosh case demonstrates, you often don't know what details from your interview are going to end up being important. So, err on the side of capturing everything.

More than words. Good notes cover more than just what the interviewee says. Your notes should include any nonverbal cues the interviewee displays.

Remember follow-up. Rather than leaving an interview and trying to remember what steps you have to take to follow-up, include these steps in your interview notes.

Keep the notes. Don't shred your notes once you've drafted your report. Your notes are a contemporaneous record of your interviews and probably contain details that didn't make it into the final report. shrm.org

The Fight Over California's Privacy Bill Has Only Just Begun
Lobbying groups and trade associations, including several representing the tech industry, immediately started pushing for a litany of deep changes that they say would make the law easier to implement before it goes into effect in January 2020. But privacy advocates worry that pressure from powerful businesses could end up gutting the law completely.

Over the last few weeks, groups like the Chamber of Commerce and the Internet Association, which represents companies like Google and Facebook, have pushed for significant alterations, even as the tech industry works to develop a federal privacy bill that would, if passed, override California's law.

In early August, a coalition of nearly 40 organizations, ranging from the banking industry to the film industry to the tech industry’s leading lobbying groups, sent a 20-page letter to the lawmakers behind SB-1121, effectively a wish list of changes.

For now, all sides at least agree that SB-1121 is effectively a stopgap. The fact that big businesses didn't get their way this time hardly signals a resounding victory for privacy. Next year's legislative session will likely see new bills with even more serious changes proposed by influential industries. "They've got another chance to succeed, and they’ll be back for sure," Baker says. wired.com

Breach Reporting Landscape Becoming Global Minefield

The past year has ushered in big changes to how companies around the world must report data breaches, with jurisdictions from Colorado to Canada establishing new requirements that further complicate an already fragmented global regime.

But while these laws all have the same general purpose, their requirements for disseminating alerts vary greatly, leaving companies that operate globally with the tricky task of figuring out how to navigate nuances in breach reporting triggers, timelines and methods.

U.S. Reporting Requirements Hit All 50 States

"If you track the state laws that have been amended recently, a lot of the talk revolves around the Equifax breach," While the massive Equifax breach wasn't enough to get federal data breach notification and security notification legislation across the finish line.

"The U.S. has a very mature framework around breach notification, as we were first out of the box, and since then breach notification has come to be recognized as an integral part of any comprehensive data protection regime.

The amended Colorado law, which takes effect Sept. 1, is particularly notable for its tight breach reporting window and broad scope, according to attorneys.

With the new law, Colorado joins Florida as the only states to require reporting of a breach to consumers and the state attorney general within 30 days, the shortest time frame currently on the books in the U.S.

"Other states may look at some decisions made by the Colorado Legislature, such as the 30-day notification window and the decision not to exempt companies covered by federal health and banking laws, and those may serve as a tipping point on those issues."

With breach laws now live in all 50 states, along with four U.S. territories, attention is likely to shift again to the federal level, where several attempts to enact not only a national breach reporting standard but also uniform data security rules — which are on the books in 20 states and counting — have fallen short during the past decade.

And it’s probably true. Think of a security key as like a two-factor authentication code that’s sent to your phone — but instead a USB stick in your pocket. Two-factor authentication is stronger than just a username and password, but text message codes can be intercepted and many sites and services don’t yet support the stronger authenticator codes. Security keys are one of the strongest lines of defense against account breaches. That’s because a hacker on the other side of the world trying to break into your account needs not only your password but also your physical key — and that’s not something a hacker can easily or covertly steal.

Although there are a handful of security key brands out there — Yubikey and Feitian to name two — Google thinks it can do better with its own Titan security keys.

Out Thursday, the company’s own branded and in house-developed security keys are now available to buy. One is a USB key, and the other supports Bluetooth and NFC for mobile devices. You need to enroll both keys — one stays in a safe space, and the other stays with you. techcrunch.com

Not all security service providers are created equal
There is no specific “starting point” for using managed security services. Whether it's staffing issues, budget restrictions, end-of-life software or an identified particular risk and the only way of providing at least some of the required security controls is via a service provider.

Security service providers are not all made equal. Security is not a product and organizations should steer clear of service providers offering one or a combination of products.

Instead, focus on those providers with expertise in your particular area – perhaps vertical, and/or company size – that understand your business. Look for providers that deliver integrated managed security services, giving your organization the option to expand its use of managed services if required.

Invariably, service providers will offer a series of certifications to demonstrate their capabilities around security – when choosing a provider, decide which are applicable to your enterprise and have these as table stakes. Additionally, ensure contractual service level agreements (SLAs) are available so your organization receives the service it is expecting.

It is also key to have an agreement about who is responsible for what, and when – for example, how frequently will the service provider undertake scanning and patching, how will your organization be informed, how quickly can a change to a firewall be applied? These are all part of the regular interactions with a managed security services provider.

Regular reporting against SLAs and other metrics on a security scorecard can help customers of security service providers have a level of assurance that requirements are being met. As with any contract, the power lies with the customer before the agreement is signed, so decide what you want up front and stick out for it. computerweekly.com

50% of Data Loss Incidents in 2016 Linked to Printer
How Hackers Hit Printers
A new study cited by Booz Allen Hamilton found that of 61% of survey respondents who reported a data loss incident in 2016, at least 50% had at least one such incident linked to a printer. The 2017 survey by Quocirca included 200 companies with more than 1,000 employees.

The security incidents included digitally intercepted print jobs (50%), loss of data from printer hard disks (48%), mailing of documents via multifunction printers to external sources (44%), and printers getting hacked to gain network access (18%).

Some of the most common types of cyberattacks on printers include disabling printers for ransom and abusing insecure printers for vandalism or vigilantism. darkreading.com

Black Diamond demands Walmart remove gear from website
Premium outdoor brand Black Diamond sent Walmart a cease and desist letter asking to be removed from the retailer's "Premium Outdoor Store curated by Moosejaw," a dedicated page on walmart.com the retailer launched Monday featuring an assortment of outdoor gear. Burlingame, CA: Apple store hit for 4th time amid epidemic of grab & run thefts
Four young thieves went into Burlingame’s Apple store Sunday, snatched up $50,000 worth of iPhones and laptops, and were out the door and running for their getaway car inside of 30 seconds, police said. The late-morning grab-and-go, which netted more than 30 iPhones and about six laptops, was at least the fourth such crime to hit the same store, said Burlingame Police Lt. Robert Boll. The four who hit the Burlingame store Sunday, and the getaway driver, were described as men in their late teens or early 20s, wearing hoodies. abc7news.com

Update: Dallas, TX: One of four Robbers arrested in $60,000 Costco Jewelry Smash & Grab
Police have arrested one of four robbery suspects believed to be behind a July smash-and-grab jewelry heist at the North Dallas Costco. Demarcus Dametreion Coleman, 18, is charged with aggravated robbery in the July 1 hold-up and was arrested last week. Police say Coleman was one of three men who on July 1 entered the Costco store on Churchill Way and went straight for the jewelry counter. "Open it up," said one of the robbers, who was armed with a black handgun and wore a red bandanna, a hoodie and possibly a wig. The employee made a run for it, fearing for her life, so Coleman put his black-and-yellow pickax to use, smashing open the jewelry case, according to his arrest warrant affidavit. He and a third suspect, who remains at large, grabbed almost $60,000 worth of jewelry from the case and threw it all in a small black bag before fleeing the store. dallasnews.com

Gretna, NE: Team of thieves hit Ulta Beauty in Nebraska Crossing Outlet Mall; $700 theft
Store security camera video showed two young couples working together to rob the store at the same time. Over $700 in cosmetics was taken by the couples, including lipstick, rouge, highlighters, perfume and primer. Covington, GA: Officer 'fighting for his life' after he's shot responding to shoplifting report at Georgia Walmart
A Georgia police officer is "fighting for his life" after he was shot while responding to a shoplifting report at a Walmart Monday afternoon, according to local police. When a suspect exited the Walmart in Covington -- about 35 miles east of Atlanta -- and started to flee, officer Matt Cooper ran after him, according to the Georgia Bureau of Investigation (GBI) and the Covington Police Department. The suspect, 21-year-old Aaron Fleming, "ran across the street behind another shopping center where several gunshots were fired," the GBI said in a statement. Cooper, a 34-year-old military veteran who has been with the Covington police for six years, was shot and hospitalized in serious condition, said Covington police spokesman Justin Stott. A second gunshot was then heard, and Fleming was found shot dead, authorities said. "Early information indicates that the wound was self-inflicted," said a statement from the GBI. Kansas City, MO: Teen, man wounded in Shooting inside Sun Fresh Market
Shoppers at a Kansas City grocery store spent Monday in shows after a shooting inside the store injured two people, including a teenager. The shooting happened just after 5 p.m. at the Lipardi Brothers Sun Fresh Market at 31st Street and Prospect Avenue. Two people were shot. Police said the victims are a man and a teen girl. Their injuries were originally reported as life-threatening but both victims have been declared in stable condition. KCTV5 News covered the store's opening earlier in the summer and Monday's violence was exactly what employees and new customers did not want to see. One employee who works at the store told KCTV5 News that a man was pacing in the front of the store when another man walked in with a gun and started shooting. She said both employees and shoppers, were ducking and trying to run to safety. Many people tried to rush children away from the gunfire. kctv5.com

Macon, GA: Teen Shot & Killed inside Chick-fil-A
An 18-year-old was charged with murder Monday in connection with the fatal shooting of another teen at Chick-fil-A on Bloomfield Road in Macon. Bibb County Coroner Leon Jones identified the victim as Leonard Spivey Jr., 18. Sheriff David Davis said there were several males fighting outside the restaurant. An employee happened to open the back door and Spivey ran inside, chased by another man who shot him in front of restaurant workers. The shooter immediately fled the scene. Later in the day Julian Charles Kongquee, 18, of Macon was charged with murder in connection with the shooting. macon.com

Brentwood, CA: Fleeing Shopliftings hit Police Officer with the get-a-way car
A Brentwood Police officer who came to help Home Depot security staff collar a pair of theft suspects Monday was hit and knocked down by the suspects’ vehicle, police said. Police on Monday night were hunting a man and woman in their 30s who were the driver and passenger in the car that struck the officer who was on foot outside the Home Depot store around 12:30 p.m., said Brentwood Police Lt. Walter O’Grodnick. Security officers and police had intended to arrest the pair on suspicion of grand theft, O’Grodnick said. Suspect in Siegel’s Jewelry burglary caught at LAX trying to flee country
Officers from the Santa Cruz Police Department and Los Angeles Police Department assisted the Paso Robles Police Department in arresting 28-year-old Roman Petre in Los Angeles on Friday, Aug. 24. Petre was currently out on bail for another jewelry store burglary in Northern California and was arrested at the Los Angeles Airport (LAX) while trying to flee the country to his native Romania. Petre was arrested on a $1 million warrant stemming from his part in the Siegel’s Jewelry store burglary from March in Paso Robles. pasoroblespress.com

Newark, DE: Serial robbers sentenced for three-state 'reign of terror'
Two men are facing at least 15 years in federal prison for a three-state robbery spree in 2016. Brian Branch and Michael Kolmonen and engaged in a “reign of terror” over several months as they robbed 20 stores in Delaware, Pennsylvania and Maryland, Chief U.S. District Court Judge Leonard P. Stark remarked last week while sentencing them to 16.5 and 15 years, respectively. Robberies in the Newark area included the Walgreens in Harmony Plaza, the Walgreens in Brookside Shopping Center, the Walgreens on Possum Park Road, the CVS in Brookside, the Rite Aid in Omega Shopping Center and the Valero Shore Stop on Old Baltimore Pike. newarkpostonline.com

Update: Las Vegas, NV: Ross Dress for Less Employee Indicted on Attempted Murder charges
A security guard at a Las Vegas retail store was indicted Friday on multiple counts of attempted murder after authorities accused him of firing a gun at his manager and others. The 37-year-old guard, Mohamed Mahmoud, was shot by Las Vegas police during the incident. The indictment charges him with six counts of attempted murder with a deadly weapon, two counts of assault on a protected person with a deadly weapon, four counts of assault with a deadly weapon, one count of burglary while in possession of a firearm, and five counts of discharging a firearm from or within a structure. MetroPolice received calls on Aug. 11 about an active shooter inside Ross Dress for Less. Police said an officer arrived within minutes, and the gunman began shooting outside the store at the police vehicle. Another Metro officer arrived and also took gunfire. He returned five shots, hitting Mahmoud once near his hip. Mahmoud was the only person hurt in the shooting. He was booked in absentia while hospitalized. reviewjournal.com
