Burberry will stop burning unsold apparel
A widespread practice among luxury retailers

When the British luxury label Burberry said this summer that it had burned tens of millions of dollars of unsold goods — an announcement that prompted fierce criticism — the practice was justified as an effort to maintain its “brand value.”

On Thursday, the company said it would cease burning stock immediately. In effect, it was once again seeking to preserve its brand.

The practice, which is widespread across the retail and consumer industry, is often used as a safeguard to prevent unwanted items being stolen or sold at a significant discount and in that way eroding the high-end price tags they can command in stores.

Other luxury labels, including Richemont and Louis Vuitton, have been accused of destroying unsold watches and handbags so they cannot be bought at reduced prices. Even companies like Nike have faced allegations of deliberately damaging unwanted stock. nytimes.com

Louis Vuitton, Prada Targeted by Fake Stores in Chinese Cities
Completely counterfeit stores are hardly novel phenomena in China. A wildly elaborate fake Apple store in Beijing, complete with automated iPhone check-ins and a faux Genius bar, was shut down by local authorities early this year, and for years prior, imitations of Ikea stores and food chains like Subway existing in China’s biggest metropolises. What is relatively new is the spreading of these fake outposts to the mainland’s less densely populated cities in an attempt to fill the void left by Western brands busy occupying China’s bigger cities.

As counterfeit sellers continue to increase the sophistication of their dealings and the offerings, themselves, in the digital domain, these faux physical outposts are simultaneously growing both in size and sophistication. “We often find fake shops like these. However, the size, in this case, was surprisingly big,” the source told Inkstone. “They try to avoid a lawsuit by slightly changing the name, but that’s usually a hopeless strategy in court, so they disappear if they’re found.” thefashionlaw.com

Google and Mastercard Cut a Secret Ad Deal to Track Retail Sales
Google found the perfect way to link online ads to store purchases: credit card data

For the past year, select Google advertisers have had access to a potent new tool to track whether the ads they ran online led to a sale at a physical store in the U.S. That insight came thanks in part to a stockpile of Mastercard transactions that Google paid for.

But the deal, which has not been previously reported, could raise broader privacy concerns about how much consumer data technology companies like Google quietly absorb. bloomberg.com

Bernie Sanders introduces 'Stop BEZOS' bill
U.S. Senator Bernie Sanders on Wednesday introduced a bill that would tax corporations with more than 500 employees for the full amount employees receive in government assistance. The bill's title, "Stop Bad Employers by Zeroing Out Subsidies Act," or "Stop BEZOS," is an open jab at Amazon CEO Jeff Bezos.

Sanders had previously criticized Amazon after a study found that some fulfillment center employees relied on a federal food assistance program. Sanders' criticism drew a heated response from Amazon, which prompted another detailed critique from Sanders' office, one that included testimonials from Amazon employees about working conditions. retaildive.com

Whole Foods Workers Push to Unionize
Parent Amazon has resisted past unionization efforts at its businesses

Some Whole Foods employees want to unionize to address what they say are changes to corporate culture and diminished compensation under the ownership of Amazon.com Inc. A group of workers planned to send an email Thursday to workers at most of the 490 Whole Foods stores urging them to back their unionization drive. The workers said they want to push Whole Foods and Amazon for better compensation, benefits and profit-sharing.

The unionization push presents a potentially high-profile challenge to Amazon, which has opposed past organizing efforts by warehouse workers and other employees that are less visible to customers than grocery-store clerks. wsj.com

'Retail Apocalypse' Debunked - It's actually a Retail Renaissance
According to new research from IHL Group, North American retailers will open 12,663 stores and close 8,828 stores in 2018, for a net increase of 3,835 store locations. The report found that a handful of retailers - 16 companies - represented 66% of the total number of store closings. For restaurants, 16 companies represented 74% of all net closings.

"We can't emphasize enough that the closings have been driven by a handful of retailers, not the entire market," IHL stated.

IHL's Retail's Radical Transformation/Real Opportunities report reviews 1,485 retail chains with 50 or more locations on net store openings and closings. It found that while physical retail is thriving it is also changing drastically.

According to the research, grocery stores, drug stores, mass merchants/supercenters, and convenience stores are adding a net 2,694 stores in 2018. The increase is on top of 3,115 net new stores in 2017.

But department stores, specialty softgoods (apparel, shoes), and specialty hardgoods (DIY, electronics, sporting goods, books, furniture) are closing a net 682 stores in 2018. This follows 2,557 net closings in 2017.

"There has been a great deal of negative press about retail in the last two years," said Greg Buzek, president of IHL Group. "Overall retail is very healthy... But there are vast differences in retail segments with some growing rapidly and others struggling." chainstoreage.com

New Retail Concept - HiO
9 brands come together under one roof in Brooklyn to test new retail shop

More HiO stores are set to open in the U.S. in the future, the co-founders tell CNBC, helping fill a glut of empty real estate. Nine young retailers are coming together under one roof in New York to test a new, smaller-format mall, as the industry experiments with ways to draw in shoppers.

HiO is owned by Direct Brands Group, a business formed in 2017 to serve as an intermediary for international businesses and e-commerce brands that are looking to open bricks-and-mortar locations in North America. The 15-Minute News Cycle
Firing for Online Behavior

The bombs people drop on social media can detonate right away or lurk like hidden land mines. In some cases, someone is terminated from a current job for recent problematic posts.

When an employee posts something offensive, HR professionals are often on the front line of protecting the employer's brand. Hiring managers also may be expected to act as defenders of the company if a candidate's online posts have the potential to reflect poorly on the organization's image.

Attorney Eric Meyer, who blogs about workplace issues, tracks news about employees whose offensive social media comments cause them to lose their jobs. He and other experts believe that this type of termination is becoming increasingly common.

Adding pressure to HR's role is the ubiquity of social media and the speed at which comments can erupt into full-blown crises. "Sometimes, it's not even a 24-hour news cycle anymore-it's a 15-minute one."

But doing nothing may not be a viable option when business leaders are subject to intense pressure to terminate an employee who's behaving badly. Determining how to respond is no easy task. shrm.org

'Ghost' Employees May Be Haunting Your Workplace
People who create ghost employee accounts typically make up more than one fake persona, according to Files. "All fraud begins small and grows over time, like a weed in an untended garden," he said. "A thief looks to steal as much as [he or she] can without being noticed. … Fraud creates an appetite that cannot be satiated."

Having a system of checks and balances is an important theft deterrent, said Mason Wilder, certified fraud examiner and a research specialist at the Association of Certified Fraud Examiners (ACFE) in Austin, Texas. Prior to ACFE. It's easier for ghost employees to exist when a business supports a workforce in remote locations.

To protect themselves, the ACFE suggests employers pay attention to five categories of red flags:

- Employee information anomalies. An employee's Social Security number (SSN) is not listed, or multiple employees have the same SSN; an employee doesn't have any deductions—for taxes or benefits—coming out of the paycheck; or there are multiple address changes within a year or so.

- Payroll-register anomalies for direct deposits. - Multiple bank accounts for one employee's paycheck. - Payroll-check anomalies. Multiple checks are issued to an employee within one pay period

- Employee time-off trends. An employee hasn't taken any paid time off or sick leave for an entire year, or the person processing payroll never takes vacation. Forced vacations or rotation of duties are an effective control, Wilder said. shrm.org

New York Releases Model Anti-Harassment Training
Sexual-harassment prevention policy and training required by all NY employers

New York passed significant new sexual harassment laws earlier this year. Among the new requirements, all employers in New York are required to adopt a sexual-harassment prevention policy to be distributed in writing to employees and conduct annual sexual-harassment training starting on Oct. 9. The statute directed the New York State Department of Labor and the New York State Division of Human Rights to develop both a model sexual-harassment policy and model training program. Employers can then choose whether to adopt the models prepared by the state or develop their own, as long as their policies and training meet or exceed the standards contained in the models. shrm.org

On Aug. 23, the state released the following:

● A new website with resources for employers and employees regarding combating sexual harassment in the workplace.
● A model sexual-harassment prevention policy, which is considered the "minimum standard" requirement for employers to adopt as is or use as a basis to establish their own, more robust policy.
● A model sexual-harassment complaint form.
● A model anti-harassment training.

What's next for data breach legislation?
For Retailers Not This Year
A BREACH OVER DATA BREACH - Amid a years-long standoff between rival industries and committees over federal data breach notification legislation, one House panel is plotting a move to go it alone - at least in the short run. Sometime this month, the House Financial Services panel might consider data breach notification and security legislation that applies only to the banking sector, a GOP committee aide told MC. The panel has been locked in an impasse with the House Energy and Commerce Committee, which has jurisdiction over the retail industry. That panel has typically written legislation more favorable to that sector; retailers have resisted proposals to make it adhere to the same security requirements as the financial services industry. Now, the Financial Services Committee wants to make some headway even if it has to do it by itself, using a modified existing draft bill written by Rep. Blaine Luetkeymeyer as a vehicle, the aide said.

The idea, the aide said, is to advance data security and notification requirements for only financial institutions. Although the bill language isn't finalized, it would first codify security requirements put in place after the Gramm Leach Bliley financial services and consumer privacy law was enacted in 1999. Beyond that, the aide said, the idea is to provide preemption from state law for those institutions that meet the requirements. That doesn't mean, however, that all hope is lost for a complete measure. "We're not backing away," the aide said. "The panel's also aware there's not much time left in the year to get something enacted. But, absent a deal, committee leadership and individual members want to "advance some sort of marker."

GDPR Spurs Interest in Insider Threat Prevention
The EU's General Data Protection Regulation, which has tough breach notification requirements, is spurring global interest in technologies to help prevent insider breaches, says Tony Pepper of Egress Software Technologies.

In an interview at Information Security Media Group's recent New York Security Summit, Pepper discusses:

● Why data breach prevention has become a boardroom issue;
● Real-time breach detection advances;
● Using machine learning and artificial intelligence to detect insider anomalies. govinfosecurity.com

A risk-based approach to security outsourcing
All security controls can be outsourced. In fact, many organizations do exactly this, outsourcing the security operations centre (SOC) and all its preventative and detective controls to security management companies. Or, they outsource antivirus and anti-malware, or intrusion detection and response.

Build a risk register

A useful approach to begin with is to build a risk register, because managing controls that do not align to a risk your business faces is ultimately counterproductive. Even the smallest of SMEs should have a risk register, and there are enough templates online to give you a starter for 10. These should range all the way from minor glitches to major incidents that could destroy the company.

You should also be looking at data leakage prevention services, as fines under the General Data Protection Regulation (GDPR) are much bigger than they were under the Data Protection Act 1998. Can you manage this in-house?

Define security metrics

The large corporations I have worked with have often had hundreds of metrics defined for security, and the outsourcing of a service just required that these metrics were provided by the third party, along with some additional ones indicating the third party's security status. That is obviously going to be difficult for an SME, so an appropriate approach is to look at the metrics available. One should consider, are they:

Configurable - you should be able to define alerting thresholds;

Automatable - to ensure they are provided to you predictably and regularly;

Relevant - they support the security of your organization;

Actionable - if you or the third party cannot do anything about a particular metric, it may not be useful;

Timely - it is much less helpful to learn about an intrusion that happened last year.

Inside Twitter’s Long, Slow Struggle to Police Bad Actors
Twitter CEO Jack Dorsey has personally weighed in on high-profile decisions, frustrating some employees

When Twitter Inc. Chief Executive Jack Dorsey testifies before Congress this week, he’ll likely be asked about an issue that has been hovering over the company: Just who decides whether a user gets kicked off the site?

In policing content on the site and punishing bad actors, Twitter relies primarily on its users to report abuses and has a consistent set of policies so that decisions aren’t made by just one person, its executives say.

In a hearing Wednesday morning before the Senate Intelligence Committee, Mr. Dorsey will appear alongside Facebook Inc. Chief Operating Officer Sheryl Sandberg to discuss how foreign actors can use the social-media platforms to spread misinformation and propaganda. Later in the day, the House Commerce Committee will question Mr. Dorsey individually in a Republican-led look at how Twitter treats conservative voices.

Twitter and rival Facebook are increasingly caught in a Catch-22 situation—criticized by some users for allowing hateful posts, but blasted by others for removing content because it curtails free speech.

Twitter has taken a different approach than Facebook, which has hired thousands of content reviewers in the last couple of years to review posts and built out technology to flag inappropriate content. Twitter has far less staff and typically only investigates harassment and abuse that has been reported by users.

In the coming weeks, the company plans to start showing users a picture of a tombstone in the place of a tweet that has been taken down as a way to signal that a user has violated a company policy, rather than a notice saying the tweet is unavailable. That step, which hasn’t been reported, is among a number of policy changes Twitter plans to make in the coming weeks, according to people familiar with the matter. wsj.com

China’s new e-commerce law positive for IP protection, say lawyers
China’s new e-commerce legislation is a positive development in the country’s fight against IP violations and counterfeit distribution, according to lawyers. Under the legislation, e-commerce platforms such as Alibaba and Pinduoduo will be jointly responsible for counterfeit goods sold by third parties on their sites. The e-commerce platforms must also establish rules to protect IP rights, and failure to act quickly when a violation is reported can lead to a fine of up to RMB2 million ($293,130) in serious circumstances. worldipreview.com

Credit Card Fraud

Perth, Australia: Security loophole sees 'Eftpos bandits' steal nearly $200,000
A group of alleged Electronic Funds Transfer POS, 'Eftpos' bandits are taking advantage of a security loophole in the machines to rip off shops for thousands of dollars with stolen credit cards. At a Camera House in Perth, two women were seen attempting to buy two cameras worth $15,000. Security footage appears to show one of the women checking her phone before slotting a card into the Eftpos machine. She is allegedly stealing the entire purchase from right under the retailer's nose.

"She got her own credit card, she put it into the terminal, but didn't push it all the way through, so it didn't register," shop owner Liddio said. "She cancelled our transaction and went in manually and typed in a stolen credit card number." Across town, the group visited another camera shop, buying three cameras worth $21,000. "The camera stores were roughly $60,000-$70,000, and then from I what I hear from other retail stores and petrol stations it could potentially be upwards of $150,000-$200,000," Liddio said. 9news.com.au

Perception becomes reality slowly on a macro level and it's difficult to change it if it's incorrect or doesn't portray the truth. It's the same reason law enforcement separates witnesses to ensure clarity and truth. The group mind becomes influenced by opinion and agendas and distorts the true reality. One can only rely on daily vigilance based on doing what's right to hopefully impact the individuals one works with on a daily basis to carry the experience forward and be witness to what is right.
