Former Pilot Flying J president sentenced to 12​​​​​​​ years in prison, fined $750K
Mastermind behind retailer's massive rebate fraud scheme

A federal judge on Wednesday ordered former Pilot Flying J President to serve more than 12 years in federal prison as the mastermind of a five-year fraud plot to grow the firm's market share.

Senior U.S. District Judge Curtis Collier also ordered Mark Hazelwood to pay a $750,000 fine in addition to spending 150 months behind bars.

"The motive was hubris - his competitiveness ... his desire to capture more market share for Pilot," Collier said. "The defendant improperly took it upon himself to use the Pilot name and reputation ... This degree of commandeering ... the court is not aware of any reported case where such a situation has happened.

"Mr. Hazelwood abused the trust of Pilot and the trust placed in him," Collier continued. "The participants (in the fraud scheme) laughed and joked about it. They used extreme and offensive language. They used Pilot's email ... cellphones ... financial management system. They talked openly of this criminal activity ... He violated the law on a constant and repeated basis for half a decade."

Collier is allowing Hazelwood to remain free through November while the U.S. Bureau of Prisons determines in what facility he will be housed. He will remain under conditions of house arrest imposed after his conviction in February.

Hazelwood was convicted after a four-month trial of conspiracy to commit wire fraud, wire fraud and witness tampering.

He was the highest-ranking member of Pilot Flying J who was convicted in the plot. Two subordinates were convicted of varying crimes alongside him, and 14 others pleaded guilty. Two were granted immunity. Pilot Flying J’s board also admitted criminal responsibility. knoxnews.com

EEOC Sues Dollar General For Sexual Harassment
Dollar General violated federal law when it subjected a store manager to a sexually hostile work environment, the Equal Employment Opportunity Commission (EEOC) charged in a lawsuit announced Tuesday.

According to the suit, within a week of Dollar General hiring an assistant store manager for its Rock Hall, Md. location, the store manager began sexually harassing her. The store manager frequently made crude comments about the woman’s appearance and made sexually charged innuendoes, according to the suit.

The store manager is also alleged to have repeatedly subjected the assistant manager to unwelcome touching, including once grabbing her head and forcing it to his crotch while making a sexual innuendo, rubbing her shoulders, and grabbing her blouse, ripping it.

The EEOC said that after the assistant manager complained to Dollar General management, they transferred her to its Chestertown store, which added travel and working complications to her daily commute. Dollar General refused to return her to the Rock Hall location.

The assistant manager was, according to the EEOC, compelled to resign in 2016, based on Dollar General’s inadequate response to her sexual harassment complaint. cbslocal.com

Amazon debuts new '4-Star' brick-and-mortar concept in NYC

An Amazon spokeswoman said the store is permanent, not a pop-up location, as some of its shops — including one that sold Calvin Klein merchandise in SoHo last year — have been before.

The new store in SoHo is unlike any shop the e-commerce giant has rolled out before. Amazon currently has a handful of bookstores across the U.S. and is starting to open more of its cashier-less convenience stores known as Amazon Go.

Amazon said customers will find items like a mini skillet, card games and many of the company’s own electronic devices including the Echo Spot and Fire TV Stick, in the new store, called Amazon 4-star. It said it will also include some “Trending Around NYC” items there, which Amazon is able to track on its website.

Amazon said digital price tags in the new store will show how much Prime members are saving, the average star rating and how many ratings a product has received, similar to what shoppers can see on the website today.

Visa President said Friday in a Bloomberg interview that they're rolling out NFC to their forty-two million cards as quickly as possible and that the entire payment industry is working together to drive this to market.

Walmart tried mobile Scan-Bag-Go in 150 stores this year and stopped the pilot after just four months saying "few customers used it". According to CBC News, it was challenging for shoppers to bag, weigh and scan items like produce, causing most to head to traditional checkout counters.

Kroger is also investing in the technology to ease the grocery shopping experience with the expansion of its "Scan, Bag, Go" service that the company said it's bringing to 400 stores this year.

It's going to take time to re-train the public on the usage and flow of the process. With even now some customers are still reluctant to even use self-checkouts. Which everyone knows increases shrink and theft.

With a few retailers even saying that they're seeing as high as 30% shrink numbers with scan-n-go. While this has not been officially reported of documented for public review. Even if it's off by 50% we're still talking 15% shrink numbers. A problem that has to be addressed. Stores and credit-card companies are in an all-out war over fees
Large merchants including Amazon.com Inc., Target Corp. and Home Depot Inc. are pushing for the right to reject some rewards credit cards, which typically carry higher fees for merchants. Not your father's POS: What 2019 will bring to payments and mobility

Study: Robotics Presents Opportunity to Security Industry
Automation is one of the biggest trends associations are facing, and the security industry is no exception. According to a new report from the Security Industry Association (SIA), the demand for robotics is growing fast, with an expected market growth of more than 20 percent over the next five years and more than 40 percent of survey respondents saying they had plans to use robots for security.

There’s a downside to e-commerce’s rapid growth: Online retailers are facing a future with a growing number of data breaches, attacking millions of consumers that will cost them millions of dollars.

These data breaches of large, well-known brands highlight fraud’s shift online and the need for merchants to understand the weak points on their websites and apps, and how to secure them. Update: Oakland, CA: Alameda County Sheriff Confirm 7 Arrests In Connection With Apple Store Robberies; Statewide Sting
Seven people have been arrested in Oakland in connection with robberies around the state, including recent thefts at Apple stores, an Alameda County sheriff's spokesman said. Sgt. A fight between two men inside a Cub Foods in Minneapolis ended with one of them dead in the parking lot and the other in jail, authorities said Wednesday. The clash at the Cub on 26th Avenue S. drew officers to the scene about 11 p.m. Tuesday, where they found one of the men down outside the store, police said. The man was taken to the Medical Center, where he died. Officers quickly located the other man, a longtime felon with a rape conviction and dozens of other convictions on his record, at a home nearby and arrested him. startribune.com

Update: Durham, NC: Police identify man fatally shot outside Circle K
Police have identified the man fatally shot outside a Durham convenience store Tuesday as Colby Aaron Lucas, 29, of Durham. Investigators have interviewed a person of interest in the case but have made no arrests. Officers were alerted at 2:19 p.m. Tuesday about a shooting in the parking lot of the Circle K, at 109 N.C. 54, near the Homestead Market shopping center. They found a man who had been shot. Fort Worth, TX: Walmart Loss Prevention Associate stops pair who tried to snatch Child from cart
A loss prevention officer at a Texas Walmart stopped a possible kidnapping Monday evening, police said.
The employee confronted a man and woman who were trying to take a 4-year-old girl from a shopping cart. Afterward, the pair left the store and drove away in a red SUV. No arrests have been made, as the Fort Worth Police Department continues to investigate. The child is reported to be OK. star-telegram.com

Emeryville, CA: Apple store Grab & Run thieves hit for the 4th time in a month
The Emeryville PD sent a Nixle alert yesterday for another ‘grab & run’ robbery at the Bay Street Emeryville Apple Store. This was at least the fourth incident of this type in a one month span. Today at about 12:23PM, a group of 6-8 subjects committed a grab and run theft at the Apple Store in Emeryville. The suspects fled with an unknown amount of Apple products. The investigation is ongoing. On August 25th, a resident reported being witness to one of these incidents on Nextdoor.com. Since then, there have been similar incidents reported on September 4th & 12th. Phone carriers like T-Mobile and AT&T have also reportedly been targets of these type of thefts. evilleeye.com

Hollywood, CA: 2 Men Shoot C-Store Clerk with BB Gun while trying to Steal Beer
A clerk at a Hollywood convenience store was punched, kicked and shot several times with an air gun after confronting three individuals who were attempting to steal beer Wednesday evening, police said. The violent ordeal unfolded after two women came into the store at the Arco gas station just after 5 p.m. The footage shows one of the women leave with a case of beer without paying, and the clerk goes out to confront her.

After the pair exchanged words, the women returned with others. The employee tries to keep them from entering the store, but the group overpowers him. The video shows one of the women ripping off the worker's shirt as she attempts to pull him to the ground, while a man stands outside the door and appears to be mocking him. Another man then emerges from behind with a weapon in his hand, takes aim at the clerk and shoots. Police believe it wasn't a firearm but a BB gun. ktla.com

A South Bend Police officer is on paid leave after being accused of stealing by loss prevention staff at a local retail store. The officer, who is not being named by the department, was stopped yesterday, according to a news release. southbendtribune.com

Indiana Supreme Court Cell Phone Ruling Reopens Indiana Robbery Case
Marcus Zanders is serving a 61-year sentence for a string of liquor-store robberies in Dearborn County in 2015. Police cracked the case by getting cellphone records from Sprint which showed Zanders' phone in the vicinity of two package stores right around the time they were robbed. The Supreme Court ruled that since police were collecting evidence from a third party, not from Zanders himself, that no warrant was needed. wibc.com

Marrero, LA: Accused Walmart Halloween aisle arsonist arrested
The Jefferson Parish Sheriff's Office says it has arrested a suspect in a recent arson investigation. The crime happened on Wednesday, September 19, at the Walmart store in Marrero. Deputies say a man entered the store at about 8:40 that morning and wandered the aisles aimlessly for about 30 minutes. Then they say he started a fire in the seasonal section of the store which was full of Halloween merchandize. wgno.com

A former Cameron County Precinct 4 constable arrested a week ago is accused of stealing $860 worth of merchandise while working as a security guard for Walmart. The Brownsville Police Department arrested Jerry Xagoraris and charged him with official oppression and theft. Every executive has an agenda out of absolute necessity and in the normal course of doing business. Agendas, in essence, drive performance and results. However, it's the hidden agendas that one must be on the look out for because those are the ones that do the most damage to executives and companies.
