ACLU targets ICE after Amazon pitched facial-recognition technology
Amazon has found itself in a new controversy over its facial-recognition software. The American Civil Liberties Union (ACLU) on Wednesday filed a Freedom of Information Act request with the Department of Homeland Security (DHS) demanding the U.S. Immigration and Customs Enforcement (ICE) disclose whether it uses Amazon’s software.

The civil liberties advocacy group's request comes after reports that Amazon attempted to sell its “Rekognition” software to ICE and Homeland Security. foxbusiness.com

Amazon Opens First San Francisco Store
Facing Off With Other Cashierless Concepts in the Bay
Its fifth location overall for the concept, and already is working on launching a second store in the city, due to open this winter, the company said on its website.

The e-commerce giant also is planning another store in Chicago, its second spot in that city, which the company plans to open in 2019, according to Amazon. Separately, Recode reported that the e-commerce company also is developing an Amazon Go location in New York City, inside the Brookfield Place office building near the World Trade Center site.

However, the San Francisco opening potentially could be the most interesting one yet for Amazon Go, as it commences something of a competitive face-off with other cashierless or automated checkout/mobile checkout concepts from the likes of Standard Cognition, Zippin and Inoyko, all of which are technology companies that have opened their own pilot stores in the Bay Area.

Amazon's rapid expansion and reportedly grand plans for Amazon Go's proliferation in the coming years may overshadow what this band of startups is doing with the automated checkout concept. But perhaps seeing different technologies with the same goals operating in close proximity to one another will highlight key differences between the approaches, as well as how customers feel about each of them in their early stages. retaildive.com

Intellectual Property - An Asset That Most Minimize & Don't Appreciate the Value
"Don't Give Away the Store: Protecting retail with design patents"
One of the most important things for a retailer to protect from copying is its retail environment, its familiarity. The thing that makes customers feel they're in an Apple store, a Burberry store, a Best Buy, or a Home Depot - even if there was no sign on the door. A retailer's unique style and familiarity can build comfort and trust with its customers. At least, until the competition copies this style, and it no longer feels unique.

Many retailers may feel that nothing in the intellectual property toolkit is perfectly suited to combat this copying. Trade dress, a form of trademark protection for three-dimensional articles, may be the most commonly used tool. But it can be difficult to establish both a protectable right - by showing that consumers identify the look of the store itself with a single source - and infringement of that right - by showing that the look of the copycat store is likely to cause confusion. Copyright is available for some architectural designs, but it also falls short because it otherwise does not cover the design of useful articles per se.

Fortunately, patents are available to protect retail environments. Not only can patents protect retail interiors (and exteriors) on the whole, they can also protect individual fixtures, architectural features, and any other physical article that contributes to the overall style of a retail environment.

Is your store's style influenced by the unique design of a display unit, a table, a light fixture, a floor tile? Then patent it! If a competitor copies it, you can assert your patent, even if they don't use it to create an entire confusingly similar store. chainstoreage.com

Editor's Note: Using a successful business model as an example to build or create a business is a common technique and has been widely practiced in every sector. But there's a line you can't cross. Similar to controlling LP manuals and email list. Things that define your program or simple lists that in a competitors hands enables them to profit or cause damage or harm to your business. The problem is that our organizations are not great places to hang out in! Recent research proves it:

● The Workplace Bullying Institute's 2017 survey found that 19% of Americans have suffered abusive conduct at work. Another 19% have directly witnessed it. 63% are aware that workplace bullying happens.

● Christine Porath found that 98% of workers surveyed in the past 20 years have experienced incivility in the workplace.

● TinyPulse found that 77% of employees do not feel strongly valued at work.

● And trust across our society is at an all-time low. The 2018 Edelman Trust Barometer found that trust among the US general population fell nine points to 43 on a 100-point scale, the largest drop in the history of the survey's history. Trust among the informed US public plunged 23 points to 45, making it the lowest of the 28 markets surveyed.

These all contribute to the poor quality of our workplace cultures.

FAA bill to impact security industry
Bill sets policies for not just drones but security technology as well
President Trump signed into law on Oct. 5, H.R. 302, the FAA Reauthorization Act of 2018, a bill that provides a roadmap for FAA-related policies, programs and procedures that will impact the security industry in a number of ways, from the use of counter-drone measures to the expanded use of CCTV and biometric technology within airports.

Included in the new law is the Preventing Emerging Threats Act, which was a 2018 policy priority for the Security Industry Association, according to Joseph Hoellerer, government relations manager for SIA.

“It presents an opportunity for our members who specialize in the counter-UAS [unmanned aircraft systems] space to work with DHS and DOJ, hopefully getting their technology procured by those two governmental entities,” said Hoellerer. Retailers missing the mark with BOPIS, shipping
Inconsistencies in operational processes are killing the customer experience. This was according to a new study by strategic retail advisory firm HRC Retail Advisory (HRC), which revealed that 100% of companies offering omnichannel services are experiencing operational challenges. Specifically, retailers are experiencing execution issues that have caused customer frustration and increased cost to the retailers.

Buy online, pick up in-store (BOPIS) is a major source of retailers’ headaches. Companies describe the initiative as consistently unreliable, as systems often tell shoppers that an item is available in a specific store, yet the store does not actually have it in stock. New Sekura research unveiled at LPRC

Sekura Global is pleased to unveil results from the first phase of our research with the LPRC. The research formed part of the Product Protection Working Group, focusing on Sekura’s award-winning SlideTag and Self-Retracting BoxGrip, and was first made available at the recent LPRC Impact Conference in Florida.

Phase one of the study involved interviewing former-offenders to determine how they perceived the SlideTag and Self-Retracting BoxGrip technologies, whether they understood the tags, and whether they would be deterred from attempting theft of merchandise protected with these tags. In this way, the report establishes whether offenders might “See it – Get it – Fear it” in each case.

The key findings from the study are as follows:

Self-Retracting BoxGrip

● 75% of Offenders surveyed had never encountered the BoxGrip before
● 100% of Offenders noticed the BoxGrip (See It)
● 100% identified the tag as a deterrent (Get It)
● Average deterrence of 5.9 out of 7, meaning “Somewhat Strongly/Strong Deterred” (Fear It)

● 100% of Offenders surveyed had never encountered the SlideTag before
● 100% of Offenders noticed the SlideTag (See It)
● 88% identified the tag as a deterrent (Get It)
● Average deterrence of 5.1 out of 7, meaning “Somewhat Strongly/Strong Deterred” (Fear It)

Interviews of offenders were undertaken in-person at the LPRC Innovation Lab in Gainesville Florida, and the report was conduct by Mike Giblin and Dr Read Hayes (of the LPRC). In the second phase of the research, customer and store associate data will be collected in a retail lab environment and will be made available in 2019.

Organized Crime Report Shares Insights on GDPR, Skimming, Counterfeiting
The 2018 Internet Organised Crime Threat Assessment (IOCTA), by the European Union policing agency Europol, reports that ransomware remains the key malware threat.

The 72-page report suggests that the new GDPR (General Data Protection Regulation) and the lesser-known Network and Information Security (NIS) directive, also relating to data breaches, will likely lead to greater reporting of breaches to law enforcement and increasing cases of cyber-extortion.

As for payment fraud, the report warns that the threat from skimming continues and shall do as long as payment cards with magnetic stripes continue to be used. The abuse of PoS terminals is taking on new forms: from manipulation of devices to the fraudulent acquisition of new terminals.

And as for online markets of cybercrime toolkits or fake documents or banknotes, even firearms and explosives, Europol sees more, smaller vendor shops; and secondary markets catering to specific language groups or nationalities. Most illicit trade however still occurs on the surface web. The nature of the counterfeit commodity is reflected in which market it is sold. Counterfeit goods such as clothing, pharmaceuticals, electronics, or jewellery, sold wittingly or unwittingly, will typically be found on the surface web where they can reach the maximum customer base. professionalsecurity.co.uk

ISACA Issues New Resources for Auditors to Assess & Maintain GDPR Compliance
The 25 May 2018 enactment of the General Data Protection Regulation (GDPR), a European Union regulation, thrust many auditors into positions of even greater responsibility: serving as critical resources in complying with the new rules governing the use and manipulation of personal data.

Months after implementation, many auditors are still navigating these changes and working to ensure their audit programs address all the new requirements of GDPR. To meet their needs and provide guidance and best practices, ISACA, in partnership with ACL, has released a new complimentary white paper, How to Audit GDPR.

Exploring six of GDPR's principles-lawfulness, fairness and transparency; purpose limitations; data minimization; accuracy; storage limitations; and integrity and confidentiality-How to Audit GDPR identifies where GDPR can be considered within an enterprise's strategic audit plan. Biometrics Institute develops action plan to promote ethical use of biometrics
Biometrics Institute reports that more than 270 members and stakeholders met last week during the Biometrics Congress and related events to agree on an action plan to promote the responsible and ethical use of biometrics.

According to the announcement, it was agreed to develop additional good practice papers focusing on questions of presentation attack detection and the use of facial biometrics to be used to provide education and training to the biometric community. The Biometrics Institute notes it is “well-placed to provide thought-leadership and guidance on important questions including how to balance security, convenience and privacy, how to harness biometric technology to create social enablement, how to manage identity in the uncontrolled digital space and how to manage identities along the travel continuum”.

NEC features facial recognition-based retail concepts at Futurecom
At last week’s Futurecom 2018 event in Brazil, NEC demonstrated how innovative the customer experience in a smart business can be with the use of facial biometrics. In a space set up as a smart cafe, NEC deployed its G5100 POS terminal so visitors to the fair could make financial transactions and simulate the purchase of typical products this type of business carries using a modern POS system. E-Commerce in Greater Jeopardy With Soaring Numbers of Stolen Card Data
An almost tripling of the number of false retailer websites designed to phish for customer credentials and black-market listed stolen goods for resale are some findings in a new report.

Riskified and IntSights Cyber Intelligence released “The Retail and eCommerce Threat Landscape Report,” which studied how the growth in online shopping, combined with the explosion of compromised financial data available, made the retail and e-commerce industries one of the most targeted sectors in the darknet.

The joint report, which analyzed data from third quarter 2017 to third quarter 2018, addressed the scope and severity of the current threat and fraud landscape for retailers from selling credit card data and personal information from data breaches to sharing commonly used tools and schemes.

The report found some key trends:

● A 297% rise in the number of false retailer websites designed to “phish” for customer credentials. In the third quarter alone, there was an average of 23 phishing sites per company, a significant increase from 2017.
● A 278% rise in stolen goods listed on black markets for resale.
● An average of 22.1 internal login pages or development servers exposed per retail company in 2018.
● Fake apps and social media profiles on the rise with a 469% spike in suspicious applications and a 345% increase in fake social media profiles (respectively) in the fourth quarter of 2017. cutimes.com

Security ranks as number one eCommerce priority for US SMBs
More than half (54%) of US online small to medium-sized businesses worry that the move to frictionless payments, such as transactions that take place behind the scenes in apps, is leaving them more open to fraud and will negatively impact revenues according to a new report from Paysafe. This concern is heightened by the fact that 76% feel they are being more aggressively targeted by fraudsters now compared to a year ago and 54% consider card fraud an increasing challenge.

These concerns mean US SMBs now view security as the most important factor when considering their eCommerce setup. Security (59%) ranks above reliability (45%), cost (49%) and ease of transactions including refunds (45%). US SMBs are also wary that these concerns may hamper the buyer journey for consumers. Four in five (80%) believe that longer verification processes during the payment stage – which could potentially combat these issues – runs the risk of losing consumers. Yet, 75% – a global high – admit they don't know how to balance security with an acceptable customer experience, a global high amongst respondents, highlighting the trade-off faced by US online merchants. prnewswire.com

ICE emphasizes social media in fight against counterfeiting
Law-enforcement agencies across the U.S. government and anti-counterfeiting organizations from academia and industry gathered today to discuss how social media can be effectively used to protect intellectual property rights and combat the flow of counterfeit goods that threaten the health and safety of American consumers, negatively impact the nation’s economy and fund criminal organizations involved in violent crimes.

North California ORC Association (NCORCA) Welcomes 300 Retail & Law Enforcement Attendees to 5th Annual Symposium
The Northern California Organized Retail Crime Association (NCORCA) just hosted their 5th annual symposium in Roseville, Ca. with nearly 300 attendees. The symposium included presentations from the Department of Homeland Security, Walmart, The Placer County DA's office and the Roseville Police Department.

Chesterfield, MO: Suspects stage wheelchair accident to steal from Sam's Club
Police are searching for three suspects who used a wheelchair as a distraction to steal from the Sam’s Club in Chesterfield. Authorities say the theft happened Saturday afternoon around 3:00 p.m. and was caught on surveillance video. The video shows one man pushing another in a wheelchair. As the wheelchair approached the door, the man sitting in the wheelchair fell to the floor. Police do not believe the man requires a wheelchair to get around. When nearby shoppers turned to see what happened, a man wearing a ball cap and dark shirt walked out of the store with a cart of stolen merchandise. kmov.com

According to police, McGrath stole multiple items from Home Depot with the intention of then selling the stolen items. When police stopped McGrath, he was in possession of a stolen Georgia driver’s license. McGrath is charged with felony fencing of a retail property, felony theft by shoplifting, felony theft by receiving, felony identity fraud, felony possession of a controlled substance, and driving with a suspended license. coosavalleynews.com

Manatee County, FL: Deputies will be giving shoplifters a free "sleigh ride" to jail this holiday season
The department put out traffic signs near shopping centers across the county warning everyone ahead of the holiday shopping season. Posters also going up in many retail stores warning shoplifters. Spokesperson for the Sheriff's Office, Randy Warren, says between now and the end of the holiday shopping season sheriff deputies will be out keeping a close eye on those breaking the law. "Beware we have deputies in and around the shopping centers outside uniformed but then inside the stores we have deputies in plain clothes, undercover. You never know who may be shopping in the aisle next to you and they're going to be watching", says Warren. Jeffersontown, KY: Multiple people shot, 2 killed in Kroger grocery store; suspect arrested
Police have identified the suspect accused of killing two people at a Kroger location near Louisville. Gregory Alan Bush, 51, is charged with two counts of murder and multiple counts of wanton endangerment. According to his arrest citation, Bush went into the back of the Kroger on Taylorsville Road Wednesday and shot a man in the back of the head. The report says he continued shooting the man after the victim was on the ground. Police said Bush then walked to the parking lot and shot a woman several times. She died at the scene. Bush then exchanged gunfire with an "armed citizen" before leaving the scene. He was later arrested nearby. The arrest citation doesn't point to a motive for the shooting. On Wednesday, police said both killings may have been the result of a random attack. Bush will be arraigned Friday morning. wkyt.com

Chamblee, GA: CVS Armed Robber hit by Police Car
Chamblee Police say they arrested a man just a few seconds after he allegedly committed armed robbery. On the night of Oct. 22, police responded to reports of a robbery at the CVS on Peachtree Boulevard. They quickly spotted 24-year-old Rodney Garvin, who fled after being ordered to stop. An officer gave chase on foot, while another who was driving bumped into him with his police car, officials said. Garvin was arrested. Police found a Glock .45 caliber handgun, ski mask and stolen cash in his possession. fox5atlanta.com

Reno, NV: Shoplifter pulls Taser on Sportsman’s Warehouse Loss Prevention, arrested for robbery
A man suspected of shoplifting from the Sportsman’s Warehouse in Reno pulled a Taser on security guards before running from the store. Kyle Brandon Bouteiller, 28, was booked on suspicion of robbery, possession of heroin and possession of drug paraphernalia. Police found him behind a Taco Bell on the other side of Moana Lane. Pinjarra, Australia: Retail theft a 'constant challenge' for Mandurah district police; more than 200 stealing offences went before court last month
Data collated by the Mandurah Mail shows a total of 2081 charges were heard at the Mandurah Magistrates Court in September. There were 211 stealing charges, not including possessing stolen property (48) and stealing as a servant (8). Since 2011, Mandurah's reported stealing offences have been more than Rockingham, Joondalup and Bunbury, except for 16/17, when Rockingham surpassed Mandurah for the year, according to WA Police data. mandurahmail.com.au
