Back before actual POS systems replaced simple cash registers, and before any exception reporting (remember looking through miles of detail tape looking for a transaction?  For you younger people – it was similar to buying one item at CVS).

A time before CCTV was widely in use – and definitely not in full HD color! (OK, I know some of you are still there. I see the “Google Earth shots of Bigfoot” on the news asking the public to identify your suspects.)  Before we figured out how to use the cameras we had to identify inefficiencies that were costing us millions, instead of just thieves that were costing us thousands.

'Biggest-Ever' UK Campaign Calls On Businesses To Step Up Holiday Security
Counter Terrorism Policing Partners With Retail Giant Marks & Spencer
This campaign aims to encourage the public to remain vigilant, look out for suspicious behaviour and inform people how to report their concerns, providing a ‘whole society’ approach where police, security staff, retail workers and the public come together to minimise the chance of attacks and mitigate the impact they can have.

That is what the ‘Step Change’ initiative – which aims to bring the public and private sectors together to collaborate on security matters – is all about, meaning retailers and other businesses operating in crowded places are also being asked to play their part in countering the terrorist threat.

Businesses can do this in two ways, the first being to sign up to ACT Awareness, the innovative online training scheme designed to help industry better understand, and mitigate against, current terrorist methodology.

Developed in a ground-breaking partnership between Counter Terrorism Policing and retail giant Marks & Spencer, it covers how to spot the signs of suspicious behaviour and what to do if an attack should take place.

Why skimming operations are difficult to topple
Flood of credit card skimmers results in few arrests
Austin police records show that investigators found more than 100 skimmers throughout the city during a 12-month period from April 2017 through April 2018, but Austin police financial crimes Det. Mike Morgovnik said skimmer arrests are rare. Morgovnik said Austin police have made inroads in arresting people with cloned cards but climbing the ladder to find others involved in stealing card information has also been a problem.

“It’s complicated because the criminals doing this are very compartmentalized to where different parts of the organization don’t know each other, so they can’t provide information to help officers climb up the food chain,” he said.

Loeffler said investigators who have spent time digging into skimmers and arrested the people they believe are responsible have learned that in nearly every case, they are tied to larger criminal groups, and that Florida and Texas seem to be primary targets.

Editor's Note: Reporting on this extensively over the past five years, especially after the EMV roll-out, and knowing there'd be an increase, and what we've seen is the heavy Eastern Europe/Russian influence, including the gypsies, and a couple of Cuban gangs. But only a few.

Predominately the Russian fraudsters that had been focused on retailers, to the extent of actually sitting in the store parking lots intercepting credit card numbers real-time from transactions happening within fifty yards, almost immediately switched to skimming operations with mules using the numbers in other cities within minutes of acquiring the numbers.

These gangs are well organized and with worldwide operations. With this year's Interpol arrests that took place in multiple countries simultaneously arresting over twenty suspects for millions in skimmed cash and illegally purchased merchandise.

This was so prevalent that for a time the Daily created a sub-column for skimming until we found it was never ending and really didn't impact mainstream retail. So now we only report on the large cases.

Atlanta Business Owner Pleads Guilty In $5.7 Million Rite Aid Vendor Kick-Back Scheme
Larry D. Nuckols, age 69, of Valdosta, Georgia, co-owner of Nuvision, Inc., an Atlanta, Georgia based company, pleaded guilty today before United States District Court Judge John E. Jones, III, to vendor kick-back charges that defrauded Rite Aid, Inc. out of $5.7 million.

The Information alleged that Nuckols engaged in a kick-back scheme with James W. Pilsner, age 60, of Harrisburg, Pennsylvania, a former Vice President for Advertising for Rite Aid, and Vance Taylor, age 71, of Acworth, Georgia, co-owner of Nuvision, Inc., between 1995 and August 2017. 

Nuckols and Taylor entered into an agreement with Pilsner whereby Pilsner would approve Nuvision’s invoices, some of which were false and inflated, for payment. In exchange, Nuckols and Taylor would “kick-back” a significant portion of Rite Aid’s payments to Pilsner. 

Between 2001 and August of 2017, Rite Aid paid Nuvision approximately $45.3 million dollars. Pilsner received no less than $5,124,862 in kick-backs over that time period, with another $634,300 paid to other Rite Aid employees designated by Pilsner, bringing the total loss to Rite Aid to $5,759,162.

Nuckols tendered restitution to Rite Aid in the amount of $1,919,720 at the time he entered his guilty plea. Nuckols also agreed to forfeit a $1.3 million yacht seized by the government and his interests in nine parcels of real estate located in Florida, Georgia, Alabama, and Costa Rico to the government.

James Pilsner pleaded guilty to wire fraud and tax evasion charges on October 1, 2018. Vance Taylor was indicted on 40 counts of mail fraud, wire fraud, and money laundering on September 19, 2018. His indictment seeks the forfeiture of $1,239,058 in U.S. Currency, eight cash/investment accounts, 73 tracts of real estate in Georgia, Florida and Alabama, and Taylor’s half interest in the $1.3 million yacht. justice.gov

Fort Worth, TX Department Stores Arson Gets 10 Years in Federal Prison
Fort Worth Man was sentenced today to 10 years in prison for the May 2018 Hulen Mall arson. In July, Craig Michael Tezeno, 46, of Fort Worth, Texas, pleaded guilty to igniting several Molotov cocktails inside two department stores in Fort Worth’s Hulen Mall.

Tezeno admits he lit a rag stuffed into a glass bottle filled with gasoline and placed it on the floor of Dillard’s department store on May 11. Later that same day, he lit a similar device inside a Sears. He returned to the same Sears a week later and ignited a third device, hoping to start a fire and damage the store. justice.gov

QuikTrip Adding Armed Security Employees to Select Stores
Specifically, the Tulsa-based convenience store chain is looking for applicants with backgrounds as certified peace officers, veterans or armed security guards, reported Tulsa World. The job description for the role describes its purpose as to "deter illegal activity, theft and vandalism," as well as protecting employees, customers, visitors and the company's property, alongside standard daily duties of a store employee. Starting pay for the role is approximately $32 per hour. csnews.com

Jacksonville, NC: Jacksonville Mall Prepares for Black Friday Shoppers After Hurricane Florence
The Jacksonville Mall Marketing Director says the store owners and managers are working hard to be back up and running for Black Friday 36 stores, kiosks, restaurants are reopening after Florence, out of the 60 that were there before Two big anchor stores, Belk and Barnes & Noble, that bring heavy traffic to the mall will open after Black Friday. spectrumlocalnews.com

A California federal judge said Monday he would rethink a July decision tossing claims by a certified class of 29,000 Big Lots workers seeking wages for off-clock times locking stores, saying there may be a triable dispute about whether some employees worked more than short, de-minimis off-clock periods. law360.com

Just days before Amazon announced the big winners of its HQ2 sweepstakes, CEO Jeff Bezos had to address a separate but related concern among employees: Where is all this headed?

At an all-hands meeting last Thursday in Seattle, an employee asked Bezos about Amazon's future. Specifically, the questioner wanted to know what lessons Bezos has learned from the recent bankruptcies of Sears and other big retailers.

"Amazon is not too big to fail," Bezos said, in a recording of the meeting that CNBC has heard. "In fact, I predict one day Amazon will fail. Amazon will go bankrupt. If you look at large companies, their lifespans tend to be 30-plus years, not a hundred-plus years."

The key to prolonging that demise, Bezos continued, is for the company to "obsess over customers" and to avoid looking inward, worrying about itself.

In an earlier all-hands meeting in March, Bezos was asked whether tech companies like Amazon need to be more closely regulated because of their sizable market power and influence.

"It's a fact that we're a large company," Bezos said, according to a recording. "It's reasonable for large institutions of any kind, whether it be companies or governments, to be scrutinized."

Several Amazon employees, who agreed to speak with CNBC on condition that they not be named because they're not authorized to talk about the issue, said that government regulation and the potential for antitrust violations are big concerns among staffers as they look at the company's future. cnbc.com

Each Kick In $10M - Creates TRU Severance Fund

The private-equity firms that owned Toys “R” Us Inc. before its collapse into bankruptcy have rolled out a severance fund for the thousands of workers left jobless as a result of the retailer’s liquidation in the U.S.

The severance fund is an unusual move by the private-equity firms. The fund isn’t required under bankruptcy law and has no ties to the chapter 11 process itself.

Soon after Toys “R” Us announced it was shuttering its U.S. business in March, employees banded together to fight for severance payments and initially took aim at the company’s private-equity backers.

KKR, Bain and real-estate investment trust Vornado Realty Trust VNO -0.80% acquired Toys “R” Us in a 2005 leveraged buyout for $6.6 billion, which included $5.3 billion in debt. When the retailer sought bankruptcy protection more than a year ago, much of its debt load stemmed from the buyout.

The unemployed Toys “R” Us workers trekked to Washington, D.C., protested in New York and lobbied in front of the firms’ investors. Nineteen members of Congress sent a letter to the firms, questioning their role in the retailer’s troubles. In September, the firms and the ex-Toys “R” Us employees agreed to the terms of a deal.

As part of the fund, the eligibility and payment amounts will be based on four factors. Ex-employees must have worked at the retailer for at least one year, they can’t have more than $110,000 or less than $5,000 in annual income, and they must have met the termination and employment guidelines in the Toys “R” Us plan.

The claims process is expected to happen on Dec. 15, and distributions will be made shortly after. The aim is to complete the payouts by April 30, 2019.

Convincing CEOs to Make Harassment Prevention a Priority
It has been a year since the #MeToo movement went viral. Since then, the Equal Employment Opportunity Commission (EEOC) has experienced a 13.6% increase in the number of sexual harassment charges it has received. The EEOC's counterpart state agencies have seen even greater increases. While some business leaders have seized this moment to make important changes in how they address harassment in their workplaces, others do not yet see the urgency in addressing the problem.

In June 2016, the EEOC issued a first-of-its-kind report on harassment in the workplace. The suggestions and tips in that report still stand, but the past year has shown us just how difficult it is for HR directors, general counsel, compliance officers and D&I directors to make the business case for harassment prevention to their leadership. Many of the people in these roles know—as we do—that stopping and preventing workplace harassment is not only a moral imperative, it is also sound corporate strategy. shrm.org

Over 30K Retail Job Cuts & 1,127 Stores Closures Due to Bankruptcy in 2018
So far this year, employers have announced 33,530 job cuts due to bankruptcy, 30,212 of which were announced by retailers, according to a report by global outplacement and executive coaching firm Challenger, Gray & & Christmas. That’s compared to 4,970 bankruptcy-related job cuts last year. The largest announcement this year came from Toys “R” Us, which in March eliminated 30,000 jobs when it filed for bankruptcy and ceased operations. Challenger has tracked 1,127 store closures due specifically to bankruptcy in 2018. This is in addition to the 4,156 retail store closures due to bankruptcy announced through all of 2017. chainstoreage.com

Lowe's Closing Mexico Operations
Previously Lowe’s said it will shutter its 90-store Orchard Supply unit and close 20 under-performing stores in the U.S. and 31 locations in Canada, including 27 under-performing stores there. 

The retailer’s 27.9% slide in net income is “a poor result that shows that Lowe's is going backward at a time when the market as a whole is advancing strongly."

Lowe’s is grappling with "continued challenges with inventory out of stocks, poor reset execution, and assortment concerns in certain categories" that "pressured our ability to turn those visits into transactions," according to a statement from CEO Marvin Ellison, who took over the role in July.

Saunders said deeper issues like the lackluster omnichannel services, which need to improve in order to support the growing e-commerce sector, as well as its relatively poor ”brand image and status in the marketplace” played roles in the company's results. retaildive.com

Kroger names Cincinnati the first location for robot-operated Ocado warehouse
Expected to build 20 total robotically operated warehouses

Grocery giant Kroger announced Monday that Monroe, Ohio, a suburb outside of Cincinnati, will be the home of its first Ocado customer fulfillment center. Last May, Kroger struck a deal with British online grocer Ocado to bolster its delivery business with the construction of about 20 robotically operated warehouses, as it continues to battle Amazon. Kroger is based out of Cincinnati.

Kroger is investing $55 million to build this first location, which is set to measure 335,000 square feet and generate more than 400 new jobs. These "sheds" typically take about two years to open. cnbc.com


 

Tasmania, Australia: New Bid to cut Cost of Shoplifting Scourge
Tasmanians may have to undergo mandatory bag checks in retail stores across the state under newly proposed legislation aimed at curbing theft. The legislation, which was announced Saturday, would allow employers at any store to physically inspect customers' bags as they exit a store. Under current legislation, only employed security guards stationed at the front of stores have the authority to check bags.

"Consumer Data Protection Act" Introduced by Senator Ron Wyden (D-OR)
Senator Ron Wyden (D-OR) introduced internet privacy legislation modeled after the European Union’s recently enacted General Data Protection Regulation (GDPR). The bill will get more attention in the next Congress but the proposal indicates the direction the U.S. House may take on the issue. While internet data privacy regulations have been long-debated, the ongoing public concern regarding the manipulation of consumer data and the effect social media networks have had on political dialogue makes regulatory action in this space more likely than ever. senate.gov

Employees Are Key to Curbing Data-Breach Risks
Since workers are reportedly the top source of security incidents, employee engagement is essential in combatting data breaches, said Danielle Vanderzanden, an attorney with Ogletree Deakins in Boston.

Employees need to know how to recognize threats and should feel comfortable reporting any incidents to head off a breach or trigger a notification mandate.

Philip Gordon, an attorney with Littler in Denver, recommended that employers take the following steps to establish a culture of data-security awareness and compliance:

Conduct thorough pre-employment screening to avoid hiring individuals who pose a risk to personal information.

● Require employees to
sign confidentiality agreements to reinforce the importance of protecting information.

● Provide
periodic information-security training to new hires and current employees, focusing on identifying phishing scams and protecting portable devices.

● Limit access to personal information to those employees who need the information to perform their job.

● Develop information-security
policies designed for line employees, not just IT.

The Role of Risk and Compliance in Cloud Decisions
With cloud established as a business tool that is increasingly used by organizations to bring new products and services to market and help improve customer experiences, risk and compliance teams have an opportunity to redefine their roles with respect to cloud decisions and partner with the business. Part of any sound cloud strategy is identifying roles and responsibilities.

Mistaking Current Implementations and Processes as Requirements
Often requirements are used to dictate which process or vendor solutions are put in place in the cloud. Many requirement documents spell out exactly how network segmentation should be implemented in the cloud. This approach can create inefficiencies and be detrimental to the cloud’s architecture.

Applying Data Center Auditing Practices to Cloud Providers
CSPs typically do not allow access to physical machines in their data centers, and do not allow external parties on the floors of the cloud data center to protect themselves against potential breaches and others risks. While there are some cloud providers that allow companies and their auditors to tour a facility, the tour overall can be a distant view of machines with blinking lights, and it’s virtually impossible to know which machines host the data to be audited. So while a tour of a CSP center may sound reasonable, it generally is not time well spent and can end up being a “check the box” exercise to adhere to audit requirements.

Understanding the Delineations of a Shared Responsibility Model
Cloud’s ability to provide cost-effective automation in areas such as compliance audits, for example, enables cross-functional teams to work on projects from the initial stages and innovate while maintaining critical controls. Automation also may allow for more effective compliance processes. Rather than sample testing technology limitations, an automated monitoring system could produce a comprehensive report of red-flag incidents taking place in the system. That kind of sweeping monitoring was often cost-prohibitive before cloud technology was available.

Working Together on the Cloud
Risk and compliance teams play an important role in the adoption of cloud, particularly with respect to determining policies and requirements and reviewing how the architecture and design address those requirements. 'Tis the Season for Mobile Threats
During the third quarter of 2018, over a quarter of organizations also experienced some sort of malware attack originating from those mobile devices, with Android operating systems being the primary attack vector. In fact, Android-based threats now comprise 14% of all cyberthreats that organizations have to contend with. This shouldn’t come as too much of a surprise, since over 80% of smartphones, tablets, and other mobile devices now run some version of Android OS.

Magecart Cybercrime Groups Harvest Payment Card Data
Card-Scraping Code Has Infiltrated Over 100,000 E-Commerce Sites

"Magecart is an umbrella term given to at least seven cybercriminal groups that are placing digital credit card skimmers on compromised e-commerce sites at an unprecedented rate and with frightening success," according to a new report from security firms RiskIQ and Flashpoint.

To be clear: Magecart is a term applied to multiple attack groups that share a similar - and unfortunately very effective - cybercrime modus operandi.

Magecart attacks are characterized by attackers using certain types of "digital skimmers," or code designed to swipe information disclosed during e-commerce transactions.

So far, RiskIQ has counted at least seven cybercrime groups that it classifies as being part of Magecart, although it says that's not meant to be an exact figure.

Beyond British Airways, Newegg and Ticketmaster, other victims of Magecart named in the report - all previously notified by researchers and the infections curtailed - include Annex Cloud, Clarity Connect, CompanyBe, Conversions On Demand, Feedify, flashtalking, Inbenta, PushAssist, SAS Net Reviews, ShopBack, Shopper Approved and SociaPlus.

"We break down the first six groups of the set we track, but there are many more groups and individuals taking part in Magecart web skimming," according to the report, which is meant to highlight some of the tactics these groups employ as well as the scale at which they can operate. databreachtoday.com

Is App-Install Fraud on the Rise?
Fraudsters are trying to make a buck off the ad dollars that flow to mobile.

Over the past 12 months, mobile attribution firm AppsFlyer analyzed 17 billion app installs across 7,000 apps worldwide. It found that the amount of install fraud roughly tripled. More than one-quarter of the installs that AppsFlyer analyzed in that timeframe were fraudulent.

eMarketer estimates that $7.1 billion will be spent on mobile app install ads in 2018, up from $6.5 billion last year. App-install fraud refers to the practice where a company falsely gets credit for getting a user to download an app.

“Many companies study app-install fraud where fake mobile devices install apps and get credit for the install,” said Augustine Fou, an independent ad fraud researcher. “Bad actors also take credit for organic installs [whereby] a user downloaded and installed the app because they wanted to, not because they saw an ad for it.” emarketer.com

E-commerce grocery demand doubles this Thanksgiving
Digital Grocery Survey: 2018 Holiday Edition consumer survey. The study finds that more than 4 in 10 Americans (44%) plan to shop online for some or all of the groceries they need for their Thanksgiving or holiday meal this year. This is more than twice as many people who shopped online for Thanksgiving groceries in 2017.

Update: Pennsylvania Man Charged with Transporting Stolen Electronics Across State Lines
Defendant allegedly broke into various Target stores with blow torch - Faces Federal Charges

A Pennsylvania man was charged in federal court in Worcester today in connection with transporting stolen electronics across state lines. Defendant allegedly broke into Target stores in Easton and Westborough, Mass, and in Pennsylvania and Connecticut. 

Elijah Aiken, 35, of Allentown, Penn., was charged with one count of conspiring to transport stolen goods in interstate commerce and two counts of interstate transportation of stolen goods. Aiken appeared in federal court in Worcester today and was ordered detained.

From December 2014 until February 2015, Aiken allegedly conspired with others to break into numerous Target retail stores during early morning hours, usually by using portable blow torches to cut through the metal loading-dock doors at the rear of the stores. Once inside the Target stores, Aiken and his co-conspirators stole electronic devices valued at hundreds of thousands of dollars, including cellular phones and computer tablets. Aiken and his co-conspirator successfully burglarized Target stores in Easton and Westborough, Mass., as well as in Pennsylvania and Connecticut. Aiken transported the stolen electronics across state lines in order to sell them to buyers located in New York. 

The charge of interstate transportation of stolen goods, provides for a sentence of no greater than 10 years in prison, up to three years of supervised release, a fine of up to $250,000, and restitution in an amount determined by the court. The charge of conspiracy to transport stolen goods in interstate commerce, provides for a sentence of no greater than five years in prison, up to three years of supervised release, a fine of up to $250,000, and restitution as determined by the court. Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and other statutory factors. justice.gov


Stafford County, VA: Two Burglars flee AT&T with $80,000 of merchandise
A pair of burglars made off with about $80,000 worth of phones and cash from the AT&T store at 28 South Gateway Drive in south Stafford on Nov. 15, according to Stafford County Sheriff’s Office. Paragould, AR: Man stole $6,500 worth of “Christmas presents” from Walmart
Investigators say Josiah Bailey, 20, went to the Walmart store Sunday, selected a backpack, and tore the tags off it. “Bailey then proceeded to walk through the store stuffing additional merchandise into the bag as well as concealing it on his person,” the probable cause affidavit stated. During an interview with police, Bailey reportedly said he “stole the items for Christmas presents.” wtxl.com

Chambersburg, PA: Maryland woman wanted for theft of 7 vacuums from Target
Chambersburg police are searching for a woman from Frederick, Md., who stole vacuums from a Target in Chambersburg. Police said Gabriella Victoria Ayala, 29, stole seven vacuums over two days from the Target on Norland Ave. in Chambersburg. Ayala has been charged with two counts of retail theft. Police said the total cost of the stolen vacuums is $2,669.93. fox43.com

Police in suburban St. Louis on Monday were searching for a gunman who went into a religious supply store, sexually assaulted at least one woman and shot a woman in the head. The gunman walked into the store and sexually assaulted at least one woman — police spokesman Shaun McGuire said he couldn’t confirm media reports that more than one woman was assaulted. time.com

Chicago Police Superintendent Eddie Johnson says the four dead in the shooting at Mercy Hospital include two hospital employees, a Chicago police officer and the suspected gunman. Thieves Smash Through Nordstrom Window At The Grove
Thieves shattered a plate glass window at the Nordstrom store, just hours after thousands flocked to the Grove for the shopping center’s annual Christmas lighting event. The burglary was reported at about 4:45 a.m. at The Grove, where Los Angeles police found a shattered plate glass window and discarded black clothes on the ground beneath the window. Witnesses told police they saw as many as six men in masks use a sledgehammer to break the window, ran inside and grabbed men’s clothes and accessories. An 18-year-old is accused of hiding out in a Farmington JCPenney store until closing time and then stealing jewelry and watches. Tarik Mathis has been charged with burglary. Police said last week, he was caught on surveillance video hiding in a storage room inside of the business. He was eventually caught after the burglar alarm went off. A Grand Jury has indicted a man accused of shooting a police officer during a July 4 attempted robbery at a CVS pharmacy. Luis Armendariz Jr., 38, is charged with one count of attempt to commit capital murder of a peace officer, one count of aggravated robbery, three counts of aggravated assault against a public servant, six counts of aggravated assault with a deadly weapon and one count of theft of property valued between $30,000 and $150,000. Perception becomes reality slowly on a macro level and it's difficult to change it if it's incorrect or doesn't portray the truth.
