NRF Sends Letter to Congress Supporting First Step Act Reforming Nation's Criminal Justice System

David French, Senior Vice President, Government Relations, National Retail Federation (NRF), sent a letter of support for S. 3649, the First Step Act to Congress. This bipartisan legislation would make critical reforms to our nation’s criminal justice system, and NRF urges the Senate to move forward without delay.

The First Step Act’s emphasis on recidivism reduction programs and incentivizing inmate participation in these programs will help prepare incarcerated individuals for successful reentry into our communities and employment opportunities. Strasbourg, France: 3 dead, 12 injured after shooting near Christmas Market
Three people are dead and 12 wounded from a shooting Tuesday night in the French city of Strasbourg, the French interior minister said early Wednesday. Authorities meanwhile were continuing to search for the suspect who is on a terrorist watch list and whose home police had raided earlier in the day in a burglary probe.

The shooting took place shortly before 8 p.m. near a Christmas market in Strasbourg, France, that attracts millions of tourists every year. Strasbourg is on the German border. The suspect fled and engaged in a firefight with police between 10 p.m. and 11 p.m. local time, Interior Minister Christophe Castaner. He said the suspect has a record in France and Germany for common crimes. bbc.com

Hollywood, Los Angeles: $525-million wrongful-death lawsuit to be filed in shooting of homeless man by Walgreens security guard
Attorneys for the family of a homeless man who was fatally shot by a Walgreens security guard in Hollywood earlier this month announced a wrongful death lawsuit against the company on Tuesday.

The attorneys are seeking $525 million after the death of 21-year-old Jonathan "Sky Young" Hart, who was killed in an alleged shoplifting incident on Dec. 2.

At a Ladera Heights news conference on Tuesday morning, attended by members of Hart's family, attorneys also called on District Attorney Jackie Lacey to "charge the security guard with manslaughter" and demanded that Walgreens "explain their rationale for putting profits over public safety, including putting armed security guards in their stores."

According to the Los Angeles Police Department, Hart and the security guard were involved in an altercation that turned physical at the store in the 1500 block of Vine Street. After being shot, Hart was transported to a hospital where he was pronounced dead.

"Jonathan Hart was profiled because he was homeless. He was harassed because he was gay, and he was shot because he was black," Douglas said.

Walgreens issued a statement regarding Hart's death: "We have extended our deepest and most sincere condolences to Mr. Hart's family. As a result of the tragic incident, we immediately terminated the security company, and we continue to fully cooperate in the ongoing police investigation," the statement said. abc7.com

Augusta, ME: 2 ex-workers sue Eddie Bauer, charging racism and pay fraud
Two former workers are suing Eddie Bauer LLC, saying they were victims of retaliation after reporting racist remarks by their managers’ at the Augusta store, as well as altered time sheets.

The complaint, which is at U.S. District Court in Bangor, says that while working there, the two women “observed and experienced a racially hostile environment created by their managers’ racist comments, racial slurs and racially motivated employment decisions, which they each found offensive and reported to management.”

The lawsuit charges violation of the state Whistleblower Protection Act, and violation of state and federal wage and hour laws. On Monday, the company responded to the women’s claims, denying the allegations involving racism and saying through attorney Melinda Caterine that it did nothing wrong and that the lawsuit should be dismissed. centralmaine.com

Taylor, TX: Three Sonic employees arrested after ecstasy pills found in 4-year-old boy's burger
Illicit drugs served in a fast food burger has led to three arrests in Taylor, Texas. Police say an ecstasy pill was found in the wrapper around a burger that was meant for a 4-year-old boy. Police went to the restaurant to investigate and ended up arresting three Sonic employees. One worker was arrested for possession of marijuana; another for having four warrants out for his arrest. One suspect, Robert Fisher owns RBM Imaging in Daytona Beach, a Xerox reseller, who gave Kyle Haynes and Bryan Day's sham company HDH Graphic 63 Xerox printers.

Although HDH Graphics made few, if any, prints with the printers, the defendants fraudulently represented to Xerox that HDH Graphics was making prints, using much more toner than the industry average, which deceived Xerox into shipping approximately $25,000,000 worth of toner to HDH Graphics. The defendants then sold the fraudulently obtained toner for approximately $11,000,000 to an individual in Miami, Florida. Kyle Haynes, Bryan Day, and Fisher shared the profits from the fraudulent sale of the Xerox toner.

In executing the scheme, the defendants repeatedly misrepresented to Xerox that they were making millions of prints with the toner, even though they never took most of the printers out of their boxes. The defendants provided Xerox with false usage profiles from the printers and false print samples that made it appear that the defendants were making the millions of prints and using much more toner than the industry average for each print. justice.gov

Huawei CFO facing extradition to US released on $10 million bail
The chief financial officer of Chinese tech giant Huawei has been released on bail in Canada, setting her up for a lengthy legal fight over extradition to the United States.

But the case of Meng Wanzhou, who was arrested in Vancouver earlier this month, took on a new dimension after US President Donald Trump suggested he may intervene in the legal saga if it would help his pursuit of a trade deal with China.

Holiday ID Fraud Report Shows 2018 Fraud Reaches 5 Year High
New data from Jumio reveals that online ID fraud attempts on government-issued IDs increased 22 percent worldwide during the 2018 Black Friday to Cyber Monday period compared to the non-holiday full-year average.

Attempted ID fraud perpetrated during the online identity verification stage, involving passports, driver’s licenses or ID cards, hit a five-year high, and increased 109 percent in 2018 from 2014 levels.

In the second edition of Jumio’s Holiday ID Fraud Report, attempted fraud is defined as an attempt by an individual to create a new online account by manipulating a government-issued ID. securitymagazine.com

Brick-and-mortar store traffic up 14% this holiday season
Retailers in malls, shopping centers, and streets will see a 49% lift in foot traffic on Dec. 15, contributing to a 14% year-over-year increase in Christmas traffic, according to a report from Foursquare.

“The CISO can’t win.” That’s how Kevin Mandia, CEO of FireEye Inc., sees the thankless job of the chief information security officer. Not only do they frequently lose their jobs when their company is breached, but simply trying to give other senior executives a dashboard of metrics about the state of cybersecurity at the firm is a no-win situation, Mr. Mandia said. “If I see all green [indicators], I don’t believe them. If some are red, I think, ‘Aw, now I have to do something about it,’” he said. “All yellow, and I don’t know what to think.”

Mr. Mandia’s observation captured some of the challenge for security executives and others attending the WSJ Pro Cybersecurity Executive Forum on Tuesday. Protecting and defending a company can be an expensive proposition with no clear roadmap and many variables are beyond your control.

Hackers don’t act according to the breach-response plan that business leaders practice. Supply-chain partners don’t always come clean about the holes in their own security that put your systems at risk.

Audit: No Chinese surveillance implants in Supermicro boards found

Equifax Hack ‘Entirely Preventable,’ Report Says
Hackers were able to perpetrate last year’s massive data breach at Equifax because there was a “culture of cybersecurity complacency” at the credit reporting bureau, a congressional report has concluded.

Biometrics, the Next Step in Authentication, Eases Into the Workplace
As cyber threats grow and become more sophisticated, companies are increasingly turning to biometric technology to help replace the legacy username and password sign-in measures. But tying authentication to physical information about users--like fingerprints and voices--or other user attributes also carries risks.

Speaking on a panel at the WSJ Pro Cybersecurity Executive Forum on Tuesday, Ellen Richey, the vice chairman and head of risk and public policy at Visa Inc., said that the company is increasingly pivoting towards using biometrics and user behavior patterns to protect their customers from fraud.

To safeguard against fraud, she suggested employing multiple biometrics in tandem.

"The data is so diverse. Replicating with high accuracy is very difficult,” Ms. Pantic said. Ms. Richey said that she expects the adoption of biometrics measures to take root within the next five years. wsj.com

Canadian military retailer warns customers after 'malicious attack' compromised hundreds of credit cards
A Canadian retailer that caters to military personnel and their families is warning its members to monitor their personal information closely after a "malicious attack" may have exposed credit card numbers and other personal information. In a statement posted online, Canex says its website was the subject of an attack between Nov. 14 and Nov. 21.

Canex learned of the attack on Nov. 22, immediately shut down its website, and then called in an IT security firm. Canex was able to establish that 373 customers had their credit cards compromised. Those people are either military personnel or families of military members.

Canex contacted the 373 customers by email on the evening of Nov. 22 to make them aware of the breach, and followed up with phone calls the next morning. It is offering to pay for a year's worth of credit monitoring for all of the customers whose information was breached. cbc.ca

Holiday Spending in Canada: High in Ontario, Low in Quebec
A recent survey by the Retail Council of Canada asked people across the country about their shopping behaviours, specifically around the holiday season. Shoppers in Saskatchewan plan on spending almost the lowest in the country at $611 a person. That figure includes extras like travel. Quebec is the only province that’s out-thrifting Saskatchewan, coming in at $458 per shopper.

According to the data, Ontario has the season’s most extravagant shoppers with survey respondents there planning on spending an average of $805 this Christmas. In addition to spending on Christmas gifts and travel, those provincial numbers include spending on food, alcohol, and holiday entertainment, like a work Christmas party. Interestingly, the Retail Council says while most Canadians say they plan on sticking to a firm budget, it’s not always that easy. The Mayor of Toronto John Tory wants the Province of Ontario to give more agency to municipalities in deciding where retail cannabis stores can be located. Hamilton police say one of two people found suffering from stab wounds at a central mountain plaza has died from his injuries. Retailers Brace for Returns This Holiday Season
While retailers are hyper-focused on holiday sales, returns impact the bottom line.

According to data from B-Stock Solutions, a liquidation platform, around 11% to 13% of holiday purchases are returned with closer to 30% of online purchases being sent back. By their estimates, between $90 billion to $95 billion in holiday gifts will be returned this year.

Online shoppers have become accustomed to retailers like Warby Parker and Amazon that utilize try-before-you-buy programs and often "bracket," buying an item in more than one size or color and returning the unwanted merchandise, which has resulted in more returns than ever.

On the B-Stock platform, inventory generally rises 60% in Q1 vs. Q4 with February and March seeing the highest volumes. By category, books, music and movies have the highest holiday returns (up 125% in Q1), while health and beauty (50%) and toys and kids items (40%) also spike after the holidays.

No category is immune from returns. According to BodyBlock AI, half of US internet users are expecting to return clothing bought online during the 2018 holiday shopping season due to poor fit. Nearly three-fourths of respondents (72%) said they had returned apparel in the past because it didn't fit properly. emarketer.com

How fraudsters are attacking e‑commerce sites this holiday season
Overall, mobile and online transaction volumes jumped 20 percent from the same seven-day period last year, running from the day before Thanksgiving through to the day after Cyber Monday, according to the latest data from ThreatMetrix, a LexisNexis Risk Solutions Company.

These findings are based on an analysis of transactions and cyberattacks on the ThreatMetrix Digital Identity Network over the holiday shopping week, providing insight into global cybercrime patterns. As such, it offers the industry a first look at trends shaping this all-important season for retail and e-commerce.

Digital Decks the Halls with 20 Percent Growth in Transactions
From Thanksgiving through Cyber Monday, the total number of online and mobile payments grew by one-fifth year-over-year, offering further evidence that consumers are increasingly choosing holiday sofa surfing over elbowing their way through crowded malls.

Mobile Rings in 60 Percent of Online Purchases
This year, 59 percent of all online sales were made via smartphone or tablet, up from 52 percent in 2017.

Basket Sizes Rise—With a Side of Bah Humbug
The average basket value of transactions rejected as fraudulent was 2.7 times higher than the value of legitimate transactions—$250 versus $95. This suggests cyberthieves are attempting to exploit high transaction volumes during peak holiday shopping periods to hide fraudulent transactions.

‘Tis the Season for Sneak Attacks
That same dynamic played out in the key attack vector detected during this big holiday shopping week: automated bot attacks.

One major payments platform saw a high volume of bot attacks using session replay to hijack shoppers’ session IDs, indicating how fraudsters are attempting to capitalize on larger transaction volumes to try and overwhelm organizations with a high level of bot traffic.

Two suspects are under arrest in Johnson County, charged with robbery, criminal recklessness and shoplifting. Tiny Rabiu, 44 and Dominique Sheridan, 29, are charged after allegations of being involved in a violent shoplifting incident at Greenwood Park Mall. It happened Saturday at a Sears store. Police say the two women filled two shopping carts with items from the store than headed for their car. When a store employee tried to stop them, ”she maced him,“ a witness said. “I was afraid somebody was going to pull a gun out.” As the two tried to drive away, a shopper tried to block them with a shopping cart, according to the report. “The car ran into her and pushed her about 10 to 12 feet with her on the hood before she fell off onto the ground,” said the witness. The report says a police officer patrolling nearby spotted the women trying to get away and arrested them. Police say the illegal shopping spree was valued at more than $4,000, from clothes to jewelry, toys to shoes. wthr.com

Orange County, FL: Amazon worker accused of stealing eyebrow makeup, gift cards and electronics accessories
An Amazon distribution center worker admitted to stealing thousands of dollars in gift cards and electronics accessories, the Orange County Sheriff's Office said. Investigators said Elvis Soto, 20, took several Amazon gift cards, including one worth $2,000, and two $200 Visa gift cards since November. Deputies said he also stole iPhone cases, an Apple Watch band and eyebrow makeup. The company said it reimbursed customers. The report said Soto used to work at an Amazon facility in Pennsylvania. Soto was charged with grand theft. wftv.com

Lower Marion Township, PA: Two men get away with $17K worth of Newport cigarettes in 7-Eleven robbery
According to police, two men wearing all black clothing and ski masks entered the 7-Eleven store at 169 E. City Ave. Dec. 8 shortly after 5 a.m. According to the report made by the store manager to police, one of the men locked the door while the other man walked up to the clerk with a metal rod in his hand. The man forced the female clerk into a back room. They then took seven boxes of Newport cigarettes. Each box contained 30 cartons of cigarettes. The stolen cigarettes were valued at about $17,000. mainlinemedianews.com

Harrisburg, PA: Rite Aid Pharmacy Armed Robbers flee with over 2,000 Hydrocodone pills
Employees told police three people came into the store, with one staying at the front and the other two going to the pharmacy and jumping the counter, police said. One suspect hit a pharmacist over the head with a gun. One robber demanded a pharmacist provide “Oxys,” but the pharmacist told the robbers they had none. Instead, the pharmacist gave the robber “around 2,000 hydrocodone pills,” police said. pennlive.com

Update: Sherborn, MA: Three arrested in Walgreen Armed Robbery; over 9,500 pills stolen
Following a months-long investigation, three men have been charged with a carefully-planned September robbery of a Sherborn pharmacy. Authorities say the three men worked together to rob the Walgreens Pharmacy, 19 North Main St., on Sept. 15 at 8:06 a.m. They say two men who were wearing masks went into the pharmacy, one man holding a handgun and the other a crowbar. The two men ordered a pharmacist to open the safe that contained drugs, and also pulled drugs from the shelves in the pharmacy. In all, authorities said the men stole more than 9,500 various pills. metrowestdailynews.com

Colorado Springs, CO: Man believed to be connected to 17 Armed Robberies arrested; victims included Wendy’s, Subway, Carl JR., and Starbucks
A man suspected of being behind 17 armed robberies in the past four months was arrested on Monday. Lt. Black with CSPD reported that Cody Croker, 34, was the suspect in those robberies. Two of which, Crocker is accused of firing his handgun off during the robbery. The robberies occurred at convenience stores and fast food restaurants. fox21news.com

Troy, MI: Police investigate whether Jewelry Store Thefts are linked; Tiffany & Co. hit in Somerset Mall
Troy police say a "handful" of high-end jewelry was stolen from Tiffany & Co. from the Somerset Collection on W. Big Beaver Road on Monday night. The theft comes four days after a similar incident took place at Kay Jewelers at the Mall at Partridge Creek on Hall Road in Clinton Township.

Troy police Sgt. Meghan Lehman said a single thief entered the luxury retailer store about 8:30 p.m. Monday, deployed pepper spray at a security guard and used a hammer to break the glass of a display case. The thief grabbed the jewelry and fled on foot. Police did not release the total value of the stolen merchandise or description of the thief. macombdaily.com

New Brunswick, NJ: Rutgers football report: 8 players indicted in credit card scheme
The eight men who were either dismissed or suspended from the Rutgers football team last summer were charged in a nine-count indictment that accuses them of fraudulent use of a credit card. The indictment, dated Dec. 5, came from a grand jury of the Middlesex County Superior Court. Authorities allege the players used the dark web to snag credit card numbers and transferred funds to various Rutgers Express debit-card accounts for personal use. Brendan Devera, (Linebaker who was dismissed from the teamin July, had his most serious charges dropped) was charged with a second-degree crime as the "organizer'' of a credit-card fraud scheme that enlisted seven other Rutgers football players and resulted in the alleged theft of $11,450 from victims. nj.com
