HD Security Negligence: Failure to Search & Properly Detain Suspect
Families of Dallas police officers shot in 2018 sue Home Depot, Security & Allied
The families of two Dallas officers shot last year inside a Home Depot have filed a lawsuit against the killer, the home-improvement store, a Dallas-based security company and two people who worked security that day.

The April 24, 2018, shooting at the store near Forest Lane and U.S. Highway 75 left officer Rogelio Santander Jr. dead and Crystal Almeida seriously wounded.

The two families’ lawsuit, filed Friday in Dallas County, alleges negligence by Home Depot. At the center of the suit is the allegation is that security officers at the retailer “failed to perform an adequate search” and properly detain shoplifting suspect Armando Luis Juarez.

When Almeida and Santander showed up to the Home Depot, the officers “were under the belief that Juarez had been appropriately detained, searched, and pat-down for weapons,” the lawsuit said.

According to the lawsuit, when a business detains a suspected criminal and calls in the police, “it is a standard industry practice” for security to search and disarm a suspect before the suspect is detained and before the police arrive.”

“It is also a standard practice to handcuff a detained individual until they are released,” the lawsuit said. Juarez was unrestrained, according to the suit.

The lawsuit states Home Depot hired Allied Universal Security Services and off-duty police officers after the store saw increased criminal activity. But the suit also faulted Home Depot for not allowing security to carry firearms. dallasnews.com

Mobile Pay Fraud - Here it Comes
Miami Man Pleads Guilty To $1.5M Apple Pay Fraud Conspiracy Hitting Retailers

Daniel Butler, 29, and his co-conspirators fraudulently obtained access to at least 477 credit card accounts and linked those accounts to the Apple Pay application on their iPhones. Then, using their iPhones, Butler and the others made purchases using the victims’ credit card accounts, all without having to present actual credit cards to retailers. The group made more than $1.5 million in fraudulent purchases.

Three co-conspirators previously pleaded guilty for their roles in this scheme. Johnny Max Wesley (23, Miami) was sentenced in December 2018 to four years in federal prison. Laurent Pierre Louis (30, Miami) is scheduled to be sentenced on July 25, 2019, and Rachel Bishop (26, Miami), is scheduled to be sentenced on September 18, 2019.

Butler faces a minimum mandatory sentence of 2 years in federal prison for the aggravated identity theft count and up to 20 years in federal prison for the wire fraud count. justice.gov

India's Welspun - Global Egyptian Cotton Counterfeiting Case
Walmart, Target, Bed Bath must face lawsuit over fake 'Egyptian' cotton

A federal judge said Walmart Inc, Target Corp and Bed Bath & Beyond Inc must face a lawsuit claiming they sold linens that were falsely labeled “100% Egyptian Cotton” or “100% Long-Staple Egyptian cotton” despite being suspicious of their origin. U.S. District Judge, White Plains, New York, addressed claims that consumers nationwide overpaid for mislabeled cotton produced by an Indian textile company, Welspun India Ltd.

He dismissed fraud claims against the retailers because there was no “strong inference of fraudulent intent.” New York and California consumers were allowed to sue the retailers under their respective state's consumer protection laws.

According to the complaint, the retailers sold Welspun’s “Egyptian” cotton well into 2016 even though Target and Bed Bath & Beyond had known for several months, and Walmart had known as early as 2008, that the cotton was mislabeled. reuters.com

Editor's Note: The CEO of India's Welspun actually knew they were selling more Egyptian cotton than what can actually be produced annually. All the retailers dropped them once reported in the news outlets which we reported on as well.

This was huge at the time and indeed it was fraud and counterfeit on the part of Welspun but certainly not on any retailers part. In addition there hasn't been any news about the impact on Welspun or any criminal charges.

1st Major International Europol 'Cyber Patrol' Op
"Postbox ll" - 30 Suspects, 2,320 Seizures & 50 Cases

Took place in March 2019 and involved customs experts from 22 Member States and Europol. Focusing on criminals working on both the open and the Dark Web, Postbox II led to 2320 seizures, the opening of 50 case files and identification of 30 suspects in Member States.

Customs authorities checked mail and courier service packages for prohibited items. What followed was the assembly of an expert cyber patrol which raided both the open web and the dark net, as well as social media sites, in search of the perpetrators of the crimes. Investigators used special software and techniques to pierce the sellers' online veil of anonymity.

The main findings: Asian e-commerce platforms still responsible for the majority of counterfeit sales. Drug trafficking takes place mainly on the Dark Web. europa.eu

NYC: Will a massive new mall strike gold or strike out?
Staten Island's Empire Outlets & Amazon Warehouse Side by Side

Anybody Taking Bets?
It sometimes feels like Staten Island is in a time warp—perhaps never more so than last week, when political and real estate honchos descended on its North Shore to celebrate something downright quaint: a new mall.

Of its $304 million in construction costs, Hochul said, $55 million came in the form of state subsidies. "We think that money was well-spent," she said, according to the Staten Island Advance. "I'd like to quote from my favorite baseball movie: If you build it, they will come."

Unlike in Field of Dreams, "they" refers to the millions of tourists who ride the Staten Island Ferry to St. George for the view and quickly return to Manhattan. The hope is that famous brands and low prices will tempt the travelers into spending time and money in the "forgotten borough."

In the meantime, Amazon opened a $100 million warehouse center a few miles away. Can the Seattle-based mall-slayer and Empire Outlets coexist? crainsnewyork.com

When the going gets tough, the tough get transparent
Everyone deals with setbacks and crisis management. Think about the recent news blunders with Uber, AirBnB, and even KFC. I think what sets all these stories apart from damage control done in years past is that honesty and change are now a requirement in the aftermath.

Most Millennials say they care more about what a company stands for than their latest advertising gimmick. No business is perfect, and while we try to do our best, mistakes happen. And now it seems, we can be easily forgiven with a heartfelt apology and a roadmap for change.

These examples represent companies that have great PR agencies to help them navigate the recovery process, but there are still many businesses going the old school route by remaining silent. In the age of social media and instant communication, a business that wants to sustain its growth must be transparent with their customers, even during the tough times. retailwire.com

Spotlight on InstaKey

The Fresh Market Implements Better Controls for Locks and Keys in all Stores

LAKEWOOD, CO - InstaKey® Security Systems completes a new implementation with The Fresh Market, a leading specialty grocer, on their new lock and key management program designed to add process and structure to their mechanical key system, while lowering associated costs.

In less than three months, The Fresh Market converted 160+ stores nationwide, to the proprietary InstaKey Key Management System. All locations received new small format interchangeable lock hardware and Store Management uses InstaKey’s SecurityRecords.com® to issue keys and manage their key holder population.

“Every time we work with InstaKey, their commitment to us, the project and to their personal/corporate integrity shines through,” explains Joe Oliveira, CFI, Director of Asset Protection at The Fresh Market. “The InstaKey program is a huge success. The program has become part of our culture and it is helping us better protect our team members, guests, product, cash and data. We just couldn’t do it without InstaKey’s help and support. To top it off, converting an entire company in under three months has to be a world record!”

This new partnership with InstaKey also makes future lock changes easy. When keys are lost or unaccounted for, using user-rekeyable locks eliminates the need make an expensive locksmith callout when a step change key is the only tool required to complete a rekey. This allows for immediate lock changes to keep stores and areas within stores secure.

The software and service behind the lock hardware makes a significant difference in managing the key system, allowing The Fresh Market to easily take control of managing the system and reducing costs. This is accomplished through restricted keys that cannot be duplicated, cloud-based software that maintains and tracks the system’s integrity and a dedicated team of subject matter experts at InstaKey that help administrate the key system management with The Fresh Market team.

A Chinese Standoff?
Impacting the 5G Roll Out
Washington Issues Temporary License to Huawei

The US government has issued a temporary license to Huawei and its affiliates, allowing American companies to supply the telecoms and handset giant until August.

Despite reports emerging over the weekend of various chipmakers halting supplies to the Chinese firm after it was placed on an Entity List last week, the Commerce Department appears to have softened its stance.

Issued on Monday, the temporary general license for Huawei and 68 non-US affiliates will run for 90 days, bringing it up to August 19 2019.

It covers various areas, including: supplies to ensure Huawei’s networks and equipment are fully operational; software updates for existing Huawei handsets; and disclosure of any security vulnerabilities to the firm.

A new report by right-wing think tank the Henry Jackson Society co-authored by a Conservative MP and a former government security advisor claims there is “significant risk” in allowing Huawei to supply the UK’s 5G networks.

Huawei founder has also reportedly claimed that no company can catch Huawei in terms of its 5G technology, a fact that Western lawmakers are grappling with in weighing up how to treat the company and he said the US “underestimates” the firm’s capabilities and that it has already made efforts to mitigate the impact of any supply chain restrictions.

Lock the company out of 5G completely and it could add years to implementation, impacting customers — or at least, that’s Huawei's argument.

The report includes a foreword from former MI6 boss, Richard Dearlove, calling on the government to reconsider its position. infosecurity-magazine.com

Trump Held Off Punishing Huawei Until China Trade Talks Stalled
The Trump administration held off on blacklisting Huawei Technologies Co. out of concern the move could disrupt trade negotiations with China and only took action after the last round of talks hit an impasse, according to people familiar with the matter.

Plans to target the Chinese telecommunications equipment maker over security concerns had been on the table for months and included possibly subjecting Huawei to economic sanctions. But the decision to curtail the Shenzhen-based company’s access to American suppliers unfolded quickly once trade talks broke down, setting off a scramble to implement the measures, the people said. bloomberg.com

The China Warnings Continue
DHS Warns of Data Theft via Chinese-Made Drones

The US Department of Homeland Security warns Chinese-made drones could be transmitting flight data to manufacturers and, in doing so, make it accessible to the Chinese government. Chinese maker DJI makes 80% of drones used in the US and Canada, reports CNN, citing industry analysis. Law enforcement officials and infrastructure firms in the US have adopted and now rely on drones.

The Cybersecurity and Infrastructure Security Agency calls the drones "a potential risk to an organization's information," the report states, citing a copy of the alert obtained by CNN. Officials, who don't name drone makers, say drones "contain components that can compromise your data and share your information on a server accessed beyond the company itself."

DHS advises users to be cautious and turn off a drone's Internet connection before using. darkreading.com

How to Evaluate Threat Intelligence Vendors That Cover the Deep & Dark Web
How do you select the right vendor? Asking the following questions during your evaluation can help:

What types of sources does your collection strategy cover?

Not all vendors cover the same breadth and quality of DDW sources, so it’s crucial to ensure a vendor’s collection strategy includes, at a minimum, the following:

● Illicit marketplaces, as well as specialty shops such as card and account shops

● Communities frequented by threat actors who operate in languages other than English

● Closed sources including invitation-only and password-protected communities

● Demonstrated ability to discover and collect from new sources and technologies as threat actors adopt them

● Sources relevant to your function, organization, industry, and intelligence requirements (IRs). For fraud teams in the financial industry seeking to reduce fraud losses, these sources might entail card and account shops, forums frequented by fraudsters, and communities known to facilitate threats to financial institutions, for example.

Keep in mind that although the deep web and dark web are often conflated, they aren’t the same thing. The deep web is the expansive region of sites traditional search engines cannot access, while the dark web is a subcomponent of the deep web only accessible via specialized browsing software. Both harbor illicit sites, but in general, dark web sites are fewer and, in most cases, more easily accessible than their deep web counterparts, which more likely vet members. securityweek.com

HOW DATA CAN HELP BRANDS FIGHT AD FRAUD
Despite continued focus and effort by the digital advertising community, fraud continues to plague advertisers and technology platforms. It’s an ever-evolving and costly problem that is set to rob advertisers of $44 billion globally by 2020. While digital marketers are well aware of bad actors conspiring to steal their media budgets, the average consumer remains largely unaware of the threat.

That changed this past February when Oracle uncovered “DrainerBot,” a far-reaching and fraudulent mobile ad operation enabled by millions of downloads of infected consumer apps. These apps can consume more than 10GB of data per month by downloading hidden and unseen video ads. Not only did advertisers pay for impressions that were never seen by a human, but consumers were paying hundreds of dollars for data they never used while their device batteries were being drained by apps running in the background. This was one of the very first advertising fraud attacks that crossed over from the advertising ecosystem to the consumer landscape.

There are many types of digital ad fraud, but this specific version is called invalid traffic. And invalid traffic is an equal opportunity thief, affecting advertisers who lose dollars from impressions that aren’t served to a human, publishers who lose revenue when advertisers jump ship from not realizing ROI, and now consumers whose devices have become hosts for this activity.

So how can we stop this from happening? Marketers now have more channels and data than ever to reach relevant audiences more efficiently. But reaching relevant audiences online won’t matter if those audiences aren’t actual consumers. The first step is sophisticated data-driven measurement technologies that protect against fraud with transparency. For all parties to realize ROI on their spend, ads should be seen by someone who is not a bot on viewable inventory, adjacent to safe content. adage.com

Tigard, WA: FBI, Sheriff’s Office and Local Police bust elaborate Apple gift card scam
Tigard Police, along with federal and local law enforcement agencies, arrested five people who they believe were acting as criminal intermediaries in a widespread out-of-country scam involving Apple gift cards. On May 14, Tigard police and other agencies served multiple search warrants in Beaverton, unincorporated Portland and Oregon City in connection with the scammers demanding Apple gift card payments and then having area intermediaries quickly use the cards for purchases in the Portland-metro area, specifically in Tigard.

In addition to the arrests, police seized more than 300 devices including Apple watches, iPhones, AirPods, and iPads. Also, hundreds of used gift cards were discovered. This operation relates to a trend in the last few years where scammers ask victims to pay them with gift cards, said a Tigard police spokesperson. Whether it involves a social security, IRS, jury, computer support, or emergency scam, the fraudster instructs the victim to purchase a gift card and relay the card number over the phone, by email or text. By the time the victim realizes they have been defrauded, the gift card balance has already been depleted and they are unable to recover their money. Working with Apple and federal agents, CCU determined that scammers often operating out of the country were using paid intermediaries located in United States to spend balances obtained from stolen Apple gift cards on bulk purchases of iPhones and other products at Apple stores. pamplinmedia.com

Pasco, WA: Suspect arrested after 'Shoplifting' TWO Kayaks from Walmart
At 4:00 am Monday morning a man (who turned out to be wanted in Union Gap) decided it would be "easy" to shoplift a pair of kayaks from the front of the Pasco Walmart. Police say the suspect allegedly grabbed the full-size watercraft from a display out front. The store security cameras captured good views of the suspect, his large black Ford truck, and the items. It just so happened a Pasco officer was driving on Interstate 182 headed west when the call came on his radio. He was right behind the suspect. The officer pulled over 29-year-old Cody Anthony Ricard and his contraband. He's in jail, the kayaks are back at Walmart, and all is well. Police say this is the first time in years they've seen someone try to make off with such large items from an outdoor display. newstalk870.am

Memphis, TN: Loss Prevention uses tracker to locate $4,000 of stolen cigarettes
Mohamed Saleh and Faroq Hidar are both charged under the Organized Retail Crime Prevention Act. Matayo Seawood said Thursday night was his second day on the job at the Murphy Express when three young-looking men strolled in. “One of them came and distracted my co-worker. The other two came behind the counter,” Seawood said. Seawood said the men started grabbing cartons of cigarettes as well as a tote full of them. When Seawood confronted one of the suspects, he said they gave the impression they had a gun.

The next day, police said they got a call from the store’s loss prevention officer. Apparently, the tote full of cigarettes came with a tracking device and it was pinging at the Raleigh Express. Police say surveillance video shows Hidar unloading cigarettes from an unknown man’s car and carrying them inside the Raleigh Express. When police searched the store, they said they found a pink tote with a Murphy’s label on it. A man who identified himself as Hidar’s uncle disputed the police account. wreg.com

New Port Richey, FL : Walmart clerks marked down video games, bought them and resold for $5,000 profit

They each face charges of scheming to defraud, and Lulow faces additional charges of dealing in stolen property and false verification of ownership. The two men were part of a four-person scheme to defraud the Walmart Supercenter, deputies said. tampabay.com

Serial shoplifting suspect strikes another Home Depot, flashes knife at employee
A man who detectives believe is responsible for a "series" of shoplifting cases at Home Depots across the county recently struck another one — and flashed a knife an at employee while leaving the store. Earlier this month, Gwinnett County Police Department officers responded to the Home Depot on Satellite Boulevard in unincorporated Suwanee, where employees told them the suspect entered the business using the contractor entrance, according to Gwinnett County Police Department Cpl. Michele Pihera. "The lead detective assigned to this case believes that this suspect and his co-conspirator may be responsible for several other theft cases in Gwinnett and the metro-Atlanta area," Pihera said. gwinnettdailypost.com

We've all got great ideas and plans. The problem lies in putting them together, rolling them out and maximizing speed to market. Making it happen quickly and efficiently - that's the key to success. The first obstacle is always fear of risk. Making an idea a reality requires risk taking and sometimes you've just got to make it happen if your inner self, or the bird on your shoulder, tells you it's the right thing to do. I was writing this e-newsletter for a year before I walked in and just said hey we're doing it. Yes, I was absolutely fearful of all the critics and naysayers, but I took the risk and made it happen. There will always be torpedoes in the water and sometimes they hit. But to make things happen you've got to jump in the water and swim as fast as you can.

Just a Thought,
Gus
