Patrick Byrne, Overstock C.E.O., Resigns After Disclosing Romance With Russian Agent

For two decades as the chief executive of the online retailer Overstock.com, Patrick Byrne has never been far from controversy. He posted elaborate theories on his personal website, railed against an unnamed Wall Street figure he named the Sith Lord and then, last week, delivered the most eyebrow-lifting tale of all.

Mr. Byrne — operating on the advice, he said, of the Berkshire Hathaway chief executive Warren Buffett — disclosed that he had been in a romantic relationship with Maria Butina, a woman accused of being a Russian spy who tried to infiltrate circles of political power before the 2016 presidential election.

His statement, with its references to the “Deep State,” “Men in Black” and “political espionage,” sent his company’s shares sharply down and baffled investors. On Thursday, he resigned as Overstock’s chief executive and chairman, saying his continued presence was complicating the company’s business relationships. Those relationships, he said in an interview, included the kind necessary to fulfill his plan to sell the online retailer.

“My presence could — and likely would — be disruptive to strategic conversations that are occurring, one of which is with my most preferred suitor in the entire industry,” he told The New York Times. He declined to name that potential buyer.

He also said his presence could lead to problems for the company as it tried to renew indemnification insurance for its directors and officers. “The fact that I am so controversial has never been appealing to them, but I know it is salt in the wound now,” he said. nytimes.com

El Paso, TX: Walmart will reopen store; interior will be entirely new, memorial will be featured to honor those who were slain in the mass shooting
Walmart plans to reopen the El Paso store where 22 people were killed in a shooting earlier this month, the retail giant said Thursday, but the entire interior of the building will first be rebuilt. The renovated store will include an on-site memorial honoring the victims of the shooting, many of whom were Latino, and recognizing the "binational relationship between El Paso and Ciudad Juarez" just across the border in Mexico, Walmart spokesman Randy Hargrove said. The project is expected to take three to four months. Nearly all of the 400 employees at the El Paso store have been reassigned to other nearby locations, Hargrove said, and the Arkansas-based company believes reopening the store is "an important step in healing from this tragedy."  nbcnews.com

San Francisco Board Rebrands 'Convicted Felon' as 'Justice-Involved Person,' sanitizes other crime lingo
Crime-ridden San Francisco has introduced new sanitized language for criminals, getting rid of words such as “offender” and “addict” while changing “convicted felon” to “justice-involved person.” The Board of Supervisors adopted the changes last month even as the city reels from one of the highest crime rates in the country and staggering inequality exemplified by pervasive homelessness alongside Silicon Valley wealth. The local officials say the new language will help change people’s views about those who commit crimes.

According to the San Francisco Chronicle, from now on a convicted felon or an offender released from custody will be known as a “formerly incarcerated person,” or a “justice-involved” person or just a “returning resident.” A juvenile “delinquent” will now be called a “young person with justice system involvement,” or a “young person impacted by the juvenile justice system.” And drug addicts or substance abusers, meanwhile, will become “a person with a history of substance use.” “We don’t want people to be forever labeled for the worst things that they have done. We want them ultimately to become contributing citizens, and referring to them as felons is like a scarlet letter that they can never get away from,” said Supervisor Matt Haney.  foxnews.com

Toronto, CN: Circle K making it tough for violent thieves,
'Clear zone’ criminals risk rapid arrest

Thieves would think twice about targeting Circle K convenience stores if they knew how quickly the chain’s security team can respond to robberies. Sean Sportun, Circle K’s manager of security and loss prevention in central Canada, said the chain’s security team can put a perpetrator’s image onto the cell phones of officers on patrol within seconds of a robbery report. The security team can also quickly provide closed-circuit footage to relevant law-enforcement agencies. “The quicker we’re made aware of it, the quicker we can get video and images into the hands of law enforcement,” Sportun said in Hagersville Wednesday.

It works like this: High-resolution cameras in the chain’s 740 Ontario stores will capture a robbery in progress. If no one is hurt, the clerk calls the incident into Circle K’s central security office in Toronto. Security officers call up the relevant footage on a monitor, isolate images, and then blast them over the airwaves to police in the field. The rapid response team is on duty 24-hours-a-day, just like the stores themselves. simcoereformer.ca

Trump says he’s ordering American companies to immediately start looking for an alternative to China
President Donald Trump on Friday said he was ordering “our great American companies” to “immediately start looking for an alternative to China, including bringing your companies HOME and making your products in the USA.”

Trump also said he was ordering all U.S. postal carriers, including FedEx, Amazon, UPS and United States Post Office, “to SEARCH FOR & REFUSE all deliveries of Fentanyl from China (or anywhere else!).”

The White House did not immediately respond when asked if the announcement, delivered in a four-part Twitter thread Friday morning, constituted an official order from the president. cnbc.com

Barnes & Noble tops list of 10 most reputable U.S. retailers
The “unique emotional bond” Barnes & Noble has with the public helped it earn the only excellent rating, and the No. 1 ranking in the Reputation Institute’s US Retail RepTrak 2019, which studied the reputation of the best-known U.S. retailers. The annual study considered 81 nominated retailers across seven RepTrak criteria: products/services, innovation, workplace, governance, citizenship, leadership, and performance.

● Amazon ranked second in last year’s US Retail RepTrak, but did not make this year’s top 10 reputable retailers list. While the public’s level of trust and admiration for Amazon.com is in decline, the company still earned a strong rating due primarily to its strong financial performance and its prospects for growth.

● While the areas of products and services still matter, their importance is declining and being overtaken by the importance of a workplace that treats employees fairly and is concerned about employee health and well-being.

● The retail industry’s performance in the areas of governance and citizenship — corporate responsibility — is improving but has room for enhancement given an overall average score.

The top 10 most reputable U.S. retailers in the US Retail RepTrak 2019 study are:

1. Barnes & Noble
2. Costco Wholesale Corp.
3. Bass Pro Shops
4. Menards
5. Carter’s

6. Ace Hardware
7. Lowe’s
8. AutoZone
9. Kroger
10. Albertsons

Opinion: Cashless Stores Alienate Customers in the Name of Efficiency
Brands that do away with printed currency are unintentionally self-selecting their users.

Brands increasingly seek to provide "frictionless" experiences - a sense of ease and efficiency that enables users to engage with them on their terms. However, in a small but growing number of cases, frictionless means eliminating cash as an accepted payment method. This is a seemingly minor but significant shift in the retail landscape. As a society, it signals a shift away from inclusive commerce toward what might better be described as the age of the preferred customer. wired.com

Survey: Cash still king for certain purchases
Until transactions reach a certain amount, consumers are most likely to pay with cash. According to a new survey of 2,544 U.S. adults from CreditCards.com, 49% of respondents prefer to use cash for purchases of less than $10. Another 35% most often pay with debit cards and 16% use credit cards. Credit card payments for small purchases proved more popular among respondents with rewards credit cards (26%), while 43% said they preferred cash and 31% use debit cards. chainstoreage.com

Microsoft Tops Phishers' Favorite Brands as Facebook Spikes
Cybercriminals often exploit victims' familiarity with popular brands to manipulate them into falling for phishing campaigns. Microsoft is the most common brand to spoof, researchers report, with PayPal in second place and Facebook rapidly catching up in a close third.

The "Phisher's Favorites" report, released today by Vade Secure, ranks the 25 most impersonated brands in phishing attacks based on unique phishing URLs detected within each quarter. Microsoft has held the top spot every time, a trend it continued in the second quarter of 2019, when 20,217 unique Microsoft phishing URLs were detected — more than 222 per day.

It's easy to manipulate employees with fake Microsoft emails because the Office 365 platform "is the lifeblood of businesses," he continues. Most can't do their jobs without access to email, chat, and other productivity and file management tools, which is why they're compelled to take action when an email appears notifying them their Office 365 account has been suspended. Other phishing attacks may contain links to OneDrive or SharePoint documents, Vade analysts found. darkreading.com

Breach at Hy-Vee Supermarket Chain Tied to Sale of 5M+ Stolen Cards
On Tuesday of this week, one of the more popular underground stores peddling credit and debit card data stolen from hacked merchants announced a blockbuster new sale: More than 5.3 million new accounts belonging to cardholders from 35 U.S. states. Multiple sources now tell KrebsOnSecurity that the card data came from compromised gas pumps, coffee shops and restaurants operated by Hy-Vee, an Iowa-based company that operates a chain of more than 245 supermarkets throughout the Midwestern United States.

Hy-Vee, based in Des Moines, announced on Aug. 14 it was investigating a data breach involving payment processing systems that handle transactions at some Hy-Vee fuel pumps, drive-thru coffee shops and restaurants. The restaurants affected include Hy-Vee Market Grilles, Market Grille Expresses and Wahlburgers locations that the company owns and operates. Hy-Vee said it was too early to tell when the breach initially began or for how long intruders were inside their payment systems.

According to two sources who asked not to be identified for this story — including one at a major U.S. financial institution — the card data stolen from Hy-Vee is now being sold under the code name “Solar Energy,” at the infamous Joker’s Stash carding bazaar. krebsonsecurity.com

Terrorists Turn to Bitcoin for Funding, and They’re Learning Fast
Terrorists have been slow to join other criminal elements that have been drawn to Bitcoin and have used it for everything from drug purchases to money laundering.

But in recent months, government authorities and organizations that track terrorist financing have begun to raise alarms about an uptick in the number of Islamist terrorist organizations experimenting with Bitcoin and other digital coins.

The yields from individual campaigns appear to be modest — in the tens of thousands of dollars. But the authorities note that terrorist attacks often require little funding. And the groups’ use of cryptocurrencies appears to be getting more sophisticated. nytimes.com

N.Y.P.D. Detectives Gave a Boy, 12, a Soda. He Landed in a DNA Database.
New York City detectives questioning a boy facing a felony charge last year offered him a McDonald’s soda. When the boy left, they took the straw and tested it for his DNA. Although it did not match evidence found at a crime scene, his DNA was entered into the city’s genetic database. To have it removed, the child’s family had to petition a court and file an appeal, a process that took more than a year. The boy was 12.

The city’s DNA database has grown by nearly 29 percent over the last two years, and now has 82,473 genetic profiles, becoming a potentially potent tool for law enforcement but one that operates with little if any oversight. The New York Police Department has taken DNA samples from people convicted of crimes, as well as from people who are only arrested or sometimes simply questioned. The practice has exposed the Police Department to scrutiny over how the genetic material is collected and whether privacy rights are being violated, civil liberties lawyers said.  nytimes.com

WHITEPAPER: Learn how Under Armour introduced a game-changing loss prevention strategy

After establishing a new standard for electronic article surveillance (EAS) technology for its North American stores, Under Armour does have one lingering regret. "I could kick myself for not discovering this solution sooner," said Sean Donnelly, Sr. Director of Global Retail Asset Protection and Investigations for the premier activewear giant.

"My advice to other AP leaders is to not write things off by thinking that something looks too good to be true. Be open to challenging the status quo and willing to put new solutions to the test. We learned that openness pays big dividends, and it's an important part of servicing any rapidly growing business that prides itself on innovation."

Merchants Concerned by Potential Security Gap in EMVCo’s Secure Remote Commerce
Secure Remote Commerce (SRC) is a standardized e-commerce checkout method proposed by EMVCo in 2017. The stated goal of SRC is to “establish the foundation to deliver a consistent consumer checkout experience while increasing simplicity and security.” Practically speaking, the SRC product will be a unified pay button for e-commerce checkout that will house consumers’ payment cards securely in one location, whether they are American Express, Discover, MasterCard or Visa cards.

One of the main advantages EMVCo touts is that it will make guest checkout easier for consumers and more secure for merchants. The design philosophy guiding EMVCo is less consumer friction at checkout, which should lead to a better consumer experience and less cart abandonment. This is accomplished, in theory, because consumers only have to register and log into their SRC account once. From then on, as long as the consumer is transacting from the same computer, using the same internet connection and a few dozen other data points are consistent, they will not be prompted to login again.

Our analysis, however, has uncovered a potential gap in security we feel merchants should be aware of, and that EMVCo should address. Read more: cardnotpresent.com

Inventory Scarcity Messages in Online Retailing Can Backfire
Online companies often will alert shoppers that supplies of an item are about to run out. “Only eight left in stock.” “Only seven rooms left on our site.” “Five or fewer left at this price.” The goal is to whip up a buying frenzy, and the message is clear: Buy now or risk losing out.

Do these messages work? In a working paper, Arizona State University’s Sungho Park and Elliot Rabinovich, UCLA Anderson’s Christopher S. Tang and Arizona State’s Rui Yin sought to answer the question by analyzing sales data from an online retailer before and after a product was listed in short supply.

They found that in a regular retail setting (outside of special sales events), the notices hurt sales by reducing the number of daily purchases, especially of items typically bought in larger quantities. The messages did shorten the time between sales, but only for items that were purchased relatively infrequently.

The findings suggest that online retailers should be careful how they use scarcity messages, limiting them to items that move relatively slowly and that typically are purchased in small quantities. “An indiscriminate implementation of scarcity disclosure strategies across products will lead to suboptimal results,” the authors write. anderson.ucla.edu

Darlington County, SC: Darlington Co. Sheriff makes recommendations to Dollar General corporate after incidents at stores
Officials with the Darlington County Sheriff’s Office have asked corporate officials with Dollar General to take measures in light of two robberies and a theft at three different area stores over the last week. “The Sheriff is tremendously concerned about the safety and well-being of the employees and customers of the Dollar Generals in Darlington County,” said DCSO Lt. Robert Kilgo via email. Kilgo said recommendations were made to Dollar General’s corporate office that “were both of high and low financial investment.” “The law enforcement profession cannot be the only entity at the table attempting to prevent these crimes; it has to be a total collaboration of the private sector, other government entities and law enforcement,” Kilgo said. This request comes after a string of incidents at Darlington County Dollar General locations that began last Sunday. In the most recent instance, an armed robbery occurred at the Dollar General at 904 Lamar Hwy., around 10 p.m. Monday. A person entered the store carrying a weapon and demanded money, authorities said. No one was injured in the robbery.  wmbfnews.com

Muskogee, OK: Former Death Row Inmate wins freedom or new trial in 1984 C-Store murder case
For decades, two Ada men insisted from prison that they did not kidnap and murder a C- store clerk in 1984 despite their confessions to police. They claimed their admissions came from a dream. Those innocence claims attracted renewed national attention when the true-crime documentary series, "The Innocent Man," debuted on Netflix last December. "Based on the numerous constitutional violations that occurred in this case, it is clear Mr. Fontenot did not receive a fair trial to which he was entitled both under the laws of the state of Oklahoma and the U.S. Constitution," U.S. District Judge James H. Payne wrote. The judge ruled Fontenot, now 55, must be permanently released from custody or granted a new trial in 120 days. Perception becomes reality slowly on a macro level and it's difficult to change it if it's incorrect or doesn't portray the truth. It's the same reason law enforcement separates witnesses to ensure clarity and truth. The group mind becomes influenced by opinion and agendas and distorts the true reality. One can only rely on daily vigilance based on doing what's right to hopefully impact the individuals one works with on a daily basis to carry the experience forward and be witness to what is right.

Just a Thought,
Gus
